Harris DATE: November 13, 1990 SUBJECT: Addendum to Item 11 on Council Agenda DEPARTMENT: Community Development Recent discussions with Mr. and Mrs. Toyama at City Hall have led to a possible solution which may allow the applicants to reasonably develop their property while retaining an opportunity for the City to.widen Sand Canyon Road in the future. The Toyamas have been pursuing a plan which encroached 32' into the projected 100' right-of-way. By designing a 6' high retaining 'wall on the back of their parcel of land, they have adjusted the footprint of the house to encroach a maximum of 12' into the 100' right-of-way. The new design would allow the existing right-of-way (401) to;,be expanded to a 68' width. This width would permit the present two-lane roadway to be improved to four lanes, and also allow a 5' buffer zone and a 151,equestrian trail. All these possible improvements could take place.on the westerly side of the street, on the Toyama property. The Toyamas have agreed to make an irrevocable offer of the necessary land to accommodate these potential improvements. This offer would encompass an approximately 30' depth of .land for the 700' ± frontage of the Toyamas' present parcel, all in addition to the present 40' right -o£ -way existing at this location for Sand Canyon Road. In the event the City would eventually make the improvements as suggested above, the proposed house would set a minimum of 20' from the equestrian trail. Several healthy heritage oak trees would have to be removed in order to accomplish this widening, and staff is not making any recommendation at this time that the widening should take place. The Parks Director is also not recommending any action be taken on the placement of the trail. The irrevocable offer simply guarantees availability of the right-of-way when and if the City wishes to make the improvements. Nt CITY OF SANTA CLAR,ik Thank you very much for arranging a meeting with the City Staff on Friday, 9 November 1990, to discuss options that would permit the building of a single family residence on my property. Among the options discussed, the following proposal by the City Staff appears to offer the most reasonable solution to the interference between the CSB 3030-1 road alignment and my proposed single family residence. 1. The City of Santa Clarita shall vacate the Westerly 32 feet of the future County Survey Book (CSB) 3030-1 road alignment, 100 feet wide, crossing the property. The subject property is described in the Los Angeles County Assessor's Parcel Book as 2841-014-030. The revised future CSB 3030-1 road alignment crossing the property shall be 68 feet wide. 2. The property owner shall dedicate a portion of the property to the City of Santa Clarita, from the Westerly portion of the revised CSB 3030-1 road alignment, 68 feet wide, to the Westerly edge of the existing Sand Canyon road right-of-way, 40 feet wide. 3. The dedication of property to the City of Santa Clarita shall be for the purpose of constructing a future 4 -lane road, 48 feet wide, a 5 foot wide drainage channel, a 10 foot wide riding trail, and a 5 foot buffer zone between the road and the riding trail. continued ...... �I 6 Proposal for Resolution of Master Case No. 90-159 13 November 1990 Page 2 4. The dedication of the property to the City of Santa Clarita shall be contingent on the following conditions. A. The property owner shall be permitted quiet enjoyment of the property dedicated to the City of Santa Clarita, until the riding, hiking, or biking trail system is funded with public money and under construction. The property owner shall be permitted to make improvements to the dedicated property, such as erecting a fence, driveway, walkway, mailbox, security lighting, landscaping, trees, hedges, or temporary structures. The property owner shall remove such improvements at his own expense, after the trail system is under construction. B. The riding, hiking, or biking trail on the dedicated property shall be paid for by the City of Santa Clarita with public funds. The property owner shall not be specifically required to pay for the construction of the riding, hiking, or biking trail system improvements on the dedicated property. C. The riding, hiking, or biking trail on the dedicated property shall only be constructed, after the City of Santa Clarita has condemned or acquired other property to construct a continuous, uninterrupted trail of not less than one mile in total length. The dedicated property shall be a part of the continuous, uninterrupted trail system. The dedicated property shall not be used as the starting point for the construction of the riding, hiking, or biking trail system. D. The dedicatedproperty shall not be used as the starting or ending point for the riding, hiking, or biking trail system. The City of Santa Clarita shall not construct a public restroom, bus or public transportation shelter, picnic tables, barbecue pits, stoves, benches, horse corral, stables, horse watering trough, drinking fountain, basketball court, tennis court, horseshoe court, wading or swimming pool, children's playground, or other similar type of public facility on the dedicated property. Proposal for Resolution of Master Case No. 90-159 13 November 1990 Page 3 The above proposal was prepared without benefit of legal consul, however the intent and spirit of the proposal should be clear. If this proposal meets with the City Council's approval in principle, the language of the contract can be resolved at a later date between the City Attorney and our legal consul. Should this proposal meet with the City Council's approval, we request that we be permitted to submit plans and specifications for a single family residence to plan check for review during the period that the contract is being negotiated with the City Attorney.
