Medina SUBJECT: RAILROAD AVENUE (PORTIONS THEREOF) AT 4th STREET AND SAN FERNANDO ROAD/VACATION Resolution NumVer: 90-140 DEPARTMENT: Public BACKGROUND The City Council in its meeting of June 26, 1990 set this date for consideration of the vacation of a portion of Railroad Avenue at San Fernando and 4th Street. The recently completed San Fernando Road project administered by Caltrans realigned Railroad Avenue at San Fernando Road to provide a right angle intersection with 4th Street (see attached map). Curb and gutter was constructed 'along San Fernando Road and along the right angle turn from Railroad Avenue to 4th Street. Consequently, there is a portion of right-of-way for Railroad Avenue which is no longer necessary for street purposes. Since the easement was originally granted only for street purposes, it is appropriate to conduct the public hearing to consider vacation of the road easement. Resolution No. 90-121 declaring the intention of the City Council to vacate a portion of Railroad Avenue at 4th Street and San Fernando Road was approved on June 26, 1990 and established July 24, 1990 at 6:30 p.m. as the date and time for a public hearing on this issue. Public notices have been published and posted as required by the Government Code.. The utility companies have been notified of the proposed vacation so that they may reserve any utility easements they may require. At this public hearing, any and all persons interested in or objecting to the proposed vacation may appear before the City Council to be heard. The City Council conduct the public hearing and approve Resolution No. 90-140 vacating a portion of Railroad Avenue at 4th Street and San Fernando Road as described and shown on "Exhibit A", and instruct the City Clerk to cause the resolution to be recorded.
