HomeMy WebLinkAbout1989-12-12 - ORDINANCES - AMEND ZONE MAP ZC 88 490 (2)ORDINANCE NO. 89-24 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA AMENDING THE OFFICIAL ZONING MAP (Zone Change Case No. 88-490) THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council does hereby find and determine as follows: a. An application for a zone change was filed with the City of Santa Clarita Department of Community Development on October 25, 1988, by Richard Howe ("the applicant"). The purpose of the zone change application is to facilitate the establishment of a commercial center at 23503-23533 San Fernando Road, and further described in the attached Legal Description (Exhibit "A") and shown on the attached map (Exhibit "B"), which was approved by the Planning Commission (Resolution 89-20). b. The Planning Commission held a duly noticed public hearing on the application on July 18, 1989 at the City Council Chambers, 23920 Valencia Boulevard, Santa Clarita, at 7:30 p.m. The Planning Commission adopted Resolution No. 89-20 recommending approval to the City Council of the requested zone change. c. The City Council held a duly noticed public hearing on the rezoning application on November 14, 1989 at the City Council Chambers, 23920 Valencia Boulevard, Santa Clarita, at 6:30 p.m. SECTION 2. Based upon the testimony and other evidence received at the public hearing, and upon studies and investigation made by the Planning Commission and the City Council and on their behalf, the City Council further finds and determines as follows: a. The subject property is a 2.36 acre parcel located on the southwesterly corner of San Fernando Road and Meadow Ridge b. The request is for a change of zone from A-2-1 (Heavy Agricultural) to CPD (Commercial Planned Development) to authorize the establishment of a commercial center on the site. C. The subject property is of a size and shape which lends itself to the proposed uses that would be established as a result of this request. d. The subject property is located on a commercial highway and is a planned commercial development area. e. The City is proceeding in a timely manner with the preparation of a general plan. There is a reasonable probability that this project will be consistent with the future general plan. f. The recommended change of zone from A-2-1, will not result in a significant environmental effect. g. The project has received a Negative Declaration pursuant to the California Environmental Quality Act (Public Resources Code Sections 21000 et seq.). SECTION 3. In acting on the rezoning application, the City Council has considered certain principles and standards, and finds and determines as follows: a. That modified conditions warrant a revision in the zoning plan as it pertains to the subject property; b. That a need for the proposed zone classification exists within the area of the subject property; c. That the subject property is a proper location for the Commercial Planned Development Zone classification; d. That the placement of the proposed zone at the subject property will be in the interest of public health, safety and general welfare, and in conformity with good zoning practice; e. That rezoning the subject property will not result in a need for greater water supply for adequate fire protection; and, f. That the City is proceeding in a timely fashion with the preparation of a general plan. There is a reasonable probability that this rezoning will be consistent with the general plan proposal which will be studied within a reasonable time. There is little or no probability of substantial detriment to or interference with the future adopted general plan if this rezoning is ultimately inconsistent with the plan. This rezoning complies with all other applicable requirements of state law and local ordinance. SECTION 4. An existing Urgency Zoning Ordinance is currently in effect in the A-2 Heavy Agricultural Zone. The Council finds that this project is appropriate for a zone change as it is not inconsistent with the general intent and purpose of the A-2 Urgency Ordinance. A Conditional Use Permit (CUP) was approved by the Planning Commission on July 18, 1989 which is consistent with the requirements for a CUP under the Urgency Ordinance. r SECTION 5. Based upon the foregoing, the City Council does hereby-erdain_that:the�capplication for:. -a: -zone change is approved, and that the official zoning map of the City of Santa Clarita is hereby amended so that the subject property is rezoned from A-2-1 to.CPD. SECTION 6. The City Clerk shall certify as to the passage of this Ordinance and cause it to be published in the manner prescribed by law; PASSED AND APPROVED this 12thday of December , 1989.
