Medina Earlier this year a buy-back recyling center located behind the closed Alpha Beta market located on Lyons Avenue closed. It is understood, the closing was due to the low value of some recyclable materials. Staff has received many calls from residents asking if the City would work toward reopening the center. The property owner, Champion Development, has given tentative permission to reestablish a recycling drop-off center where the old buy-back center had been located. The City Attorney has prepared the attached License Agreement between the City and Champion Development. Upon execution of this document, staff will pursue the opening of a drop-off center at this location. A description of the center is found attached to the License Agreement as Exhibit "B". The center will concentrate on newspaper, but will provide space for aluminum, plastic and glass. Cal Coast Recycling Inc. has also expressed an interest in opening a satellite extention of their service at this location. Staff is currently working with Cal Coast on this proposition. Blue Barrel Disposal has agreed to provide transportation of recyclables to local recycling centers such as Cal Coast or Big Mike's, and staff is drafting a M.O.U. for this service. The reestablishment of this recycling center will provide a more convenient location for residents in the Newhall/Valencia area. Start-up costs will be low since the necessary infrastructure is in place. Minor repairs, recycling bins and a sign will be required before the center is opened. Staff estimates costs to be under $2,000. Operational costs will also need funding. These costs should be low due to the donated services of Blue Barrel. Staff estimates a cost of $100 per month for periodical clean up of the area. These costs can be funded from the Public Works contractual services account. Staff is currently .working on a residential refuse franchise agreement which will require hauler(s) to open and service recycling drop-off centers throughout the City at no cost to the City. The operating cost of the Lyons recycling drop-off center would become the responsibility of the hauler when the franchise agreement is executed. RECOMMENDATION Approve the attached License Agreement. ATTACBMENT License Agreement Agenda Item: ---- tbm/AGR96129 LICENSE AGREEMENT This Agreement is made this 25th day of July , 1990, by and between CHAMPION DEVELOPMENT (hereinafter referred to as "Licensor") and THE CITY OF SANTA CLARITA (hereinafter referred to as "Licensee"). WHEREAS, Licensor is the owner of certain real property commonly known as 23600 Lyons Avenue (old Alpha Beta), Santa Clarita, California, and more particularly described on Exhibit "A", attached hereto and incorporated herein by this reference as if set forth in full; and WHEREAS, Licensee desires to obtain permission to perform certain acts upon Licensor's property, NOW, THEREFORE, it is agreed as follows: 1. Licensor grants to Licensee a license to reestablish a recycling drop-off facility at the location as particularly described on Exhibit "B" to this License Agreement, attached hereto and incorporated herein by this reference as if set forth in full. Licensor and Licensee agree that this Agreement, including Exhibit B. may be modified from time to time upon the mutual written consent of Licensor and Licensee. 2. This license is personal to the Licensee. It is nonassignable and any attempt to assign this license shall terminate any and all rights under this Agreement. tbm/AGR96129 3. It is completely enclosed, including the top, by either the adjacent building's wall or chain-link fence. The facility would not be expanded in size, but some minor repairs and/or modifications to the fence might be necessary to easily exchange recycling bins. Modifications or repairs to the facility would be done at the expense of the City or private donor and would become the property of the land owner. Center Operation The City would like to re-establish a recycling _drop-off facility which was in operation at this location several months ago. It is unknown what the previous recycling operator collected, but the City intends to concentrate collection efforts on newspaper and High Density Polystyrene (HDP) containers. The center will accept aluminum and glass. This would be an unmanned center, and recyclers would be required to deposit specific material through holes in the fence directly into identified recycling bins. Access to the facility would be limited to City personnel, City designated groupsandthe refuse hauler. Full recycling bins would be replaced with empty bins on an as -needed basis by the refuse hauler. Please note that I have executed this agreement on behalf of Champion Development and am returning it to you. Please note that the Exhibit A legal description has not been attached. I have enclosed a legal description of our entire parcel, which you may feel useful attaching as Exhibit A. Even if that is used, of course, since it is the smallest legal parcel description available, we are all aware that the description on Exhibit B actually defines the area where the recycling facility is.and may be operated. Please note that I have executed this license agreement as an accommodation to your City with the following additional explicit understandings: 1. The right to terminate under article three of the agreement is with or without cause, by either party. It would only be our intent to terminate the agreement if the continuation of it negatively effects the operation of the center. The City of Santa Clarita will hold Champion Development, its partners, tenants, agents, assignees, successors, and assigns harmless from any liability caused by the operation of the recycling center. If the City has an insurance policy, I would appreciate receiving a certificate of insurance indicating that Champion Development is an additional insured.
