SUBJECT: Annexation No. 1989-04, Resolution Making Findings On
Written Protest and Approving & Ordering Annexation 1989-04

BACKGROUND
The proposal is for a resolution be adopted by the.City Council to
approve and order Annexation No. 1989-04. The resolution states the
direction given to Council by the LAFCO to proceed with a duly noticed
public hearing, and sets forth the reasons for the annexation, terms and
conditions established for the annexation by the LAFCO, exhibits
identifying the site, and other required recitals. The resolution
represents the final action to be taken by the City Council to complete.
Annexation No. 1989=04; upon adoption, the resolution will be forwarded
to the LAFCO for review and certification, and the annexation will be
recorded with the State Board of Equalization within 15-25 days. The
date of recordation typically serves as the effective date of completion.

Annexation No. 1989-04 is a proposal to annex approximately 160 acres of
uninhabited land to the City of Santa Clarita for proposed residential
development. A subdivision map, VTTM 47803, has been previously approved
by the Planning Commission and City Council, and would allow construction
of 140 single-family residences. The developer would also provide
substantial traffic circulation improvements in the area. The site is
located in the Sand Canyon area, approximately 1600 feet south of Soledad
Canyon Road and one quarter mile east of Sand Canyon Road. (See attached
map for location.) Annexation is requested by the property owner (Prime
West Development, Batts Vujicic), who cites a desire for City services
and local government permit processing. The City's cost to provide
municipal services to this area would be offset for the forseeable future
due to revenues from increased property valuation, building permit fees,
and other development fees. There are no known persons, agencies or
organizations opposed to this proposal.
Because Annexation No. 1989-04.is presently defined as "uninhabited,"
only property owners may protest. If owners of property who own less
than 50 percent of the total assessed value of land in the affected area
oppose Annexation No. 1989-04, the annexation can be approved by the City
Council_ If the percentage of opposition protest is above 50X, the City
Council must deny the annexation.

Previous actions taken by the City Council on Annexation No. 1989-04
include adoption of Resolution No. 89-63, initiating proceedings with the
LAFCO and Resolution No. 90-23, a joint resolution with the County of Los
Angeles regarding property tax transfer.
RECOMMENDATION
1. Adopt Resolution No. 90-135 making findings regarding written
protest.
2. If the hearing results in insufficient written protest and the e
annexation is approved, then direct staff to transmit Resolution No.
90-135 and and appropriate fees to the Local Agency Formation
Commission for final review and certification.

A RESOLUTION OF THE CITY COUNCIL,
OF THE CITY OF SANTA CLARITA; CALIFORNIA,
MAKING FINDINGS THAT INSUFFICIENT WRITTEN PROTESTS
HAVE BEEN FILED AND APPROVING AND
ORDERING THE ANNEXATION OF
CERTAIN UNINHABITED TERRITORY DESIGNATED AS
"ANNEXATION NO. 1989-04"
TO THE CITY OF SANTA CLARITA.
WHEREAS, the Local Agency Formation Commission of the County of
Los Angeles adopted its resolution, making determinations and approving,.
the proposed annexation to the City of Santa Clarita of territory
described in Exhibits A and B attached hereto and by this reference
incorporated; and
WHEREAS, the Local Agency Formation -Commission of the County of,
Los Angeles has directed the City of Santa Clarita to proceed with the
annexation following a duly noticed public hearing; and
WHEREAS, the City Clerk set Tuesday, August 28, 1990, at 6:30
p.m. in the Council Chambers of the City Hall, 23920 Valencia Blvd., lst_'
Floor, Santa Clarita, California, as the date, time, and.place for said:
hearing on the proposed annexation and the owners of land within the said
territory were duly informed of their right to file written protests
against the annexation with the City Clerk at any time prior to the
conclusion of the hearing on the proposed annexation; and
WHEREAS, the public hearing was duly and regularly conducted by
and before the City Council at its meeting of August 28, 1990.
WHEREAS, the Local Agency Formation Commission approved this
proposed annexation subject to the following specified term(s) and
condition(s):
That the subject territory also be annexed to the Consolidated
Fire Protection District; and
WHEREAS, the reasons for this annexation are to extend and
square.up the City's boundaries, to comply with the property owner's
request for annexation, and to promote sound planning and land use
practices in the affected territory; and
WHEREAS, the regular County assessment roll is utilized by this
City; and
WHEREAS, the affected territory will not be taxed for existing
bonded indebtedness of this City.
NOW, THEREFORE, BE IT RESOLVED by the City Council'of the City
of -Santa Clarita, California, as follows:
SECTION 1. The City Council hereby declares said territory is
found to be uninhabited and a legal description of the boundaries of the.
annexation is set forth in Exhibit A and a map of the boundaries is set'
forth in Exhibit B, attached hereto and made a part hereof.
SECTION 2. In accordance with section 57075 of the Government
Code, it is hereby found that written protests, if any, have been filed.
and not withdrawn by owners of property owning less than 50Z of the total
assessed value of land within the territory.
SECTION 3. The City Council hereby orders the territory
described in Exhibits A and B annexed and directs the City Clerk to
transmit eight (8) certified copies of this resolution with applicable
fees required by Section 54902.5 of the Government Code to the Executive
Officer of the Local Agency Formation Commission of Los Angeles County.
SECTION 4. The City Clerk shall certify to the adoption of
this resolution and certify this record to be a full, true, correct copy
of the action taken.

NOTICE OF PUBLIC HEARING,
NOTICE IS HEREBY GIVEN, pursuant to Section 57025 of the Government Code, that
the City Council of the City of Santa Clarita will hold a -Public Hearing to
consider annexation to the City of Santa Clarita of that uninhabitedterritory
identified as Annexation No. 1989-04. The purpose of the hearing will be to
receive and consider all written protests of any residents or owners of land,
within the territory proposed to be annexed to .the City of Santa Clarita
The hearing will be held by the City Council in the City Hall Chambers, 23920
Valencia Boulevard, First Floor, Santa Clarita, California, on August 28,
1990, at or after 6:30 p.m.
1. Proceedings for the referenced proposal were initiated by the City of
Santa Clarita and submitted to the Local Agency Formation Commission for
Los Angeles County.
2. The irregularly-shaped inhabited territory consists of approximately
159.70 acres, is comprised of a single ownership, and is located generally
south of Soledad Canyon Road and east of Sand Canyon Road, in the area.
typically known as Sand Canyon.
3. The proposal shall be subject to all terms and conditions as specified and
imposed by Resolution No. 90-96 of the Local Agency Formation Commission
for Los Angeles County and reference is hereby made to said resolution for
a full and complete description of the annexation and the terms and.
conditions.
4. The short -form designation of the proposal is Annexation No. 1989-04.
5. The reasons for the proposed annexation are to respond to the property,
owner's request for municipal services from the City of Santa Clarita,.for
local government representation and review, to promote sound planning and
land use in this area, and to annex property within the City's Sphere of
Influence as amended by the Local Agency Formation Commission on July 25,
1990.
6. Any owner of land within the territory who wishes to file written protest
against Annexation No. 1989-04 must do so by written communication filed
with the City Clerk, which must be filed not later than the hour specified
in this notice for commencement of the hearing. Each written protest must
state it is made by a landowner and must indicate the name and address of
the owner of land affected and the street address or other description
sufficient to identify the location of the land.
The proposal may be reviewed by the public at the City of Santa Clarita
Department of Community Development prior to the Public Hearing of August 28,
1990. Inquiries should be directed to Associate Planner Don Williams, at

Dear Property Owner:
You are invited to attend a public hearing of the City Council on
Tuesday, August 28, 1990, regarding the proposed annexation of the
roperty shown on the attached map. Legally referred to as a protest
hearing, the hearing is the final step in the annexation process
which began in May, 1989. The hearing begins at 6:30 p.m. in the
City Council Chambers, First Floor, 23920 Valencia Boulevard, Santa
Clarita, California. ,
Because Annexation No. 1989-04 is defined as "uninhabited," only
property owners may protest. If you are in favor of the annexation,'
your attendance at the hearing would be appreciated and welcomed,
but is not necessary. If you are opposed to the annexation and wish
to protest, State law requires that your protest be submitted in
writing prior to, or at the time of, the public hearing..
Correspondence should be addressed to the City Clerk, City of Santa
Clarita, 23920 Valencia Boulevard, Santa Clarita, CA, 91355. For
more information on how to file written protest, see the attached
Notice of Public Hearing, or contact the Department of Community
Development at the number below.

If the annexation is approved at the conclusion of the public

weeks.
