HomeMy WebLinkAbout1988-06-23 - ORDINANCES - AMEND ZONING MAP 87 143 (2)ORDINANCE NO. 88-26 AN ORDINANCE OF THE CITY COUNCIL OF THE rte, CITY OF SANTA CLARITA AMENDING THE OFFICIAL ZONING MAP (CASE NO. 87-143) THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council does hereby find and determine as follows: A. An application for a zone change, conditional use permit and oak tree permit, Case No. 87-143, was duly filed by Anses Joseph Company, represented by Hale & Associates, Inc., on October 16, 1987. The application relates to the real property generally described as the south- easterly corner of West Lyons Avenue and North Wayman Street, consisting of approximately 1.83 acres, and more specifically described in Exhibit A attached and incorporated here by reference (the "subject property"). The purpose of the applica- tion is to allow development of a commercial shopping center consisting of two buildings totaling 31,873 square feet of floor area, and parking and landscaping. The application seeks a rezoning from R-1-6000 and C -2 -DP to C -3 -DP. Staff recommended rezoning all of the subject property to C -2 -DP. B. The Planning Commission held a duly noticed public hearing on the application on April S, 1988, continued to April 19, 1988, at Arroyo Seco Junior High School, 2771 Vista Delgado, Santa Clarita, California at 7:30 p.m. The Planning Commission granted the conditional use permit and oak tree permit by its Resolution No. P88-001, and recommended by its Resolution No. P88-002 that the City Council approve rezoning the subject property to C -2 -DP. C. The City Council held a duly noticed public hearing on the rezoning application at 7:30 p.m. on June 9, 1988, at Arroyo Seco Junior High School, 2771 Vista Delgado, Santa Clarita, California. MRW/ORD7.840 SECTION 2. Based upon the testimony and other evidence received at the public hearing, and upon studies and investigation made by the Planning Commission and City Council and on their behalf, the City Council further finds and determines as follows: (1) The subject property is a rectangularly -shaped 1.8 acre parcel located at the southeasterly corner of Lyons Avenue and North Wayman Street. (2) The request is for a change of zone from R-1-6,000 (Single Family residence - 6,000 square feet minimum required area) and C -2 -DP (Neighborhood Business -Development Program) to C -3 -DP (Unlimited Commercial - Development Program) in order to accommodate a related development proposal for a neighborhood shopping center. (3) The site plan, in this case, is a critical factor in the decision to rezone and the recommended DP (Development Program) addendum on file in this case will ensure that the site is developed in a manner consistent with surrounding land uses. (4) The subject property is of a size and shape which lends itself to the proposed development. (5) The subject property is located along Lyons Avenue which is the main east -west commercial corridor in the Newhall area. (6) The subject property represents an assemblage of individual properties, located in an older area in transition, which may be more appropriately developed in the manner proposed. (7) The subject property was previously designated for commercial use on a majority of the site, so the proposed development is largely consistent with the previous land use plan for the area. (8) The recommended change of zone will not result in a significant environmental effect. -2- ARW/ORD7$40 (9) Implementation of this proposal will cause no adverse effects in the environment which cannot be adequately mitigated through the application of available controls. (10) Rezoning the subject property to C -2 -DP is more appropriate than C -3 -DP because the C-3 zone permits high rise development and a greater intensity of uses which are not appropriate along West Lyons Avenue. (11) The project has received a negative declaration pursuant to the California Environmental Quality Act (Public Resources Code Sections 21000 et seq.). SECTION 3. In acting on the rezoning application, the City Council has considered certain principals and standards, and finds and determines as follows: (1) That modified conditions warrant a revision in the zoning plan as it pertains to the subject property; (2) That a need for the proposed zone classification exists within the area of the subject property; (3) That the subject property is a proper location for the C -2 -DP zone classification; (4) That placement of the proposed zone at the subject property will be in the interest of public health, safety and general welfare, and in conformity with good zoning practice; (5) That rezoning the subject property will not result in a need for a greater water supply for adequate fire protection; and (6) That the City is proceeding in a timely fashion with the preparation of a general plan. There is a reasonable probability that this rezoning will be consistent with the general plan proposal which will be studied within a reasonable time. There is little or no probability of -3- MRW/ORD7$40 substantial detriment to or interference with the future adopted general plan if this rezoning is ultimately inconsistent with the plan. This rezoning complies with all other applicable requirements of state law and local ordinance. SECTION 4. Based upon the foregoing, the City Council does hereby ordain that the application for a zone change is approved, and that the official zoning map of the City of Santa Clarita is hereby amended so that the subject property is rezoned from R-1-6,000 and C -2 -DP to C -2 -DP. SECTION 5. The City Clerk shall certify as to the passage of this ordinance and cause it to be posted as required by law. PASSED, APPROVED AND APPROVED this 23rd day of June , 1988. Northerly along the easterly lot line of said Lot 94 and Lots 95 and 96 of said Tract 1059 and their prolongation to its intersection with the center line for Lyons Avenue public roadway. Westerly along the center line of said Lyons Avenue to its intersection with the center line prolongation of North Wayman Street. Southerly along the center line of said North Wayman Street a public roadway to its intersection with a prolongation of the Southerly lot line for Lot 94 of said Tract No. 1059. Easterly along said prolongation and the southerly lot line of Lot 94 to the point of beginning.
