HomeMy WebLinkAbout1990-06-12 - AGENDA REPORTS - NATURE CENTER OWNERSHIP (2)9 0 AGENDA REPORT CONSENT CALENDAR DATE: June 12, 1990 SUBJECT: Placerita Canyon Nature DEPARTMENT: Parks and Recreation BACKGROUND City Manager Approval 74&��" Item to be presented by: Jeff Kolin Ownership Status Several questions were. raised regarding the status of the Placerita Canyon Nature Center State Park at the City Council meeting of May 22, 1990. Staff contacted John Weber, Assistant Director with the Los Angeles County Parks and Recreation Department for the Northern Region for information on the status of the proposed transfer in ownership of the Placerita Canyon Nature Center. Mr. Weber was very helpful, and provided the following information regarding the status of the Placerita Canyon Nature Center Park. The Placerita Canyon Nature Center Park is currently owned by the State .of California, and operated under a permit by the County of Los -Angeles Department of Parks and Recreation. The Department. of Parks and Recreation has been discussing the transfer of ownership for-Placerita Canyon Nature Center from the State to the County for a number of months. The County is also pursuing the transfer in ownership of Tapia Park, a Los Angeles County Park; to the adjacent Malibu Creek State Park. Originally, the concept: wasfor an equal trade arrangement where the County.would transfer ownership of Tapia Park to the State of California, and the State of California would transfer ownership of Placerita Canyon Park to the County of Los Angeles. Mr. Weber indicated that the current proposal is to proceed with the transfer of ownership of Tapia Park from the County of Los Angeles to the State of California, creating a larger Malibu Creek State Park facility. Mr. Weber is recommending that the Placerita Canyon Nature Center State Park remain a State facility until some questions with adjacent private land ownership and use are resolved. He has indicated that it is his .feeling that the transfer of ownership is several years away from taking place. He is suggesting that the adjacent land -use conflicts would be easier to.resolve if the park remained.in State ownership, and that it would be inappropriate, at this time, for the County to assume the ownership of this park. When the transfer does. take place, it was Mr. Weber's opinion that the State would require that the agreement include a reverter clause that would require the property to be returned to the State of California, if it were used for. any purpose other than park and recreation purposes. Such reverter clauses are standard in park dedication and transfer agreements throughout the State. The County of Los Angeles Department of Parks and Recreation has indicated that it will ask the State of California to renew the County's permit to operate the 1 Mn, ""I nd �I �� Agenda ltem: Placerita Canyon Nature Center. Staff has requested that the City of Santa Clarita be provided with the opportunity to review a draft of the agreement when it is prepared for the transfer of the Placerita Canyon Nature Center from the State of California to the County of Los. Angeles. This would provide the opportunity for the City to insure that a reverter clause is included in the agreement. It is recommended that the City Council receive and file this report on the Placerita Canyon Nature Center Park.
