This item is on the agenda to register the City of Santa Clarita's support for
SB 2748 - Asbestos Removal Cost recovery.
The asbestos installed in the late 1960's and 1970's are now causing local
governments to provide for costly survey's, monitoring and removal programs.
Manufacturers of asbestos claim that the statute of limitations on asbestos
begins when the asbestos is first installed or found within the buildings.
Presently counties and cities and the State of California cannot recover the
cost of abatement from the manufacturer.
SB 2748 would aid cities, counties and the State by providing a one year opening
to bring action against manufacturers. Secondly, it provides -that if a city is
cited for a health hazard or determines that there is a significant health risk,
a three year statute of limitations would then begin to run. Given the state of
decreasing revenues to all governmental agencies, the ability to reclaim the
funds. used for asbestos abatement will provide a greater incentive to pursue
abatement programs. This would in turn provide a safer, asbestos free working
environment.
RECOMMENDATION
That the City Council support SB 2748 and authorize staff to prepare letters of
support.

An act to add Section 340.7 to the Code of Civil Procedure,
relating to statutes of limitation.
SUMMARY:
Creates a special time limitation for public entities to bring
civil actions against manufacturers of asbestos -containing
products for the cost of removing or treating asbestos
materials in buildings or facilities;the limitation Would be 3
years from the date of discovery that the product poses a
significant health hazard, as defined, to occupants of a
building; more.
