Harris 0Y. cm, On June 18, 1990, the State of California Office of Planning and Research granted the City's request for an extension of time for preparation of the General Plan. Copies of the extension letter are attached. Of significance is Condition No. 2 which prohibits the processing of new vesting tentative maps. Vesting tentative maps filed before June 18, 1990, may still be processed. New tentative maps may also be processed providing they are not for vesting. With respect to Condition No. 1, the law requires and the City has been making the necessary finding regarding probability of consistency with the proposed General Plan, therefore this condition is not new. A new finding will be required once the General Plan has been recommended for approval by Planning Commission, however, such that projects be consistent with the draft General Plan which has been recommended by the Planning Commission. RECOMMENDATION Instruct staff to comply with the conditions of approval imposed by the State Office of Planning and Research and proceed as expeditiously as possible with the formulation of the General Plan. Harris Community Development Director City of Santa Clarita 23920 Valencia Blvd., Suite 300 Santa Clarita, CA 91355 Dear Ms. Harris: ##001 P02 This is to inform you that I have approved the City of santa Clarita's request for an extension of time for the adoption of the cityfs general plan. This extension is granted for a one year period, beginning on June 18, 1990 and ending on June 17, 1991 or upon adoption of all affected elements of the.general plan, whichever comes first. The extension, as provided in California Government Code section 65361 and its relevant subsections, releases the city from the requirements that it complete its general plan within 30 months of incorporation and that it maintain a complete and adequate general plan. Please note that the granting of this extension is subject to the conditions stated in this letter. Furthermore, due to statutory constraints, this extension does not encompass the hous- ing element of the city's general plan. As the basis for granting this extension, I reference the findings made by the Santa Clarita City Council in Resolution No. 90-101. I have determined that the resolution and the additional explanatory and supporting data submitted to me in the application satisfy the requirements of Government Code section 65361 and its relevant subsections. In accordance with the powers granted me by Government Code section 65361, I have determined that the follow- ing conditions are necessary in order to ensure full compliance with the Planning and Zoning Law during the term of the extension. 1. (a) until the draft general plan is approved by the planning commission, the city may approve a discretionary land use project only when the city makes written findings, based upon substantial evidence in the record, that (1) there is a reasonable probability that the project will be consistent with the proposed general plan; and (2) there is little or no probability that the project will be detrimental to or JAN -02-100 MON 22:01 Ids -2- TEL 2 - TEL NO: Is 4001 P03 interfere with the future adopted general plan if the project is ultimately inconsistent with that plan. (b) upon approval of the draft general plan by the planning commission, the city may approve discretionary land use projects only when the city mazes written findings, based upon substantial evidence in the record, that such projects are consistent with the draft general plan. 2. The city shall not process or act on any vesting tentative map, except for those filed with the city prior to June 18, 1990. 3. The city council shall not approve any redevelopment plan until the final general plan has been adopted by the city council. The city may, however, proceed with those actions necessary to enable the city council to approve one or more final redevelopment plans concurrently with its approval of the general plan. 4. For the purposes of this extensions (a) "Discretionary land use project" is defined as a zone change, development agreement, specific plan, tentative subdivision map (including a parcel map), variance, conditional use permit, other permit requiring notice and hearing under the zoning ordinance (i.e., oak tree permit, surface mining permit, etc.), public works/capital improvement project (except as necessary for maintenance of existing works or public safety), or city -initiated an- nexation or sphere of influence revision requests. (b) "Draft general plan" is defined as the proposed general plan approved by the planning commission and referred to the city council for adoption. One function of the city council is to refine the draft plan, as necessary, prior to final adoption. Accordingly, the council may make orderly revi- sions to the draft plan and refer the draft to the planning commission for further consideration as it deems necessary during its deliberations and prior to final adoption. (0) "City" is defined to include the city council and any committee, commission, board or individual delegated administrative responsibilities under the city's ordinances and policies. 5. Upon adoption of the final general plan, the city shall send OPR a copy of the final Santa Clarita General Plan and the Santa Clarita City council resolution adopting that plan. This extension does not affect the city's responsibilities with regard to public notice, public hearing, and the California Environmental Quality Act. in case of a conflict between the 'JAN -02-100 MON 22:01 ID:� -3- TEL NO: 0 #001 PO4 conditions of this extension and city policies or regulations, the extension conditions shall prevail.
