HomeMy WebLinkAbout2026-06-09 - RESOLUTIONS - FY2026-27 VISTA CYN WASTEWATER STANDBY CHARGERESOLUTION NO.26-29 "1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, CONTINUING THE VISTA CANYON WASTEWATER STANDBY CHARGE FOR FISCAL YEAR 2026-27 WHEREAS, the City Council, pursuant to the provisions of the Uniform Standby Charges Procedures Act Title 15, Division 2, Part 1, Chapter 12.4 of the State of California (Act), and in compliance with the substantive and procedural requirements of Article M D, section 4 of the California State Constitution (California Constitution) and the Proposition 218 Omnibus Implementation Act (Omnibus Act), being Government Code section 53750 et seq., (collectively, Assessment Law), at its meeting on June 26, 2018, approved the Engineer's Report dated September 26, 2017, (Engineer's Report) establishing the levy and collection of Standby Charge for the Vista Canyon Wastewater Standby District (District); and WHEREAS, the City Council desires to continue to levy and collect Standby Charge against parcels of land within the District for the Fiscal Year (FY) 2026-27, to pay the costs and expenses of operating, maintaining, and servicing the improvements within the District; and WHEREAS, the Standby Charges within the District are exempt from the assessment procedures set forth in Section 4 of Proposition 218, because they were formed by consent of the landowners, and the proceeds of the Standby Charge are used for purposes specified in Section 5 .� of Proposition 218; and the proposed rates per Equivalent Benefit Unit (EBU) are not proposed to increase by more than the standby rate increase approved by the landowners at the time the District was established; and WHEREAS, the particular charge applicable to land within the District, the method of its calculation, and the specific data used in its determination are as specified in the Engineer's Report, which is attached hereto and on file with the City Clerk of the City of Santa Clarita. NOW, THEREFORE, the City Council of the City of Santa Clarita, California, does hereby resolve as follows: SECTION 1: The above recitals are true and correct. SECTION 2: The City Council, pursuant to the Engineer's Report, finds that lands within the District are benefited as described in such report and on that basis, hereby continues the Standby Charge for fiscal year 2026-27 on land to which connection to the wastewater system is available. SECTION 3: The FY 2026-27 Wastewater Standby Charge is $547.54 per EBU as permitted in the Engineer's Report. SECTION 4: The City Council hereby directs staff to file said standby charges with the County Auditor for collection with the regular property taxes for FY 2026-27.
