Item to be presented by: Mark Scott SUBJECT: Annexation No. 1988-01, Making Findings On Writ -ten Protest DEPARTMENT: Community Development BACKGROUND The proposal is for a resolution be adopted by the City Council to approve and order Annexation No. 1988-01. The resolution states the direction given to Council by the LAFCO to proceed with a duly noticed public hearing, and sets forth the reasons for the annexation, terms and conditions established for the annexation by the LAFCO, exhibits identifying the site, and other required recitals. The resolution represents the final action to be taken by the City Council to complote Annexation No. 1988-01; upon adoption, the resolution will be forwarded to the LAFCO for review and certification, and the annexation will be recorded with the State Board of Equalization within 15 days. The date of recordation typically serves as the effective date of completion of annexation proceedings. Annexation No. 1988-01 is a proposal to annex approximately 1,038 acres of inhabited land to the City of Santa Clarita for proposed residential development. The site is located in the Country Canyon area, northerly of Soledad Canyon Road and east of the northerly extension of Oak Spring Canyon Road, in the area typically known as the Pinetree/Timberlane/Le House neighborhood. Annexation is requested by the property owners, who cite a desire for City services and local government permit processing. There are no known persons, agencies or organizations opposed to this proposal. Because Annexation No. 1988-01 is defined as "inhabited," both registered voters and property owners may protest. If fewer than 252 of the property owners and registered voters in the affected area oppose Annexation No. 1988-01, the annexation can be approved by the City Council, and be completed within three weeks. If the percentage of opposition protest is, above 50Z, the City Council must deny the annexation. If the percentage of opposition protest received falls between 25Z and 502, a special election will be scheduled at a later date and area voters and property owners will decide the issue. Previous actions taken by the City Council on Annexation No. 1988-01 include adoption of Resolution 88-120, initiating proceedings with the LAFCO, Resolution 89-118, a joint resolution with the County of Los Q Angeles regarding property tax transfer, and Resolution 90-20 which -jam rescinds and supercedes Resolution 89-118 as the joint resolution with U✓i the County of Los Angeles regarding property tax transfer. n Agenda Item: J RECOMMENDATION 1. Adopt Resolution No. 90-11 making findings regarding protests. 2. If the hearing results in insufficient protest and the annexation is approved, then direct staff to transmit Resolution No. 90-11 and and appropriate fees to the Local Agency Formation Commission Agency for final review and certification. ATTACHMENTS Resolution No. 90-11 Exhibit A - Legal Description Exhibit B - Map Protest Hearing Letter CITY OF SANTA CLARITA COUNTY OF LOS ANGELES NOTICE OF PUBLIC HEARING 10 NOTICE IS HEREBY GIVEN, pursuant to Section 57025 of the Government Code, that the City Council of the City of Santa Clarita will hold a Public Hearing to consider annexation to the City of Santa Clarita of that inhabited territory identified as Annexation No. 1988-01. The purpose of the hearing will be to receive and consider all written protests of any residents or owners of land within the territory proposed to be annexed to the City of Santa Clarita. The hearing will be held by the City Council in the City Hall Chambers, 23920 Valencia Boulevard, First Floor, Santa Clarita, California, on February 13, 1990 at or after 6:30 p.m. 1. Proceedings for the referenced proposal were initiated by the City of Santa Clarita and submitted to the Local Agency Formation Commission.for Los Angeles County. 2. The irregularly-shaped inhabited territory consists of approximately 1,038 acres, is comprised of multiple ownership(s), and is located generally north of Soledad Canyon Road and east of the northerly extension of Oak Spring Canyon Road, in the area typically known as the Pinetree/Timberlane/Le House neighborhood. ✓ 3. The proposal shall be subject to all terms and conditions as specified and imposed by Resolution No. 1990-11 of the Local Agency Formation Commission for Los Angeles County and reference is hereby made to said resolution for a full and complete description of the annexation and the terms and conditions. 4.. The short -form designation of the proposal is Annexation No. 1988-01. 5. The reasons for the proposed annexation are to respond to resident and property owner requests for municipal services from the City of Santa Clarita, for local government representation and review, to promote sound planning and land use in this area, and to annex property within the City's Sphere of Influence as adopted by the Local Agency Formation Commission on January,10,. 1990. 6. Any registered voter residing within the territory or any owner of land within the territory who wishes to file written protest against Annexation No. 1988-01 must do so by written _......communication ..filed with the City Clerk, which must be. filed .not later than the hour specified in this notice for commencement of the hearing. Each written protest must state whether it is made by a landowner or registered voter and must indicate the name and - . address -,of -the owner of land the street address or other description sufficient to identify the location of the land, or the name and address of the registered voter as it appears on the affidavit of registration. 0 The proposal may be reviewed by the public at the City of Santa. Legally referred to as a protest hearing, the meeting is the final step in the annexation process which began in October, 1988. The hearing begins at 6:30 p.m. in the City Council Chambers, First Floor, 23920 Valencia Boulevard, Santa Clarita, California. Because Annexation No. 1988-01 is defined as "inhabited," both registered voters and property owners may protest. If you are in favor of the annexation, your attendance at the hearing would be appreciated and welcomed, but is not necessary. If you are.opposed to the annexation and wish to protest, State law requires that your protest be submitted in writing prior to, or at the time of, the public hearing.. Correspondence should be addressed to the City Clerk, City of Santa Clarita, 23920 Valencia Boulevard, Santa Clarita, CA, 91355. If the percentage of opposition protest is above 50X, the City Council will deny the annexation. If the percentage of protest received falls between 251 and 50X, a special election will be scheduled at a later date and.area voters and.property owners will decide the issue. If the annexation is approved at the conclusion of the public hearing, a resolution will be sent to the Local Agency Formation, Commission, and the annexation should be completed within three weeks.
