Medina DATE: January 23, 1990 SUBJECT: Ordinance No. 9P-2 Los Angeles County Code - "Sanitary Sewers and Industrial aste Ordinance" DEPARTMENT: Public Works G" 1 BACKGROUND This item is on the agenda for introduction of Ordinance No. 90-2 adopting by reference Los Angeles County Code Title 20, Utilities, Division 2, relating to sanitary sewers and industrial waste. On July 27, 1989, the Los Angeles County Board of Supervisors adopted an Ordinance amending the Los Angeles County Code, Title 20, Utilities, Division 2, also known as the Sanitary Sewers and Industrial Waste Ordinance, whereby fees collected for processing sanitary sewer and industrial waste plan reviews, permits and inspections were increased effective August 27, 1989. In addition, fees were established for services previously performed without charge and a number of technical changes were incorporated to bring the code into conformance with U.S. Environmental Protection Agency requirements. The City has previously adopted Title 20, Division 2 by reference and has contracted with the County for enforcement of its provisions. In order for the City to recover costs expended in enforcement and provide the necessary legal authority for control of industrial waste, it is recommended that Council adopt the County's amended version of Title 20, Division 2. RECOMMENDATION Adopt Ordinance 90-2 as an urgency ordinance to be effective immediately upon adoption. ATTACHMENTS Ordinance No. 90-2 County's Amended Title 20, Division 2 Adopted :I 13 q49 Agenda item: u ORDINANCE NO. 90- 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADOPTING BY REFERENCE LOS ANGELES COUNTY CODE, TITLE 20, UTILITIES, DIVISION 2, SANITARY SEWERS AND INDUSTRIAL WASTES AS AN URGENCY MEASURE WHEREAS, the City Council of the City of Santa Clarita has previously adopted by reference Title 20, of the Los Angeles County Code relating to utilities; and WHEREAS, on July 27, 1989, the County Board of Supervisors adopted an ordinance amending the Los Angeles County Code, Title 20, Utilities, Division 2, also known as the Sanitary Sewer and Industrial Waste Ordinance, whereby fees collected for processing sanitary sewer and industrial waste plan reviews, permits and inspections were increased effective August 27, 1989; and WHEREAS, the City of Santa Clarita has contracted with the County of Los Angeles to collect fees for processing sanitary sewer and industrial waste plan reviews, permits and inspections and in such contract has agreed to maintain an ordinance substantially similar to the Sanitary Sewer and Industrial Waste Ordinance of Los Angeles County; and WHEREAS, the amended Sanitary Sewer and Industrial Waste Ordinance of Los Angeles County also makes a number of technical changes to bring the Code into conformance with the United States Environmental Protection Agency requirements; and WHEREAS, it is the desire of the City of Santa Clarita to incorporate by reference the amended Sanitary Sewer and Industrial Waste Ordinance of Los Angeles County until such time as the City of Santa Clarita shall adopt a comprehensive utilities ordinance, including a sanitary sewer and industrial waste ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That Division 2, the Sanitary Sewer and Industrial Waste Ordinance, of Title 20 of the Los Angeles County Code as amended July 27, 1989 to be effective August 27, 1989 is hereby adopted by reference as a portion of the Santa Clarita Municipal Code. N SECTION 2. That this ordinance is adopted as an urgency measure. The facts of the urgency are these: The City of Santa Clarita contracts with the County of Los Angeles to provide Sanitary Sewer and Industrial Waste ordinance administration and is obliged to maintain its ordinance substantially identical to the County Code, Title 20, Division 2. Failure by the City to maintain the ordinance in substantially identical form could result in termination of the services by the County of Los Angeles. Therefore, this ordinance shall be effective immediately upon adoption. SECTION 3. That the City Clerk shall maintain three copies of Title 20, Division 2, as amended, for examination by the public. SECTION 4. That the City Clerk shall certify to the adoption of this ordinance and cause it to be published in the manner prescribed by law. PASSED, APPROVED AND ADOPTED this day of . 1990.
