SUBJECT: Progress Report on Day Laborers Action Plan
DEPARTMENT: City Manager
BACKGROUND
On August 1, 1990, this item was presented to City Council for review and
study. City Council directed staff to begin to quickly implement the following
action plan to address the day laborers situation and alleviate the problems;
littering, loitering, blocking of entry ways businesses and traffic, safety
resulting from large numbers of day laborers gathering on the City's sidewalks
and highways.
The City Council action plan included:
1) Provide the presence of law enforcement by providing foot patrol by adding
an additional two deputies during the peak hours of 7:00 a.m. to 11:00
a.m., Monday through Saturday.
2) Transfer from contigency $5,000 and direct public works to purchase trash
receptacles with liners for San Fernando Road at City expense.
3) Move to establish a day laborer site with amenities.
4) Direct staff to contact congressman and seek advise of Immigration .
Naturalization Service.
5) Direct staff to implement a pro -active code enforcement effort.
6) Direct staff to prepare brochure on "Day Laborers Rights and
Responsibilities" and brochure for employers and homeowners in both
English and Spanish.
In proceeding to move forward and establish a day laborer site, City. staff has
contacted and is working with a realtor to contact owners of possible vacant
properties, obtain leasing costs and research the feasibility of the site for
the program. In conjunction, staff is .calling local vendors to solicit bid
requests for leasing of a trailer and bathroom facilities. Staff is also
coordinating other -site amenities and researching costs.
On August 6, 1990 the.City began Sheriff foot patrol with the addition of two
deputies at $35.33 per hour for a two week period ending on 8/18/90. The total
cost of foot patrol for the hours of 7:00 a.m. to 11:30 a.m., Monday through
Saturday is $1,695.84. Additionally, the area has been patroled by area cars at
no expense to the City. Also, for the next three Saturdays, 8/11/90, 8/10/90
and 8/25/90, a volunteer pons "nit will also patrol the area. A summary report
assessing the impact of this program will be provided. to the Council at the
meeting. APPROVED

City -staff has worked with the ad-hoc day laborer committee and has compiled the
text for "Day Laborers Rights and Responsibilities" an educational flier. The
text will be translated into Spanish, graphics will be incorporated and the
flier will be printed. Target date for the flier is 8/28/90, approximate cost
for 2,000 will run $500 - $600. Attached as attachement l is the English
version of the text for the flier.
RECOMMENDATION
Receive progress report on Day Laborers action plan and direct staff to return
to City Council on August 28, 1990 meeting with report providing alternative
site locations, and a budget for the program.

RIGHTS AND RESPONSIBILITIES
Legal Rights
• Regardless of your citizenship and legal status, the law protects your right to receive a fair minimum wage
of $4.25 per hour for eight hours work and $6.38 per hour for hours worked over eight hours per day.
• I£ you are injured while working or travelling to or from work with your employer, your employer is
required by law to provide insurance for you. This insurance may pay for your medical bills, disability,
loss of wages and pain and suffering. This is called Workers Compensation Insurance.
• In addition to Workers Compensation Insurance, you may be entitled to receive income from the state if you
are disabled.
• If you have worked for a period of time and your employers have made deduction from you paycheck, you may
be entilted to unemployment insurance payments. This is money paid to you by the state when you can not
find work.
Responsibilities
• Obey all traffic laws. This includes crossing the street only where there are signal lights or pedestrian
crosswalks. Take precaution when crossing the street.
• Do not block crosswalks, streets or entrances to businesses.
• Littering is not legal. Please.use trash receptacles.
• Restrooms must be used, it is not legal to urinate in public or back alleyways.
• It is illegal to drink alcoholic beverages in public or to be intoxicated in public.
• Do not interfere with passing vehicles, sit on parked cars, or get in vehicles unless permitted to do so.
