BACKGROUND
The Board of Supervisors of the County
No. 90-13, which adds Section 13.12.055
upon the.sale of aerosol paint containers
of Los Angeles has adopted Ordinance
to the County Code, imposing regulations
of six ounces or less.
The City- of Santa Clarita's adopted Municipal Code has other regulations
regarding the sale of aerosol paint containers. The intent of Ordinance No.
90-13, Section 13.12.055, adopted by the Board of Supervisors, is a preventive
measure against graffiti. Those persons under the age of eighteen (18) years in
our City can still obtain aerosol paint containers by theft. This new section
will impose storage requirements on the sale of aerosal paint containers and
thereby reduce the likelihood of theft. Imposing this additional language .to
the City ordinance would make it a stronger preventive measure and show
foresight in helping the City to help the deterrence of an increase in graffiti.
Introduce Ordinance No. 90-14, waive further reading and pass to second reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA,
AMENDING THE MUNICIPALCODETO ADD
SECTION 11.12.055 RELATING TO THE SALE OF
SPRAY PAINT CANS OF SIX OUNCES OR LESS
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES
HERESY ORDAIN AS FOLLOWS:
SECTION 1. That the Municipal Code of the City of Santa
Clarita is amerde3 to add section 11.12.055 to Title 11
relating to the sale of spray paint cans of six ounces and
fewer, to read as follows:
"11.12.055 Sale of aerosol paint
co..^.tainers- Storage reauire"ier.ts. Any
busir.ess.or establishment offeri-g for sale. to
the public aerosol paint containers of six (6)
ounces or less shall keep, store and maintain
such aerosol paint containers in a place that
is locked and secure, or otherwise made
unavailable to the public."
SECTION 2. The City Clerk shall certify to the

published as required by law.

Dear Mayor Darcy:
At our meeting held January 16, 1990, we adopted the
enclosed Ordinance No. 90-0013; which adds Section 13.12.055
to the County Code, imposing regulations upon the sale of
aerosol paint containers of six ounces or less.
In addition, we are requesting that all Cities within
Los Angeles County.adopt a similar ordinance.

State law permits local governments to regulate the
sale of aerosol paint containers weighing six ounces or less.
This ordinance would require all business estab-
lishments open to the public and offering aerosol paint
containers weighing six ounces or less to keep, store and
maintain such containers in secure areas which are not avail-
able to the public except upon request.

An ordinance amending Title 13 of the County Code

tainers of six ounces or less.
The Los Angeles County Board of Supervisors.ordains
as follows:
Section 1. Section 13.12.055 of the Los Angeles
County Code is added to read as follows:
Section 13.12.055. Sale of aerosol paint
containers - Storage requirements.
Any business or establishment offering for sale to
the public aerosol paint containers of six (6) ounces or less
•shall keep, store and maintain such aerosol paint containers
` in a place that is locked and secure, or otherwise made
unavailable to the public.

the permission of the city officer in charge. For the purposes
of this section, a public highway is not a city -owned facility.
