Harris1�/ (c/thlA� 1 T CONSENT CALENDAR DATE: August 14, 1990 SUBJECT: Resolution No. 90-136, Resolution Approving and Ordering Annexation No. 1989-02 DEPARTMENT: Community Development BACKGROUND The proposal is for a resolution to be adopted by the City Council to approve and order'Annexation No. 1989-02. The resolution states.the direction given to Council by the LAFCO to proceed without public notice, and sets forth the reasons for the annexation, terms and conditions established for the annexation by. the LAFCO, exhibits identifying the site, and other required recitals. The resolution represents the final action to be taken by the City Council to successfully complete. Annexation No. 1989-02; upon adoption, the resolution will be forwarded to the LAFCO for review and certification, and the annexation will be , recorded with the State Board of Equalization. The date of recordation typically serves as the effective date of completion of annexation proceedings. Annexation No. 1989-02 is a proposal to annex approximately 80 acres of uninhabited land to the City_of Santa Clarita for the proposed development of 201 single-family residential units. The site is located at the northerly terminus of Foxlane Drive and and abuts City boundaries to the west and south. Annexation is requested by the property owner (Weston Development), who cites a desire for City services and local government permit processing. Previous actions taken by the City Council on Annexation No. 1989-02 include adoption of Resolution 89-61, initiating proceedings with the LAFCO, and Resolution 90-22, a joint resolution with the County of Los Angeles regarding property tax transfer. An amendment to Resolution 90-22 was conditioned by the LAFCO on July 25, 1990. This amendment, a language addition, would be enacted by adopting Resolution No. 90-150, a. joint property tax transfer resolution with the County of Los Angeles. RECOMMENDATION Adopt Resolution 90-136 approving and ordering Annexation No. 1989-02, and direct staff to transmit the resolution and appropriate fees to the Executive Officer of the LAFCO for final review and certification. ATTACHMENTS Resolution No. 90-136 Adopted:*d Agenda Item: Exhibit A - Legal Description Exhibit B - Map RESOLUTION NO. 90-136 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA APPROVING AND ORDERING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY . DESIGNATED AS 'ANNEXATION NO. 1989-02' TO THE CITY OF SANTA CLARITA WHEREAS, the Local Agency Formation Commission of the County of Los Angeles adopted its resolution, making determinations and approving the proposed annexation to the City of Santa Clarita of territory described in Exhibits A and B attached hereto and by this reference incorporated; and WHEREAS, the Local Agency: Formation Commission of the County of Los Angeles has directed the City of Santa Clarita to proceed with the annexation without notice and hearing; and WHEREAS, the Local Agency Formation Commission approved this proposed annexation subject to the following specified term(s) and condition(s); That the subject territory also be annexed to the Consolidated Fire Protection District; and That the negotiated tax transfer resolution for this annexation (Resolution No. 90-22) be amended by the adoption of Resolution No. 90-150. WHEREAS, the reasons for this annexation are to extend and square up the City's boundaries, to comply with the property owner's request for annexation, and to promote sound planning and land use practices in the affected territory; and WHEREAS, the regular County assessment roll is utilized by this City; and WBE REAS, the affected territory will not be taxed for existing bonded indebtedness of this City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Clarita, California, as follows: SECTION 1. The City Council hereby declares said territory is found to be uninhabited and a legal description of the boundaries of the annexation is set forth in Exhibit A and a map of the boundaries is set forth in Exhibit B, attached hereto and made a part hereof. SECTION 2. The City Council hereby orders the territory described in Exhibits A and B annexed and directs the City Clerk to transmit eight (8) certified copies of this resolution with applicable fees required by Section 54902.5 of the Government Code to the Executive Officer of the Local Agency Formation Commission of Los Angeles County. SECTION 3.
