HomeMy WebLinkAbout1989-06-13 - RESOLUTIONS - DBA 18 PROCEEDINGS (2)�- RESOLUTION NO. 89-78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA IN THE MATTER OF THE PROPOSED DRAINAGE BENEFIT ASSESSMENT AREA NO. 18 DRAINAGE SERVICES RESOLUTION INSTITUTING PROCEEDINGS AND DIRECTING PREPARATION OF REPORT WHEREAS, any local agency, which is authorized by law to provide drainage services, may impose a benefit assessment to finance the operation and maintenance costs of the services pursuant to the Benefit Assessment Act of 1982 Chapter 6.4 of Part I, Division 2 of Title 5 of the Government Code of the State of California; and WHEREAS, the legislative body may establish an area of benefit within the local agency and restrict the imposition of the assessment to areas lying within the area of benefit established; and WHEREAS, the City of Santa Clarita may impose a benefit assessment to finance the maintenance and operation of subsurface drainage facilities constructed and dedicated as required for the ^^ recordation of a subdivision of land known as Tract No. 44965; and WHEREAS, the intent of the City Council of the City of Santa Clarita is to institute proceedings to establish a benefit assessment for drainage services for the above said area and establish an area of benefit over same area. NOW, THEREFORE, THE CITY COUNCIL RESOLVES: Section 1. That the proceedings for the imposition of annual benefit assessments and the establishment of an area of benefit be conducted under and in accordance with provisions of the Benefit Assessment Act of 1982. Section 2. That the name proposed for said benefit assessment area is "Drainage Benefit Assessment Area No. 18" , and the area proposed to be established as Drainage Benefit Assessment Area No. 18 is the land proposed to be within Tract No. 44965 as approved by the City of Santa Clarita, all within the jurisdiction of the City of Santa Clarita. Section 3. That this proposed first annual assessment is hereby referred to the City of Santa Clarita Department of Public Works and said Department of Public Works is hereby requested to prepare and file with the City Clerk of the City of Santa Clarita a written report which shall contain all of the following information: Resolution No. 89-78 Page 2 1. A description of the service proposed to be financed through the revenue derived from the assessment. 2. A description of each lot or parcel of property proposed to be subject to the benefit assessment. 3. The amount of the proposed assessment for each parcel. 4. The basis and schedule of the assessment. Section 4. That upon the filing of the written report, the City Clerk of the City of Santa Clarita shall cause notice of the filing of the report and of a time, date and place of herein thereon, to be published pursuant to section 6066 of the Government Code and posted in at least three public places within the City of Santa Clarita. Section 5. July 25, 1989 at 7:30 p.m. in the Council Chambers, 23920 Valencia Boulevard, Santa Clarita, California is hereby established as the date, time and place of hearing protests and objections to the assessments proposed. Description of the Service The proposed service involves the maintenance and operation of the subsurface drainage system and pump station constructed for Tract No. 44965. Included also is the maintenance of the access road to the pump station, the fences and walls and appurtenances pertaining to the subdrain system. Tract No. 44965 is located near Soledad Canyon Road and Sierra Highway, in the City of Santa Clarita as shown on Exhibit A, Page 1. Maintenance and operation of the subsurface drainage facilities involves: (1) periodic inspection and evaluation; (2) unclogging and cleanout where necessary; and (3) repair of access road, fences, and appurtenances. The estimated total annual cost to provide the subsurface drainage services is $20,000 2. The recordation of the final map for Tract No. 44965 will divide the Assessor's Parcel Numbers above into 26 parcels, 318 dwelling units and the parcels will be as shown on Exhibit A, Page 2 and described as follows: 4. Basis and Schedule of Benefit The basis of benefit was determined to be dwelling units, i.e., 1 dwelling unit = 1 benefit unit. Tract No. 44965 indicates there will be 318 dwelling units proposed. At the present time, no units have been built, therefore, a proportional amount was levied upon each of the existing parcels. Assessor's Parcel Number 2803-023-001 and 2803-023-019 are common areas which will have no dwelling units constructed thereon. These parcels will receive a zero assessment.
