Palmer Associates DEPARTMENT: Community Develo BACKGROUND: This item has been continued from the March 27th City Council meeting. The request before the City Council has been slightly modified to exclude a portion of the Proposed Development Agreement. This portion, the Vista Terrace project, has been approved by the City Council and is conditioned to participate with four other developers in the construction of Golden Valley Road (between Soledad Canyon Road and State Route 14, the Antelope Valley Freeway.)_ The City's legal counsel has reviewed the revised Development Agreement and the required ordinance. This continued public hearing is open, so the Council may receive public testimony and discuss this proposal further. In considering approval of the proposed Development Agreement and related projects, the City Council must also consider the realignment of Rio Vista Road through the applicant's Westcreek project. The applicant has also requested transferring the affordable housing requirement of the Westcreek project to another one of the applicant's housing projects within the City. Originally, staff recommended that the Planning Commission recommend approval of the Development Agreement and related projects to the City Council. The Planning Commission has recommended that the City Council take the following action: 1) Approve Tentative Tract Map No. 45022 and related applications for the project known as Vista Terrace (at Golden Valley Road and Sierra Highway; this project was approved by City Council on March 27, 1990.) . 2) Approve Tentative Tract Map No. 31236 and related applications for the project known as Santa Catarina (Southwest of Sky Blue Mesa). 3) Deny Vesting Tentative Tract Map No. 45023 and related applications for the project known as The Colony (east of. the Antelope Freeway and west of Woodfall Road). 4) Enter into an agreement to allow the affordable housing requirement (for 226 units) for the applicant's Westcreek project to be transferred to a nearby, existing multi -family residential project which is also owned by the applicant. Continued To: 'Agenda Item: e 5) Enter .into an agreement, through the Development Agreement, that approvals will be good for a period of ten years and that various rules of development (i.e.; zoning codes, fee schedules, -etc.) will be. held constant for the duration of the agreement. RECOMMENDATION: It is recommended that the City Council take the following action at the April 17th public hearing: 1) Open the public hearing on the. Development Agreement, including The Colony and Santa.Catarina projects. 2) Hear public testimony on the proposal. 3) Continue the public hearing to May 8, 1990: DISCUSSION: Staff is asking the City Council to open the public hearing to take testimony on the Development Agreement and related projects in their modified form. This is necessary in order for Council and staff to re-evaluate the modified Development Agreement proposal to determine that it still conforms with the objectives of the verbal agreement discussed between the City and the Developer.. Staff would also like the opportunity to examine the revised information submitted and to respond to some of the latest inquiries made concerning the proposal. Continuing this public hearing would also afford staff the chance to meet with project opponents to discuss the revised proposal. Council person -elect Jill Klajic may also need this additional time to become familiar with the proposal. Staff would also like.to evaluate the land use potential of The Colony project. A density comparison study shall also be conducted by staff. DRAFT 3/22/90 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING DEVELOPMENT AGREEMENT NO. 90 - WITH G. H. PALMER ASSOCIATES, ELEANOR HIRSCH, ET AL., AND ROBERT SHIREY, ET AL. THE CITY COUNCIL OF THE CITY OF SANTA CLARITA ordains as follows: SECTION 1. A Development Agreement has been requested of the City for the approval of Certain development projects, Commonly referred to as Vista Terrace Project, Santa Catarina Project, Westcreek Project, and the Colony Project. These development proposals are more particularly described in the subject Development Agreement No. 90- . . SECTION 2. The City Council finds and determines that notice of intention to consider the Development Agreement has been given pursuant to Government Code Section 65867. SECTION 3. The City Council has conducted a public hearing on Development Agreement No. 9- , Zone Change Nos. 86-522 and 89-006, vesting Tentative Map Nos. 45022, 45023, 31236, as amended, and Conditional Use Permit Nos. 87-017, , 89-015, and 86-063-(5). SECTION 4. The City Council has reviewed and considered the information contained in Environmental Impact Report No. and Addenda thereto dated i dch:OR025257 03/22/90 11:46 $21323 2700 BW&S LA MAIN E Environmental Impact Report No. dated October, 1987, and Addenda thereto dated , and the City mitigated Negative Declaration dated September 27, 1989 and Addenda thereto dated , certified the adequacy of such environmental documents, and made findings upon the significant environmental impacts identified in the related Environmental Impact Reports, such findings included adoption of appropriate statements of overriding conditions. SECTION S. The City Council finds and determines that the City of Santa Clarita is proceeding in a timely fashion with the preparation of the General Plan and that there is a reasonable probability that this Development Agreement will be consistent with the General Plan proposal currently being considered or studied and that the proposed Development Agreement complies with all other applicable requirements of state law and local ordinances. The City Council has, in addition, specifically considered the regional welfare and the impacts of the Development Agreement upon the regional welfare. The City Council finds and determines that the benefits of the project set forth in the Development Agreement and related discretionary entitlement approvals, the related environmental assessments, and statements of overriding considerations establish the reasonable relationship of the various projects to the regional welfare. -2- 03/22/90 11:46 10213 23 2700 i BW&S LA MAIN 0 SECTION 5. The City Council.hereby approves Development Agreement No. 90- between the City of Santa Clarita and G.H. Palmer Associates, Eleanor Hirsch, et al., and Robert Shirey, et al, relative to the Santa Catherina and Vista Terrace Projects, changes to the West Creek Project and annexation of the Colony Project, and related public works improvements, which is attached hereto as EXHIBIT "A." The Mayor is authorized to execute the Development Agreement on behalf of the City of Santa Clarita and the City Clerk is authorized to attest to the Mayor's signature thereto. SECTION 7. The City Clerk is directed to cause a copy of the Development Agreement to be recorded with the County Recorder not later than ten (10) days after it becomes effective upon execution by the last party thereto. SECTION 8. This ordinance shall be effective upon the thirty-first (31st) day after its passage and adoption. PASSED, APPROVED. and ADOPTED this day of 1990.
