CONSENT CALENDAR Ken Pulskam� DATE: June 26, 1990 SUBJECT: AB 3967 - (Polanco) Oppose DEPARTMENT: City BACKGROUND This item is on the agenda to register the City of Santa Clarita's opposition for AB 3927 which addresses the distribution of tobacco products to minors. The bill would provide that any person who violates the provision of law which regulates the advertising and distribution of smokeless tobacco is guilty of an infraction punishable by a fine of $100.00 for the first offense, $200 00 for the second and $500.00 -for the third offense. It also provides the same penalty to those who give or in anyway furnish to anyone under 18 years of age, tobacco or tobacco products. This bill would pre-empt a local authority from enacting ordinances on the same subject matter. Specific wording within the bill states: It is the legislative intent to regulate the subject matter of this sector. As a result, no City, County or City and County shall adopt, any ordinance inconsistent with this section. The tobacco industry is the major proponent of of AB 3967. RECOMMENDATION: That the City Council oppose AB 3967 and authorize staff to send .letters of opposition. SUMMARY: Transfers the provisions of the Business and Professions Code to the Penal Code and instead of the penalties and remedies specified, provides that any person who violates these provisions is guilty of an infraction, punishable by a fine of $100 for the first offense, $200 for the second offense and $500 for the third offense. Expands these provisions to apply to the advertising and distribution of tobacco products, rather than only to smokeless tobacco products.
