SUBJECT: ANNEXATION NO. 1988-01, MAKING FINDINGS ON WRITTEN PROTEST

BACKGROUND:
At the Council meeting of February 13, 1990, Council directed staff to bring
back a resolution setting an election for the Pinetree/Timberlane Annexation for
June of 1990. After staff has had an opportunity to review this, it has been
determined that it will not be possible to conduct an election by June of 1990.
We have been informed by the County Registrar that the signatures will not be
able to be verified in time to meet the June deadlines. Accordingly, the
soonest the election would be able to be held would be November of 1990.
There are, however, several advantages to this. The cost of the election would
be somewhere around $85,000. Since the November election is a regular County
election, the City would be, able to save this amount of money by not having to
conduct a special election.
The City will not be able to get its share of property taxes until the fiscal
year following the election. If the election were held during June of 1990, the
actual property tax transfer would not take place until July of 1991.
Accordingly, the City would have to provide services which would cost in excess
of $300,000 without receiving its share of the property taxes to partially cover
the cost of these services.
Finally, several people at the February 13, 1990 meeting indicated they felt the
annexation was proceeding too rapidly to provide public input. Postponing the
election until November will provide more than ample time for all of the
pertinent issues to be publicly debated.
RECOMMENDATION:
It is recommended that staff be directed to proceed to conduct the
..Pine tree /Timberlane Annexation for November of 1990 and inform the residents
that this will take place.
