The catering trucks, in particular, have been parking in inappropriate locations in the City. The trucks have congregated in close proximity to each other, without adequate parking and creating congestion. They are also competing with legitimate restaurants. The trucks and other businesses have been known to park in one location for virtually an entire day. The present code requires that these trucks either move a minimum of 500 ft. every half hour, or if in a location longer than a half hour, they must provide sanitary facilities- for their patrons. Both of these criteria are routinely being violated. It is difficult to enforce the present code. The attached language would provide that it is unlawful for any person to sell food or beverages from wagons or other vehicles on or adjacent to a highway within the City, unless a minimum of 10 parking spaces is provided and the use is consistent with the zoning code. This -language has been reviewed and approved by the Sheriff's Department. Introduce the ordinance and pass to second reading. ATTACHMENTS Ordinance No. 90-42 MAR:254 terZ 124 �Ovll� q Agenda Item: =21 cr- 0 • NO. 90- 42 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING THE MUNICIPAL CODE AT SECTION 11.38.170 RELATING TO PEDDLING ON HIGHWAYS THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 11.38.170 of the Municipal Code for the City of Santa Clarita is amended to read as follows: 11.38.170 Peddling on Hiahways - Location Restrictions It is unlawful for any person engaged in the business of peddling or selling liquids or edibles for human consumption from wagons or other vehicles, or any traveling merchant, hawkster or peddler of goods, wares or merchandise who uses a wagon or other vehicle and who holds a license to engage in any said business in.the city, to carry on or conduct any said business upon any portion of a public highway located within the City, adjacent to any public highway located within the City, or on a sidewalk adjacent to any public highway within the City, except that any said business may be carried on at a place adjacent to a portion of the public highway, where such use is consistent with the Santa Clarita Zoning Ordinance, and where there is sufficient parking space at said place off the highway to accommodate at least 10 vehicles of persons who may stop for the purpose of making purchases from any person conducting any business mentioned above. SECTION Z. The City Clerk shall certify to the adoption of this Ordinance and cause.the same to be published in the manner required by law. PASSED AND.APPROVED this day of , 1990.
