BACKGROUND
As the Council is aware, the City has not been able to complete its general plan
within the first thirty months following incorporation as recommended under
state law. Provisions exist in state law for the City to request from the State
Office of Planning and Research (OPR) a total of two time extensions not to
exceed one year each. State law requires that the City Council conduct a public
hearing and adopt a resolution making any one of six findings required by
Government Code Section 65361 (copy attached). Staff believes that the City is
able to justify making three of the findings: Sections 65361 (a)(2), (4), and
(6). The reasons to support the required findings are summarized below and
contained in the draft resolution which is attached for Council's consideration:
1. The City's original consultant terminated its contract with the City to
complete the general plan. This created a delay in hiring a new consultant
and familiarizing.the new consultant with the work completed to that point.
2. A turnover has occurred in the City staff. The City now has its third
Director of Community Development since incorporation (in addition to an
acting Director for approximately six months). Additional turnovers and
staff adjustments have also occurred in both the Advance and" Current
Planning Divisions of the Community Development Department.
3. The City is utilizing an extensive public review process. A 23 -member
General Plan Advisory Committee (GPAC) has been created to include
additional citizen input beyond that required by state law. These meetings
are all open to the public. Regular meetings and updates are also provided
at Planning Commission and City Council meetings to provide the fullest
opportunity for community awareness and input. Additionally, a series of
public forums are scheduled during the month of June 1990. Initially four
forums will be held at different locations throughout the City, to solicit
general public input as part of the City's first general plan. These forums
will precede the formal public hearings before the Planning Commission and
City Council. An extensive public participation program is proposed to
promote public involvement and a general plan that is reflective of the
needs and desires of the citizens.

4. In addition to the seven mandatory elements of the General Plan, a total of
six optional elements are due to. be completed as part of Santa Clarita's
general plan: Air Quality,. Community Design, Economic Development, Human
Resources, Parks and Recreation, and Public Services, Facilities, and
Utilities. The inclusion of these optional elements will provide the City
with a comprehensive document to guide and direct the City's growth and
development.
The attached resolution will be part of an application to CPR as part of the
City's request for a time extension. The Director of CPR is the individual that
is empowered to -grant the time extension. The Council is advised that as part
of an approval of a time extension, conditions of approval may be attached.
Past examples of such conditions include: (1) Demonstration to the state that
projects and actions approved by the City are likely to be consistent with the
general plan when adopted, (2) A minimum 30 -day review by the state of the
general plan elements and related environmental documents, prior to their
approval/adoption, and (3) a prohibition of processing any development
agreements, specific plans, or vesting tentative maps. In the event that
conditions are attached which the City feels are inappropriate, the City may
appeal the decision to the state Planning Advisory and Assistance Council.
RECOMMENDATION:
1. Pending public testimony, authorize the City to request a time extension of
one year.
2. Adopt Resolution No. 90-101.

RESOLUTION NO. 90-101
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA CLARITA MAKING FINDINGS
PURSUANT TO SECTION 65361
OF THE CALIFORNIA GOVERNMENT CODE
AND REQUESTING
A ONE-YEAR TIME EXTENSION FOR THE COMPLETION
OF THE GENERAL PLAN
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council does hereby find and determine as
follows:
a. On December 15, 1987, the City of Santa Clarita incorporated as a
general law city. This incorporation represented the largest
incorporation in the history of California. The official population
at incorporation was 147,228 with a land area of 40 square miles.
b. In accordance with Section 65360 of the Government Code, a newly
incorporated city is allocated 30 months from the time of
incorporation to prepare and adopt a general plan.
C. The City, in conjunction with its general plan consultants, has
determined that the statutory deadline will be impractical for the
City to meet.
d. The City will seek a one-year time extension for the completion of
all seven mandatory elements and all six of the proposed optional
elements of its General Plan in accordance with Section 65361 of the
Government Code.
e. A duly noticed public hearing was held by the City Council on June
12, 1990 in the City Council Chambers, 23920 Valencia, Boulevard,
Santa Clarita, commencing at or after 6:30 p.m.
SECTION 2. Based upon the testimony and -other evidence received at
the public hearing, and upon studies and investigation made by the City
Council and on its behalf, the -Council further finds and determines as follows:
a. In accordance with Section 65361 (a)(2) of the Government Code, the
City finds .that in spite of sufficient budgetary provisions and
substantial recruiting efforts, the City has experienced a turnover
in both staff and consultant assistance. A turnover in the staff has
occurred in the approximately 18 months that the City has had staff
available to work on the preparation of the general plan. The
department head position has changed three times since incorporation;
staff adjustments have also occurred. The City's original general
plan consultant terminated its services with the City for the
completion of the: general plan. Additional start-up time was
necessary for a new consultant to be hired and become familiar with
the work previously completed.

b. In accordance with Section 65361(a)(4) of the Government Code, the
City finds that the extended public review process proposed to assure
the opportunity for ample public participation will cause delays in
the process. A 23 -member General Plan Advisory Committee (GPAC) has
been created and has been working diligently on the preparation of
the general plan. The GPAC process includes additional citizen input
beyond that required by state law. Additionally, a series of public
forums will be held at different locations throughout the City, to
solicit general public input as part of the City's first general
plan. These forums will precede the formal public hearings before
the Planning Commission and City Council.
C. In accordance with Section 65361(a)(6) of the Government Code, other
reasons exist to justify the granting of a time extension. As part
of its general plan, the City has opted to prepare six additional
elements not mandated by state law: (1) Air Quality, (2) Community
Design, (3) Economic Development, (4) Human Resources, (5) Parks and
Recreation, and (6) Public Services, Facilities, and Utilities. The
preparation of these additional elements has consumed additional
staff and consultant time, which has created the need for additional
time to complete the general plan. The planning area and proposed
sphere of influence for the general plan encompasses the entire Santa
Clarita Valley, consisting of over 200 square miles.
SECTION 3. The .City of Santa Clarita City Council finds that in
accordance with the California Environmental Quality Act, the approval of a
time extension for the adoption of the general plan is exempt under section
65361(f) of the Government Code and requires no further environmental review.
SECTION 4. Bdsed upon the foregoing, the City Council hereby
approves a request for a time extension, without conditions, of one year for
the adoption of the general plan.
SECTION 5. The City Clerk shall certify the adoption of this
Resolution and shall forward a copy of this resolution to the Director of
Planning and Research of the State of California as part of the City's
application for a one-year time extension.

EXCERPT FROM SECTION 65361 OF THE GOVERNMENT CODE
Extension of deadline 65361. (a) Notwithstanding any other provision
to adopt plan of law, upon application by a city or county, the
Director of Planning and Research shall grant a
reasonable extension of time, not to exceed one
year from the date of issuance of the extension,
for the preparation and adoption of all or part
of the general plan, if the legislative body of
the city or county, after a public hearing, makes
any of the following findings:
(1) Data required for the general plan shall be
provided by another agency and it has not yet
been provided.
(2) In spite of sufficient budgetary provisions
and substantial recruiting efforts, the city or
county has not been able to obtain necessary
staff or consultant assistance.
(3) A disaster has occurred requiring
reassignment of staff for an extended period or
requiring a complete reevaluation and revision of
the general plan, or both.
(4) Local review procedures require an extended
public review process which has resulted in
delaying the decision by the legislative body.
(5) The city or county is jointly preparing all
or part of the general plan with one or more
other jurisdictions pursuant to an existing
agreement and timetable for completion.
(6) Other reasons exist that justify the
granting of an extension, so that the timely '
preparation and adoption of a general plan is
promoted.
