Support of Amendment to Penal Code relative to Bingo Fees

The City of Hawaiian Gardens has requested our city support of an amendment to
the penal code to allow a city or county to regulate and impose by local
ordinance, Bingo License Fees to a maximum of 10% and also allow exemption for
non-profit charity organizations, mobilehome park associations and senior
organizations.
They wish to present this position by resolution at the October 23rd Contract
Cities Annual Conference. Since their request did not arrive in time for their
September 6th League of California City resolutions committee meeting, I am
referring this to Council in order to substantiate a position for the October
23rd Conference.
The City of Santa Clarita only has seven bingo licenses as of January, 1990 and
only one of them paid ($50 for Elks) in 1989 so there appears to be little
impact in Santa Clarita.
This does not affect the City of Santa Clarita's Bingo License Fees or Bingo
Revenues. It is only presented as a support resolution for Contract Cities.
RECOMMENDATION
'Council support another city in their quest to exempt non-profit. organizations
from paying a 1S of gross receipts over $5,000 fee and to allow an increase of
commercial bingo license fee revenues from 12 to 2% of gross receipts over
$5,000.

SUBJECT: Resolution Relating to Bingo License
Fees/Requesting support and endorsement
from the League of California Cities Delegates
I am writing to solicit your support and endorsement for
the attached -Resolution related to Bingo License Fees at
the League of California Cities Annual Conference in
Anaheim on October 23. Your support is needed now to
present this Resolution to the Conference General Assembly
in October.
The Bingo License Fee Resolution will increase bingo
license fee revenue from one (1%) percent to two (2$)
percent for the 102 affected cities and counties with
Bingo Game Ordinances. Seven counties will be immediately
affected by this proposed legislation.
In 1975, the State Legislature enacted legislation to
permit cities and counties to collect one (1%) percent of
the monthly gross receipts over $5,000 derived from Bingo
games.
In the intervening 15 years, gross receipts from Bingo
games have increased as well as the expense of regulation
by local governments. Local government expenditures for
ancillary services (street maintenance, lighting
maintenance, etc.) have also grown, without a
corresponding increase in Bingo license fees to meet these
ever growing expenditures. '
The Bingo License Fee Resolution would correct this
glaring inequity by setting Bingo License fees at.two (2%)
percent of monthly gross receipts over $5,000.

I have spoken with City Officials from several cities and
they have cited the need to differentiate between
professional versus non-profit charitable bingo operators,
and I wholeheartedly concur. In order to eliminate the.
'burden to non-profit community -oriented bingo operators,
the,=City,of Pomona has exempted its local organizations
from payment of.the one (1%) percent bingo license fee. I
am, therefore, sending along a copy of Resolution No.
72-9U adopted by the City Council of the City of Hawaiian
Gardens which supports an amendment to the State Penal
'Code.which allows local governments to exempt non-profit
charitable organizations mobilehome park associations, and
senior organizations from the Bingo licensing fee.
If the Conference General Assembly adopts this Resolution
I will ask Assemblyman Richard Floyd to again introduce
legislation to increase Bingo license fee revenue.
Again, let me emphasize that your support is essential to
passage of this important legislation.

RESOLUTION NO. 72-90
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HAWAIIAN GARDENS ENDORSING, SUPPORTING AND ENCOURAGING
AN AMENDMENT OF THE CALIFORNIA PENAL CODE TO INCREASE
BINGO LICENSE FEES.
WHEREAS, In 1975, the State enacted legislation to
permit a city, county or city and county to collect. one
(1%) percent of the monthly gross receipts over five
thousand ($5,000) derived from Bingo games; and
WHEREAS, In the intervening 15 years, gross receipts
from Bingo games have increased substantially as well as
the costs to a city, county or city and county of
regulating such Bingo games; and
WHEREAS, In this same period, local government
expenditures for ancillary services (such as street
maintenance, lighting maintenance) have also grown
substantially, without a corresponding increase in Bingo
license.fees to meet these ever growing expenditures; and
WHEREAS, Increasing Bingo License Fees would correct
this glaring inequity by setting Bingo License Fees at two
(23) percent of monthly gross receipts over $5,000.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HAWAIIAN GARDENS AS FOLLOWS:
SECTION 1. The City Council of the City of Hawaiian
Gardens urges the General Assembly.of the League of
California Cities to support an increase in Bingo License
Fees from one (1%) percent to two (2k) percent.
SECTION 2. As an alternative, the City Council urges
the General Assembly to support an amendment to the State
Penal Code which allows"3'clty, county or city and county
to regulate and impose by local ordinance Bingo License
Fees up to a maximum of ten (10%) percent and also allows
a city, county -or city and county to exempt non-profit
charitable organizations, mobilehome park associations and
senior organizations.

SECTION 3. The Mayor, or presiding officer, is hereby
directed to affix his/her signature to this resolution
signifying its adoption, and the City Clerk, or her duly
appointed Deputy, is directed to attest thereto.

Your City is entitled to representation on the Board of Trustees. The
member appointed by your honorable body must be an elector and resident of
the City of Santa Clarita. The term of appointment.of your Trustee will
expire January 2, 1993. Subsequent terms of Trustees representing the City
of Santa Clarita are for two or four year terms.
The Board of Trustees meets regularly on the second Thursday of each month
at 7:30 P.M. at the District Headquarters. One exception to this meeting
place is the Annual Board Dinner Meeting which is usually held in November
at another location. If possible, we are looking forward to welcoming your
appointee to the next meeting, September 13, 1990. Please send us a copy
of your action appointing a representative to serve on the Board of Trus-
tees, and we will notify that person of the details of the next meeting.
