ORDINANCE NO. 88-44
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA AMENDING THE
OFFICIAL ZONING MAP (CASE NO. 87-570)
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council does hereby find and
determine as follows:
A. An application for a zone Change,
conditional use permit and oak tree permit, Case
No. 87-570, was duly filed by the Community
Development Commission of Los Angeles County,
represented by Sikand Engineering Associates, on
December 17, 1987. The application relates to the
real property generally described as the
southeasterly corner of Newhall Avenue and Market
Street, consisting of approximately 3.11 acres, and
r^ more specifically described in Exhibit "A" attached
and incorporated here by reference. The purpose of
the application is to allow development of a 65
unit seniors housing center consisting of 7 two-
story buildings, a recreation building, parking and
landscaping. The application seeks a rezoning from
O -S (Open Space) to R-4 (Unlimited Residence).
Staff has recommended rezoning the subject property
to R -3 -21.5U -DP (Limited Multiple Residence - 21.5
units per net acre Development Program).
a. The Planning Commission held a duly
noticed public hearing on the application on
April 5, 1988, continued to June 7, 1988, at Arroyo
Seco Junior High School, 2771 Vista Delgado, Santa
Clarita, California at 7:30 p.m. The Planning
Commission granted the conditional use permit and
oak tree permit by its Resolution No. P88-012, and
recommended by its Resolution No. P88-011 that the
City Council approve rezoning the subject property
to R -3 -21.5U -DP.

SECTION 2. Based upon the testimony and other
evidence received at the public hearing, and upon studies
and investigation made by the Planning Commission and City
Council and on their behalf, the City Council further finds
and determines as follows:
(1) The subject property is a vacant,
rectangularly -shaped 3.11 acre parcel located
at the southeasterly corner of Market Street
and Newhall Avenue.
(2) The request is for a change of zone
from 0-S (Open Space) to R-4 (Unlimited
Residence) in order to accommodate a related
proposal to develop a 65 -unit senior citizen
housing project on the site.
(3) The subject property is of a size
and shape which is suitable for the proposed
development.
�-, (4) There is a need to provide more
affordable housing opportunities for senior
Citizens which this project will help to
satisfy.
(5) The recommended R-3-21.SU-DP
(Limited Multiple Residence - 21.5 units per
net acre -Development Program) zoning
classification will not create any adverse
impacts to the environment which cannot be
mitigated through available controls.
(6) The site plan, in this case, is a
critical factor in the decision to rezone and
the DP (Development Program) and the required
Conditional Use Permit will ensure that the
site is developed in a manner which is
consistent with adjacent and surrounding land
uses.

(8) Establishment of the recommended
zone at the subject property is in the
interest of public health, safety, and general
welfare and in conformity with good zoning
practice.

(9) Rezoning the subject property to R-
3 -21.5U -DP is more appropriate than R-4, since
the R-4 zone allows densities up to 50 units
Per net acre, and the density of the proposed
development is 21 units per net acre.
Allowing 21.5 units per net acre will allow
flexibility in the event of unforeseen acreage
miscalculations.
(10) The project has received a negative
declaration pursuant to the California
Environmental Quality Act (Public Resources
Code Section 21000 et seq.
SECTION 3. In acting on the rezoning application,
the City Council has considered certain principals and
standards, and finds and determines as follows:
(1) That modified conditions warrant a
revision in the zoning plan as it pertains to
�-. the subject property; and
(2) That a need for the proposed zone
classification exists within the area of the
subject property; and
(3) That the subject property is a
proper location for the R -3 -21.5U -DP zone
classification;
(4) That placement of.the proposed zone
at the subject property will be in the
interest of public health, safety and general
welfare, and in conformity with good zoning
practice; and
(5) That rezoning the subject property
will not result in a need for a greater water
Supply for adequate fire protection; and
(6) That the City is proceeding in a
timely fashion with the preparation of a
general plan. There is a reasonable
probability that this rezoning will be
consistent with the general plan proposal
which will be studied within a reasonable
time. There is little or no probability of
substantial detriment to or interference with
the future adopted general plan if this

rezoning is ultimately inconsistent with the
plan. This rezoning complies with all other
applicable requirements of state law and local
ordinance.

ION
Council does Thereby ordain that the applicationthe forOatzone
change is approved, and that the official zoning map of the
City of Santa Clarita is hereby amended so that the subject
property is rezoned from 0-S to R -3 -21.5U -DP.
SECTION 5. The City Clerk shall Certify to the
adoption of this ordinance and cause it to be posted as
required by law.
PASSED, APPROVED AND ADOPTED this 10th day of
