HomeMy WebLinkAbout1989-03-14 - ORDINANCES - PUBLIC WORKS BID REQUIREMENTS (2)ORDINANCE NO. 89-8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING THE MUNICIPAL CODE TO ADD CHAPTER 3.14 TO TITLE 3, RELATING TO PUBLIC WORKS BID REQUIREMENTS AND AMENDING SECTIONS 3.12.120, 3.12.170 AND 3.12.175 OF CHAPTER 3.12 OF TITLE 3, RELATING TO PURCHASES THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES ORDAIN AS FOLLOWS: SECTION 1: Chapter 3.14 is hereby added to Title 3 of the Santa Clarita Municipal Code to read as follows: "PUBLIC WORKS BID REQUIREMENTS 3.14.010 Purpose. This Chapter is enacted for the purpose of implementing the Uniform Public Construction Cost Accounting Act (Public Contracts Section 22000 et seq.) and to provide for bidding procedures in undertaking public works projects. 3.14.020 Bid Limitations. The following bid limitations shall be in effect: (a) Public projects of $15,000 or less may be performed by City employees by force account, by negotiated contract, or by purchase order, as approved by the Purchasing Officer. (b) Public projects of $50,000 or less may be let to contract by informal bidding procedures as set forth in this Chapter. (c) Public projects over $50,000 shall, except as otherwise provided by State statute, be let to contract by formal bidding procedure. 3.14.030 Informal Bidding. Public works projects of an estimated value in the amount of $50,000 or less may be let to contract as follows: (a) Minimum Number Of Bids. The award of bid shall, whenever possible, be based on at least three (3) bids. TBM/ORD1412 (b) Notices Inviting Bids. After the City Council has budgeted the project, the Purchasing Officer shall solicit bids by written request to contractors licensed and experienced for the type of public work to be performed, from the list of qualified contractors pursuant to section 3.14.040. The minimum criteria for development and maintenance of the contractors lists shall be determined by the California Uniform Construction Cost Accounting Commis- sion (CUCCAC). All qualified contractors on the list for the category of work to be performed and all construction trade journals specified by the CUCCAC shall be mailed a notice inviting informal bids unless the product or service is proprietary. All mailing of notices to such qualified con- tractors and construction trade journals shall be completed not less than ten (10) calendar days before bids are due to be opened and awarded. (c) Notice. The notice inviting informal bids shall be uniform and shall describe (1) the project in general terms, (2) how to obtain more detailed information concerning the project, and (3) state the time and place for the submission of bids. (d) Award. The award of project shall be made to the lowest responsible bidder, and the Purchasing Officer is authorized to award and execute the construction contract provided the contractor has posted the required bonds and insurance. 3.14.040 Maintenance Of Contractors List. Prior to November 31 of each year, the Purchasing Officer shall mail written notice to all construction trade journals designated by the CUCCAC, inviting all licensed contractors to submit information on firms to be included on the list of qualified bidders, according to category, for the following calendar year. The notice shall require that the contractor provide the name and address to which a notice to contrac- tors or proposal may be mailed, a telephone number at which the contract may be reached, the type or.category of work in which the contractor is experienced and currently licensed ^' to perform, together with the number and type of contrac- tor's license or licenses held. The Purchasing Officer -2- TBM/ORD1412 shall assemble an updated contractors list to be effective January 1 of each year, which shall include all contractors who submitted one or more valid bids to the City during the preceding calendar year and all contractors who have properly provided the Purchasing Officer with the informa- tion described above. A contractor may be added to the list at any time during the year by providing the Purchasing Officer with the information described above. 3.14.050 Public Projects Included. Public projects will be performed pursuant to the Uniform Public Construction Cost Accounting Act and this Chapter. Further, maintenance work may be performed under the Uniform Public Construction Cost Account Act and this Chapter, including the following: (a) Routine, recurring and usual work for the preservation or protection of any publicly owned or publicly operated facility for its intended purposes. (b) Minor repainting. (c) Resurfacing of streets and highways at less than one inch. (d) Landscape maintenance, including mowing, watering, trimming, pruning, planting, replacement of plants and servicing of irrigation and sprinkler systems. (e) Work performed to keep, operate and maintain publicly owned water, power or waste disposal systems or other publicly owned buildings and facilities. 3.14.060 Rejection Of Informal Bids. The City reserves the right to reject any and all bids presented. If after the first invitation for informal bids all bids are rejected, the City shall have the option, after reevaluating the project cost estimates, to do one of the following: (a) Abandon the project or readvertise for bids in the manner described in this Chapter. (b) By adoption of majority of the project can be City employees the project by resolution by four-fifths City Council, declare that the performed more economically by and the City may then perform force account. -3- TBMJORD1412 (c) If no bids are received, the project may be performed by City employees by force account, by negotiated contract, or by purchase order, as approved by the Purchasing Officer. 3.14.070 Formal Bidding. Formal bidding on public projects of an estimated cost over $50,000 shall be performed in accordance with California Public Contract Code sections 22037 et seg." SECTION 2: Sections 3.12.120, 3.12.170 and 3.12.175 of Chapter 3.12, Title 3 of the Municipal Code are hereby amended to read as follows: 113.12.120 Formal (sealed) Bid Procedures. Except as otherwise provided herein, purchases of supplies and equipment of an estimated value greater than Five Thousand Dollars ($5,000.00) shall be awarded to the lowest responsible bidder pursuant to the formal bid procedure hereinafter prescribed. 3.12.170 Bidder's Security. Where deemed Ug, necessary by the purchasing at, formal bids shall be accompanied by security, either cash, cashier's check, certified check or surety bond, in a sum equal to ten percent of the total aggregate of the bid, and shall be designated in the notice inviting bids. Bidders shall be entitled to return of bid security; provided, however, that a successful bidder shall forfeit his bid security upon his refusal or failure to execute the contract within ten days after the notice of award of contract has been mailed, unless the City is solely responsible for the delay in executing the contract. The City Council may, on refusal or failure of the successful bidder to execute the contract, award it to the next lowest responsible bidder who is willing to execute the contract, or may reject all bids and readvertise. 3.12.175 Other Formal Bond Requirements. The City Council shall have authority to require a faithful perform- ance bond or other bonds before entering into a contract pursuant to this Chapter. If bonds are required, the form and amount thereof shall be designated in the notice inviting bids." MC TEM%ORD1412 SECTION 3: The City Council hereby declares that it would have passed this Ordinance sentence by sentence, paragraph by paragraph, and section by section, and does hereby declare that the provisions of this Ordinance are severable and, if for any reason any sentence, paragraph or section of this Ordinance shall be held invalid, such decision shall not affect the validity of the remaining parts of this Ordinance. SECTION 4: The City Clerk shall certify to the adoption of this Ordinance and cause it to be published in the manner prescribed by law.
