Statutory law requires the City Clerk to post notices of vacancies for those office terms which will expire on July .31 no sooner than July 11 and no later than August 20, 1990. Thereafter, the City Council can fill the vacancy 10 days following the posted notice or as soon as July 21, 1990. The City Council has completed the recruitment and interview process for potential appointees to the Planning Commission for office terms expiring on July 31, 1990. The City shall conduct the same recruitment and interview process for the Parks and Recreation Commission. The City has received applications from interested citizens wishing to serve on the Parks and Recreation Commission. The suggested Parks and Recreation Commission recruitment schedule is as follows: Dates 1 6/28, 6/29, 7/1. 3 day advertisement in the Signal 6/28 - 7/20 Accepting applications (City Clerk's Office) 7/11 Posting of vacancy notices by City Clerk 7/20 Deadline for applications 7/23 - 7/27 Application review by City staff 7/24 City Council appointment of Commissioners for Planning Commission 7/27 City staff interview recommendations to City Council 8/3 City Council interview additions deadline 8/7 Planning Commission reorganization Week of 8/10 Interviews by City Council for Parks and Recreation Commission and appointment of Commissioners. 8/20 Parks and Recreation Commission reorganization Agenda Item:: RECOMMENDATION City Council to direct staff to advertise and interview for those offices on Parks and Recreation Commission which will expire on July 31 and City Council to select a date to conduct interviews and make appointments to fill the six (6) vacancies. NEWELL WRITER'S DIRECT DIAL 213-236-2708 OUR FILE NO. 02012-001 This letter is in response to a request from Donna Grindey, Assistant City Clerk, that I advise on the procedures for declaring vacancies and making appointments to the Planning and Parks and Recreation Commissions. The terms for some commissioners will expire on July 31 of each year. The City, prior to December 31 of each year, shall prepare a list of all commissions and committees,whose members serve at the pleasure of the City Council and a list of those offices which will become available during the coming year. Copies of the list will be made available to the public. This year, and when there are unscheduled vacancies, the City Clerk shall post notice of the vacancy and the City Council may make appointments ten days following the clerk's notice. The Planning and Parks and Recreation Commission are established at Chapters 2.26 and 2.28 of the Municipal Code, respectively. The provisions for each commission are roughly parallel regarding terms of office. 0 Mayor and Members of the City Council City of Santa Clarita February 9, 1990 Page 2 0 Both commissions consist of five members who serve at the pleasure of the City Council. Three of'the original appointments to each commission were made for terms of one year and two of the appointments were made for terms of two years. The initial terms were determined by drawing lots. Thereafter, terms are for two years. Terms expire on the last day of the third month following Council reorganization after the municipal election, and thereafter until the Council appoints the commissioner.. As municipal elections are currently held in April, the time for the scheduled termination is July 31. Statutory.law for the State of California, at Government Code Sections 54970 et. seq. (attached), makes it a matter of statewide concern that the public be informed of opportunities to serve on local commissions and committees. Government Code Section 54972 requires that the legislative body prepare an appointments list of all regular, ongoing committees and commissions with the following information: '(1) A list of the terms to expire during the upcoming year, the name of the appointee, the date of the appointment, the date that the term expires, and any necessary qualifications. (2) A list of all commissions and committees whose members serve at the pleasure of the legislative body and the qualifications applicable to each commission or committee. The appointments list is to be prepared by the Council on or before December 31 of each year. This list shall be made available to the public for a reasonable fee, not to exceed the actual cost. Scheduled vacancies are then filled by the City Council pursuant to local law, policy or practice. Government Code Section 54974 provides a procedure for filling unscheduled vacancies. Any unscheduled vacancy, such as a resignation or disqualification of a commissioner, would be followed by a notice posted with the City Clerk for the general public that the office is available. The notice may not be posted sooner than 20 days before, and no later than 20 days following the vacancy. Further, statutory law Mayor and Members of City of Santa Clarita February 9, 1990 Page 3 the City Council provides that the City Council may not fill the vacancy any sooner than 10 days following the notice. However, there is some provision for filling a vacancy for an emergency that necessitates a sooner appointment. It is the opinion of this office that the City Council should direct staff to prepare the applicable lists of officers, commissions and committees for later adoption by the City Council. Further, the City Clerk should post notices of vacancies for those offices which will expire on July 31, 1990. The notices should not be posted any sooner than July, and no later than Aucust 20, 1990. Thereafter, the City Council shall fill the vacancies no sooner than 10 days following the posted notice.
