AN ORDINANCE OF THE CITY OF SANTA
CLARITA, CALIFORNIA, IMPOSING A
MORATORIUM ON THE CONSTRUCTION OF
BILLBOARDS IN THE CITY OF SANTA CLARITA
AND PROVIDING THIS ORDINANCE IS ADOPTED
AS AN URGENCY MEASURE
WHEREAS, the City Council intends to refer to the
Community Development Department and the Planning Commission
for study and consideration the regulation of freestanding
business signs within the City of Santa Clarita; and
WHEREAS, Section 65858 of the Government Code of
the State of California authorizes the adoption of an
interim ordinance as an emergency measure prohibiting any
usage of land which may be in conflict with a contemplated
zoning proposal which the legislative body or the Planning
Commission is considering or studying or intends to study
within a reasonable period of time; and
WHEREAS, the City Council further finds that the
absence of this ordinance would create a serious threat to
the public peace, health, safety and welfare by reason of
the possibility of construction of oversized, unsafe or
distracting billboards within the City of Santa Clarita.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. No billboards, as defined in state law or
city ordinance, shall be erected within the mapped
boundaries of the City of Santa Clarita without prior
approval by the City Council of a conditional use permit.
SECTION 2. If any provision or clause of this
ordinance or the application thereof to any persons or
circumstances is held to be invalid, such invalidity shall
^� not affect other provisions or application of the ordinance
which can be given effect without the invalid provision or
application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 3. Violation of this ordinance is
punishable by a fine of not more than One Thousand Dollars
($1,000) or imprisonment in County Jail for a period of not
more than six (6) months or both such fine and
imprisonment. Each day during any portion of which any
violation of any provision of this ordinance is committed,
continued or permitted, constitutes a separate offense.
SECTION 4. This ordinance is adopted as an urgency
measure to protect the public peace, health, safety and
welfare, and shall take effect upon its adoption and
continue in effect for a period of no longer than forty-five
(45) days, provided, however, that after notice pursuant to
Section 65856 of the Government Code and a public hearing,
the City Council may extend the effectiveness of this
ordinance for a period of ten (10) months and fifteen (15)
days and thereafter for an additional period of one year.
PASSED, APPROVED, AND ADOPTED this 16th day of
