Medina DATE: October 30, 1990 SUBJECT: SOLEDAD CANYON ROAD FROM GOLDEN OAK ROAD TO'GOLDENROD WAY (PROJECT 89-17) MEDIAN IMPROVEMENT - BID AWARD REQUEST DEPARTMENT: Public Works r BACKGROUND On September 11, 1990, Council authorized the advertisement of the subject project. The project consists of permanent modifications to the median on Soledad Canyon Road at Golden Oak Road for the purpose of providing additional left -turn storage capacity for westbound traffic. On October 4, 1990, the following bids were received by the City: Company Bid Amount R.P.S. Co. $39,677.00 R.C. Becker & Son Inc. $43,194.50 Excel Paving Company $46,749.00 Los Angeles Engineering,,Inc. $47,430.00 Padilla and Sons Co. $49,575.25 Padilla Paving Co., Inc. $57,125.00 The Engineer's estimate for this project is $46,450, and a total of $73,300 has been provided in Account No. 25-96040-227 for design, contract administration, inspection, and construction of this project. Staff recommends that the project be awarded to R.P.S. Co., the low bidder. R.P.S. Co. possesses the necessary State Contractor's license and is a member in good standing. It should be noted that the R.P.S. Co. bid contained the following irregularities: 1. Bidders were required to provide the names of all subcontractors for portions of the work in excess of one-half of one percent of the bid. R.P.S. Co. did not list any subcontractors for striping, loop detection, or asphalt paving in their bid. In follow-up phone calls with staff, R.P.S. Co. identified Cotemark, Signal Installation and Repair Inc., and APCo as proposed subcontractors. It should be noted that recent state law has been revised to require that only those subcontracts in excess of $10,000 be listed.. Since none of the proposed subcontracts is in excess of $1000000 the irregularity is considered minor. 010VED / / pgmm,lLdalie 0 • MEDIAN IMPROVEMENTS ON SOLEDAD CANYON ROAD Page 2 2. Bidders were required to submit their proposal on bid forms included in the bid set. R.P.S. Co. provided their bid bond on their Surety's form. In addition, the bid bond submitted by B.P.S. Co. provides that if they fail to enter into a contract with the City, then they will forfeit their bid bond, but the amount shall not exceed the difference between their bid and the amount contracted for with another party. Under the bid bond form included in the bid set, the bidder forfeits the entire bid bond. Since the B.P.S. Co. bid, bond is for approximately $3,900, and the next lowest bidder is approximately $3,500 above the R.P.S. Co, bid, staff recommends waiver of this irregularity. 3.. The extended amount for base material on the R.P.S. Co. bid schedule was rounded off from $4998.90 to $5,000. The total bid amount should read $39,675.90, not $39,677. The above irregularities have been brought to the attention of the City Attorney's office. Staff has been advised that the contract documents permit the City to waive any irregularity. RECOMMENDATION 1. Except for the irregularity concerning the extended amount for base material on the R.P.S. Co, bid schedule, waive the irregularities found in the R.P.S. Co. bid. 2. Award the contract to R.P.S. Co. in the amount of $39,675.90. /kn
