ORDINANCE NO. 88-41
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA EXTENDING A
MORATORIUM ON THE ERECTION OF BILLBOARDS
IN THE CITY OF SANTA CLARITA AND
PROVIDING THIS ORDINANCE IS ADOPTED AS AN
URGENCY MEASURE PURSUANT TO SECTION 65858
OF THE GOVERNMENT CODE
WHEREAS, on July 28, 1988, the City Council of the
City of Santa Clarita adopted Ordinance No. 88-36 imposing a
moratorium on the construction of billboards in the City of
Santa Clarita without prior approval by the City Council of
a conditional use permit; and
WHEREAS, Ordinance No. 88-36 was adopted as an
interim ordinance and an urgency measure pursuant to
Section 65858 of the Government Code of the State of
California; and
WHEREAS, the City Council finds that the absence of
this Ordinance extending the moratorium imposed by 88-36
would create a serious and immediate threat to the public
�.; health, safety or welfare by reason of the possibility of
"construction of oversized, unsafe or distracting billboards
or billboards which would otherwise conflict with the
contemplated zoning regulations of the City of Santa
Clarita.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
Section 1. No billboards, as defined in the
general law of the State of California or City ordinance,
shall be erected within the mapped boundaries of the City of
Santa Clarita without prior approval by the City Council of
a conditional use permit.
Section 2. If any provision or clause of this
Ordinance or the application thereof to any persons or
circumstances is held to be invalid, such invalidity shall
not affect other provisions or applications of the Ordinance
which can be given effect without the invalid provision or
application, and to this end, the provisions of this
Ordinance are declared to be severable.
Section 3. Violation of this Ordinance is
p„ punishable by f ne of not more than one thousand dollars
($1,000) or imprisonment in County jail for,a period of not

more than six months or both such fine and imprisonment.
Each day during any portion of which any violation of any
provision of this Ordinance is committed, continued or
permitted, constitutes a separate offense.
Section 4. This Ordinance is adopted as an urgency
measure to protect the public peace, health, safety or
welfare and shall .take Effect at its adoption and continue
in effect for "a period of no longer than three (3) months
and five (5) days, provided, however, that after notice and
a public hearing pursuant to Section 65858 of the Government
Code of the State of California, the City Council may extend
the effectiveness of this Ordinance for a period of one
year. A statement of facts constituting the basis for
adopting this interim ordinance as an urgency Ordinance is
contained in Ordinance 88-36, adopted as an urgency measure
by the City Council on July 28, 1988. The legal authority
for the enactment of this Ordinance is section 65858 of the
California Government Code and other applicable statutes.
Section 5. The City Clerk shall certify to the
adoption of this ordinance and cause it to be published in
the manner prescribed by law.
PASSED, APPROVED, AND ADOPTED this 8th day of
September 1988.
