BACKGROUND

On September 20, 1990, the City Clerk opened bids for the 1990-91 Comprehensive
Street Tree Pruning Contract. The contract is a one-year contract with the
option to renew at term of contract for two additional one-year periods. There
are approximately 4,000 trees- that will be serviced in the first year of the
contract throughout the City.
The lowest responsible bidder is a Monrovia based company, Golden Bear.Arborist,
at $195,400 and the only other bidder, Porshia Tree Maintenance came in at
$269,824.
The budget for fiscal 1990-91 street tree services is '.$250,000, of -which $25,000
has been used to date for emergency tree work.
Golden Bear Arborist successfully performed tree services for our City in fiscal
year 1989-90, and we have been very happy with the results of their services
thus far. Golden Bear comes to us with a long list of references, including the
City of Los Angeles, Los Angeles County and the City of Beverly Hills.
FISCAL IMPACT
Funds have been budgeted in account number 01-9200-227 in the amount of $250,000
for this contract, and the low bid is within the budget parameters, including
the $25,000 already spent for emergency services.
It is recommended that the City Council award the contract
Golden Bear Arborist, Inc. in the amount of $195,400 and
Manager to execute the contract after the required bonds
have been submitted by the contractor.

All blank spaces appearing in the foregoing must be filled in. In case of
discrepancy between words and figures, the words shall prevail.
TIME FOR COMPLETION - If awarded the contract, the undersigned agrees to start
the work within ten calendar days from the date of written 'Notice to
Proceed". And shall complete the contract exactly one year later. The period
of performance will be 12 months unless sooner terminated under terms of the
contract.
LIQUIDATED DAMAGES - A Contractor shall start up no later than the allotted
ten day 'Notice to Proceed,m therefore should a Contractor fail to start up
within the ten day period, liquidation damages of $100.00 per day will be
deducted from monies otherwise payable to the Contractor for services
rendered. Should a Contractor fail to appear an a designated work day though
the duration of the contract. For each day missed the Contractor will be
required to double the man power and equipment necessary on proceeding work
days to make up equivalent day/s missed.
The Contractor shall not be assessed with liquidated damages during the delay
or completion of the work caused by acts of god or of the Public Enemy, acts
of the State, fire not due to acts of Contractors of subcontractors, floods,
epidemics, quarantine, restrictions, strikes, freight embargo or unusually
severe weather, or delays of subcontractors due to such causes provided that
the Contractor shall. within ten (10) days from the beginning of such delay,
notify the City, in writing of the cause of the delay. The city will
ascertain the facts and the extent of the delay, and the findings thereon
shall be final and conclusive.
