AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA EXTENDING A MORATORIUM ON THE
r"'+ CONSTRUCTION OF BILLBOARDS IN THE CITY OF SANTA
CLARITA AND PROVIDING THIS ORDINANCE IS ADOPTED AS
AN URGENCY MEASURE PURSUANT TO SECTION 65858 OF THE
GOVERNMENT CODE
WHEREAS, on December 16, 1987, the City Council of
the City of Santa Clarita adopted Ordinance No. 87-9
imposing a moratorium on the construction of billboards in
the City of Santa Clarita without prior approval by the City
Council of a conditional use permit; and
WHEREAS, Ordinance No. 87-9 was adopted as an
interim ordinance and an urgency measure pursuant to
Section 65858 of the Government Code of the State of
California; and
WHEREAS, Ordinance No. 87-9 was adopted to allow
for the development of special zoning regulations for
billboards; and
WHEREAS, City staff has begun to develop draft
zoning regulations which will be reviewed by the Planning
Commission of the City of Santa Clarita once the Commission
is established; and
WHEREAS, the concerns which lead to the adoption of
Ordinance No. 87-9 still exist; and
WHEREAS, as a consequence of the characteristics of
billboards as described in Ordinance No. 87-9, there
currently exists an immediate threat to the public peace,
health, safety, and welfare, and approval of construction of
billboards without proper regulations will result in
magnifying the threat to the public peace, health, safety,
and welfare.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
Section 1. No billboards, as defined in State law
or City ordinance, shall be erected within the mapped
boundaries of the City of Santa Clarita without prior
approval by the City Council of a conditional use permit.

Section 2. If any provision or clause of this
Ordinance or the application thereof to any persons or
circumstances is held to be invalid, such invalidity shall
not affect other provisions or applications of the Ordinance
which can be given effect without the invalid provision or
application, and to this end, the provisions of this
Ordinance are declared to be severable.
Section 3. Violation of this Ordinance is
punishable by a fine of not more than one thousand dollars
($1,000) or imprisonment in County jail for a period of not
more than six months or both such fine and imprisonment.
Each day during any portion of which any violation of any
provision of this Ordinance is committed, continued or
permitted, constitutes a separate offense.
Section 4. This Ordinance is adopted as an urgency
measure to protect the public peace, health, safety and
welfare and shall take effect at its adoption and continue
in effect for a period of no longer than six (6) months,
provided, however, that after notice pursuant to section
65856 of the Government Code and a public hearing, the City
Council may extend the effectiveness of this Ordinance for a
period of four (4) months and fifteen (15) days, and there-
after for a period of one year. A statement of facts
constituting the basis for adopting this interim ordinance
as an urgency Ordinance is set forth above. The legal
authority for the enactment of this Ordinance is section
65858 of the California Government Code and other applicable
statutes.
Section 5. The City Clerk shall certify to the
adoption of this ordinance and cause it to be published in
the manner required by law.

REPORT OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA
Subject: Ordinance 88-5 (Billboards Moratorium)
IT IS RECOGNIZED BY THE CITY COUNCIL OF THE CITY OF SANTA
CLARITA THAT:
1. The City of Santa Clarita (City) is a newly
incorporated city, formerly an unincorporated area of the
County of Los Angeles; and
2. The City is currently in the process of
establishing a Planning Commission as described in Ordinance
88-2, which is on file in the office of the City Manager of
the City; and
3. The City is currently actively recruiting a
Community Development Director, and persons to serve on
other City staff and advisory bodies; and
4. The existing City staff is in the process of
preparing zone drafts, evaluating planning documents and
collecting other materials pertinent to the construction of
billboards in the City; and
5. Once the Planning Commission, Community
Development Director, other city officers and staff are in
place, the drafts, documents and materials described above
may be submitted to such commissioners, directors officers
and staff, and a final recommendation can be made to the
City Council regarding billboards and the zoning regulations
of the City; and
6. As stated in Ordinance 88-5 the absence of a
billboard construction moratorium would create a serious
threat to the public peace, health, safety and welfare by
reason of the possibility of construction of oversize,
unsafe or distracting billboards within the City.
