Harris/xC CONSENT CALENDAR DATE: August 14, 1990 SUBJECT: Resolution No. 90-150, A Joint Resolution of Negotiated Property Tax Transfer for Annexation No. 1989-02 DEPARTMENT: Community Development BACKGROUND Annexation No. 1989-02 is a City -initiated proposal to annex approximately 80 acres of uninhabited territory to the City of Santa Clarita. The territory is located at the northerly terminus of Foxlane Drive.and abuts City boundaries to the west and south. (See attached map for location.) The City Council adopted a resolution of application (Resolution No. 89-61) for this proposal on June 13, 1989, requesting that the Local Agency Formation Commission (LAFCO) begin annexation proceedings. The annexation was submitted to the. LAFCO for approval in June 1989.. On February 13, 1990, the City Council adopted Resolution No. 90-22, a joint resolution of - negotiated property tax transfer. On July 25, 1990, the Local Agency Formation Commission approved Annexation No. 1989-02 (LAFCO Resolution No. 1990-95) with the condition that said tax transfer resolution be amended to provide for the transfer to the Consolidated Fire Protection District of the annual tax increment (ATI) attributable to the territory annexed to the District as a result of the incorporation of the City of Santa Clarita on December 15, 1987. The attached resolution amends Resolution No. 90-22, which was approved by the City Council on February 13, 1990, and by the Board of Supervisors of the County of Los Angeles on March 10, 1990. The resolution would be amended by including "Section 6", language addressing the ATI attributable to the Consolidated Fire Protection District. Adopt Resolution No. 90-150, amending Resolution No. 90-22, approving the property tax transfer for Annexation No. 1989-02. 2. Direct staff to submit Resolution No. 90-150 and eight certified copies to the Local Agency Formation Commission for action by the Los Angeles County Board of Supervisors. RESOLUTION NO. g(j.-75n JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES AND THE CITY COUNCIL OF THE CITY OF SANTA CLARITA AMENDING JOINT RESOLUTION 90-22 APPROVING AND ACCEPTING NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM "ANNEXATION NO. 1989-02" TO THE CITY OF SANTA CLARITA (ANNEXATION TO CONSOLIDATED FIRE PROTECTION DISTRICT) WHEREAS, pursuant to Section 99 of the Revenue and Taxation Code, the Board of Supervisors of the County of Los Angeles and the City Council of the City of Santa Clarita adopted Joint Resolution 90-22 approving the amount of property tax revenues to be exchanged between their respective agencies as a result of the annexation of unincorporated territory.to the City of Santa Clarita entitled "Annexation No. 1989-02." WHEREAS, on July 25, 1990, the Local Agency Formation Commission • approved "Annexation No. 1989-02" with the condition that said tax transfer resolution be amended to provide for the transfer to the Consolidated Fire Protection District of the annual tax increment attributable to the territory annexed to the District as a result of the incorporation of the City of Santa Clarita on December 15, 1987. NOW, THEREFORE, BE IT RESOLVED as follows: 1. Joint Resolution 90-22, approved by the City Council of the City of Santa Clarita on February 13, 1990 and by the Board of Supervisors of the County of Los Angeles on March 10, 1990, is hereby amended to include the following section: "G. In addition to the foregoing transfers of property tax revenue, the County of Los Angeles and the City of Santa Clarita 0 . wish to provide for the transfer of incremental tax growth attributable to territory which was annexed to the Consolidated Fire Protection District when the City incorporated December 15, 1987. Accordingly, for fiscal years commencing on and after July 1, 1991, Sixteen and Seven -Tenths Percent (16.7%) of the annual tax increment attributable to that portion of the City of Santa Clarita which was annexed to the District as a result of the city incorporation, shall be transferred to the Consolidated Fire Protection District from the County of Los Angeles, and the County's share of incremental tax growth shall be reduced accordingly." THE FOREGOING RESOLUTION WAS ADOPTED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES AND BY THE CITY COUNCIL OF THE CITY OF SANTA CLARITA. PASSED, APPROVED AND ADOPTED this day of , 1990. MONTEILH, Executive Officer - Clerk of the Board of Supervisors Deputy 0 -3- . }ESOLUTION 1990-95 ' RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION OF LOS ANGELES COUNTY MAKING DETERMINATIONS AND APPROVING THE PROPOSED ANNEXATION OF TERRITORY DESIGNATED AS "ANNEXATION 1989-02" TO THE CITY OF SANTA CLARITA (ANNEXATION TO CONSOLIDATED FIRE PROTECTION DISTRICT) WHEREAS an application for.the.proposed annexation of certain territory to the City of Santa Clarita in the County of Los Angeles was heretofore filed with the Executive Officer of this Local Agency Formation Commission, and said Executive Officer has examined said application and executed a certificate determining and certifying that said application is sufficient; WHEREAS, at the time and in the form and manner provided by law, said Executive Officer set this matter for public hearing and gave notice thereof; WHEREAS, the public hearing by this Commission was held upon the date and at the time and place specified in said notice of public hearing, and all persons present were given an opportunity to hear and be heard with respect to any matter relating to said proposal and the Executive Officer's report and recommendation thereon, NOW, THEREFORE, BE IT RESOLVED as follows: 1. The Commission certifies that it has reviewed and found adequate for this proposal the lead agency's environmental documents. 2. Subject to the terms and conditions hereinafter specified, said proposal is approved. • 3. A description of the boundaries of the proposal, as approved by this Commission, is set forth in Exhibit "A," attached hereto and made a 171 part hereof. Said territory is found to be uninhabited and said territory is assigned the following distinctive short form designation: "Annexation 1989-02." 4. Any resolution ordering such annexation shall provide that such annexation shall be made subject to the condition that the territory also be annexed to the Consolidated Fire Protection District and that the property tax transfer resolution for this annexation be amended to include the following language: "In addition to the foregoing transfers of property tax revenue, the County of Los Angeles and the City of Santa Clarita wish to provide for the transfer of incremental tax growth attributable to territory which was annexed to the Consolidated Fire Protection District when the City incorporated December 15, 1987.
