HomeMy WebLinkAbout1988-11-22 - RESOLUTIONS - TRAIL GRANT FUNDS (2)RESOLUTION NO. 88-156 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE TRAIL GRANT PROGRAM UNDER THE CALIFORNIA WILDLIFE, COASTAL, AND PARK LAND CONSERVATION ACT OF 1988 FOR THE PLACERITA EQUESTRIAN AND PEDESTRIAN UNDERCROSSING OF THE SOUTH FORK TRAIL - PLACERITA JUNCTION WHEREAS, the people of the State of California have enacted the California Wildlife, Coastal, and Park Land Conservation Act of 19881 which provides funds to the State of California and its political subdivisions for acquiring and/or developing facilities for public recreational and open space purposes; and WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by local agencies under the program; and WHEREAS said procedures established by the State Department of Parks and Recreation require the applicant to certify by resolution the approval of application(s) before submission of said application(s) of the state; and WHEREAS, said application(s) contain assurances that the applicant must comply with; and WHEREAS, the applicant will enter into an agreement with the State of California for acquisition or development of the project(s); NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Santa Clarita hereby: 1. Approves the filing of an application for the Trails Grant Program under the California Wildlife, Coastal, and Park Land Conservation Act of 1988 state grant assistance for the above project(s); and 2. Certifies that said applicant understands the assurances and certification in the application form; and 3. Certifies that said applicant has or will have sufficient funds to operate and maintain the project(s); and 4. Appoints the Los Angeles County Department of Parks and Recreation as agent of the City of Santa Clarita to conduct all negotiations, execute, and submit all documents, including, but not limited to applications, agreements, amendments, payment requests and so on, which may be necessary for the completion of the aforementioned project(s); and 5. Provided further that the City of Santa Clarita Drovide a maximum of 10% or $14,000 as matching funds to supplement the grant; and 6. City Clerk to certify to the adoption of this resolution. PASSED, APPROVED, AND ADOPTED this 22nd day of November 1988_ Mayor ATTEST: Citytqverk I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Santa Clarita, at a regular meeting thereof, held on the 22nd day of November _, 1988, by the following vote of the Council: AYES: COUNCILMEMBERS Boyer, Darcy, Heidt, Koontz, McKeon NOES: COUNCILMEMBERS None ABSENT: COUNCILMEMBERS None CL R 7 AGREEMENT THIS AGREEMENT, made and entered into this Z2nc71lay of November 19 88 , by and between the CITY OF SANTA CLARITA, A Municipal Corporation in the COUNTY OF LOS ANGELES, hereinafter referred to as "CITY" and the COUNTY OF LOS ANGELES, a political subdivision of the State of California, hereinafter referred to as "COUNTY". W I T N E S S E T H P, WHEREAS, the South Fork Trail is on the County Master Plan of horse trails; and WHEREAS, the South Fork Trail is a regional trail which contributes significantly as a recreational corridor linking a population center with unique mountain scenic recreational opportunities in the Angeles National Forest; and WHEREAS, the undercrossing within the boundaries of the City, as shown in Exhibit A, will benefit residents of the unincorporated area as well as the incorporated subdivisions within the City; and WHEREAS, the project is in the general interest of safety for residents of both City and County; and NOW, THEREFORE, in consideration of the mutual benefits to be derived by both City and County and of the premises herein contained, it is hereby agreed as follows: I . City Agrees: r^ a. The City agrees to allow public access for the purpose of hiking and equestrian use. b. The City further agrees to grant the County an equestrian easement necessary access to insure construction, maintenance, and public use of the area. 2. County Agrees: y a. To act in the City's behalf as lead agency in the construction of the equestrian/hiking tunnel at the junction of Placerita Creek and the South Fork of the Santa Clara River. b. Upon completion of project to maintain all project improvements. C. Maintenance of the project shall be limited to sweeping and repair of improvements as the County finds necessary for trail safety. 3. IT IS MUTUALLY UNDERSTOOD AND AGREED TO AS FOLLOWS: a. Neither County nor any officer or employee of County shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by City under or in connection with any work, authority, or jurisdiction delegated to City under this Agreement. It is also understood and agreed that, pursuant to Government Code Section 895.4, City shall fully indemnify, defend, and hold County harmless from any liability imposed for injury (a defined by Government Code Section 810.8) occurring by reason of anything done or omitted to be done by City under or in connection with any work, authority, or jurisdiction delegated to City under this n Agreement. - 2 - b. Neither City, nor any officer or employee of City, shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by County under or in connection with any work authority, or jurisdiction delegated to County Under this Agreement. It is also understood and agreed that, pursuant to Government Code Section 895.4, County shall fully indemnify, defend, and hold City harmless from any liability imposed for injury (as defined by Government Code Section 810.8) occurring by reason of anything done or omitted to be done by County under or in connection with any work, authority, or jurisdiction delegated to County under this Agreement. C. The parties hereto agree that the Assumption of Liability Agreement executed by the parties to this Agreement and approved by the Board of Supervisors is inapplicable to this Agreement.
