BACKGROUND
The City Council was presented with a declaration of intention to vacate a
portion of the alley at Fourth Street and San Fernando Road, at its March 13,
1990 meeting. The City Council directed staff to meet with the adjacent
property owners to investigate possible improvements to the subject parcel of
land. Staff had proposed vacating the parcel of property to the adjacent
property owner, Dr. Kost, owner of the Newhall -Saugus Pet Clinic, Inc., located
at 22509 Fourth Street, Newhall.
Staff met with Dr. Kost on a number of occasions to discuss his request for
improvements. Most recently, a meeting was held on March 22, 1990 and then
again on April 20, 1990 to present a plan illustrating the proposed improvements
to be made by the City. A plot plan illustrating the location of the subject
parcel and the proposed improvements is attached for the City Council's
information.
Preliminary staff estimates indicate that construction costs for this project
will be approximately $2,700. Dr. Kost has indicated that he would support the
proposed improvements if the City were willing to accept ongoing maintenance and
liability for the proposed property. The Parks and Recreation Department would
plant drought -tolerant shrubs, which would require minimal maintenance. Staff's
original recommendation to vacate the property to the adjacent property owner
was based on the feeling that improvements to the land would not provide general
public benefit. The subject parcel of land was created when the alley, which
originally connected straight into Fourth Street, was realigned to intersect
with San Fernando Road at a right angle --see attached map (Detail A). The
parcel is contiguous with a landscape portion of Dr. Kost's property, which
fronts on Fourth Street. The City Council may wish to consider the impacts of
this decision upon similar remnant parcels of property in the City, and the
long-term costs of improvements made to small parcels of land left over when
streets are widened or realigned.
Should the City Council feel that it wishes to proceed with the vacation of this
portion of the alley at Fourth Street and San Fernando Road, staff has attached
Resolution No. 90-41, which should be adopted by the City Council, thereby
setting a date for a public hearing and posting of a notice along the right of
way of the proposed vacation. The hearing may not be held less than fifteen

days following the adoption of the resolution. The hearing date is scheduled
for June 12, 1990; this date is specified within the resolution. Prior to the
hearing, staff would investigate the need to reserve utility easements and what,
if any, improvements might be necessary to the vacated alley.
RECOMMENDATION
Staff recommends that the City Council vacate the property to the adjacent
property owner, without making improvements (Option #1) because of the lack of
benefits provided to the general public by further improvements. Vacation of
the property would place responsibility for maintenance of the parcel with the
adjacent property owner.
Options for Disposition of Property:
#1. Vacate property to adjacent property owner.
#2. Install proposed improvements to property, and then vacate to
adjacent property owner, appropriate $2,700 from City Council
contingency fund for improvements and require adjacent property
owner to maintain.
#3. Install proposed improvements to property, retain title and assume
maintenance costs. Transfer $2,700 for improvements and $800 per
year for maintenance costs from City Council contingency fund.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION
OF THE ALLEY AT SAN FERNANDO ROAD AND 4TH STREET IN
THE CITY OF SANTA CLARITA
WHEREAS, the alley has been realigned and improved during the
construction of improvements on San Fernando Road and a portion of the alley
is no longer necessary; and
WHEREAS, the City will retain an easement for sewer purposes and the
utility companies will retain an easement over the portion to be vacated and
have no objection to the vacation;
NOW, THEREFORE, pursuant to the provisions of the "Street Vacation Act of
1941", being Part 3 of Division 9 of the Streets and Highways Code of the
State of California, the City Council of the City of Santa Clarita,
California, does resolve, declare, determine and order as follows:
Section 1. That it is the intention of the City Council of the City of
Santa Clarita, California, to order the vacation of a portion of the alley as
described on Exhibit A and as shown on "Exhibit B" and located within the City
of Santa Clarita, proposed to be vacated under Resolution No. 90-41 on file
and open to public inspection in the office of the City Clerk of the City of
Santa Clarita, California, located at 23920 Valencia Boulevard, Suite 300, and
referred to and by this reference incorporated herein as a part of this
Resolution.
Section 2. That the hour of 7:30 p.m. on Tuesday, June 12, 1990 at City
Hall, 23920 Valencia Boulevard, within the City of Santa Clarita, is the time
and place when and where any and all persons interested in or objecting to the
proposed vacation of this public street may appear before the City Council to
be heard, offer testimony, and submit evidence in relation thereto.
Section 3. That the City Clerk of the City of Santa'Clarita, California,
is hereby directed to cause "NOTICE OF STREET VACATION OF A PORTION OF THE
ALLEY AT SAN FERNANDO ROAD AND 4TH STREET WITHIN THE CITY OF SANTA CLARITA,
CALIFORNIA, AND PUBLIC HEARING THEREON" to be published and posted as required
by the "Street Vacation Act of 1941", being Part 3 of Division 9 of the
Streets and Highways Code of the State of California; and the City Council of
the City of Santa Clarita hereby elects to proceed under the provisions of
that Act.

Section 4. The City Clerk shall certify to the passage of this
Resolution and shall cause it to be published and posted in the manner
prescribed by law.

of said Block 42 as shown on attached Exhibit "B".
