Medina DATE: October 30, 1990 SUBJECT: CIRCLE J RANCH TRAFFIC ENFORCEMENT Resolution Number: 90-170 DEPARTMENT: Public WorksdfA BACKGROUND On September 25, 1990, City Council deliberated a request from the Circle J Homeowners Association to assume responsibility for traffic code enforcement in their development. These streets are currently private, but have been offered for dedication. City Council established October 30, 1990 as the date for a Public Hearing on the matter, and directed staff to notify the owner of the street system of the Public Hearing. California Vehicle Code Section 21107.5 permits cities to assume responsibilty for traffic law enforcement on private streets, when the streets are used by the public.and. after a Public Hearing has-been held. Nofification of the Public Hearing to the owner of the streets is also required. These requirements have been fulfilled. It is appropriate that the City assume responsibility for traffic enforcement in Circle J Ranch. The streets will ultimately be under public control. It is recommended that the City Council: 1. Conduct a Public Hearing to consider assuming responsibility for traffic enforcement in Circle J Ranch. 2. Adopt Resolution No, 90-170 accepting responsibility for the enforcement. WHEREAS, the California Vehicle Code Section 21107.5 permits municipalities to enforce provisions of the California Vehicle Code on privately owned and maintained roads that ,are generally held open for public use for purposes of vehicle travel. CONDITIONS The Circle J Ranch development currently includes- about 400 occupied single family housing units, and additional units are under construction. All of the internal residential street system is still under private control, and it is unknown when the streets may be accepted by the City. Consequently, the City provides no traffic enforcement in the Circle J Ranch area. The street system has no traffic controls except several developer installed stop signs where internal streets intersect Via Princessa. The internal street system is designed with "T" intersections to preclude the necessity for stop sign controls. Several of the internal streets, Oxnard Lane and Cardiff Drive for example, are sufficiently long that drivers tend to travel faster than the residential speed limit. The Traffic Engineering section received complaints. about speeding from residents of the area several months ago, about the same time two children bicyclists were hit on Oxford Lane by a speeding motorist. Mr. Urso was one of the complaintants, and he was told of our inability to regulate traffic because of the private streets in the development. He was aware of a similar situation in Los Angeles County where the County accepted responsibility for traffic regulation on private streets. Hence the formal request was made. DISCUSSION The California Vehicle Code permits City regulation of privately -owned and maintained streets in Section 21107.5. This section allows. any city to enact an ordinance or resolution to apply the provisions of the California Vehicle Code on private roads which are generally held open for public use. The streets in the Circle J Ranch area fulfill the requirements of- this Vehicle Code section. Upon adoption of the ordinance or resolution and with a public hearing, the City can regulate traffic on the private streets. A copy of the specific code section is attached. John Medina Circle J Ranch Traffic Enforcement July 19, 1990 Page 2 RECOMMENDATION The Circle J Ranch street system is intended to become public streets, although they have not yet been accepted by the City. The street system traffic operations would appropriately be controlled by standard traffic control devices and monitored by the City law enforcement agency. Existing resident complaints suggest a need to provide better enforcement of traffic speeds. It is recommended that the City assume responsibility for traffic controls and enforcement in the area. The request lists additional stop signs and law enforcement., as the homeowners major goals from this process. Speed limit enforcement by the Sheriff's department would be a major benefit to the area, although the incidence of the enforcement may be less than resident expectations. It is not likely that the Traffic Engineering section will recommend :the installation of stop signs in the development, particularly for traffic on the problem streets of Oxford Lane and Cardiff Drive. These streets are not designed or intended for multi -way stops, and it is our experience that such signs do not slow overall travel speeds through the development. These resident concerns, however, are no different than resident complaints from many other areas of the City where long residential collector streets exist. California Vehicle Code. section 21107.5 allows municipalities to assume this responsibility, but the code section requires that a public hearing be held on the issue and that the property owner be notified at least ten days prior to the public hearing. City Council deliberated the request on September 23, 1990 and established a public hearing date of October 23, 1990.
