Medina' SUBJECT: TRANSFER OF STORM DRAIN TO LOS ANGELES COUNTY FLOOD CONTROL DISTRICT (L.A.C.F.C.D.) TRACT NUMBER 34251, PRIVATE DRAIN NUMBER 1786 Resolution Numbkr: 90-129 DEPARTMENT: Public Works BACKGROUND The construction of Private Drain No. 1786 has been inspected and approved by the County Director of Public Works, who has sent a Notice of Completion to the City. The storm drains were constructed by the developer in accordance with agreements and the Faithful Performance Bonds on file with the City Clerk (see Exhibit "B" attached showing the location and extent of improvements). The agreements also provide that the work shall not be deemed completed until approved, accepted as complete, and transferred to L.A.C.F.C.D. for maintenance. The City and County entered into an agreement on March 14, 1989 recorded as Document Number 89-1346418 which provides for the transfer of storm drains. The City Council must approve a resolution authorizing the transfer to complete the process. The transfer is then accepted and approved by the Board of Supervisors for the L.A.C.F.C.D., who operates and maintains the storm drains for public use. RECOMMENDATION 1. Adopt the attached resolution for the transfer and conveyance of the storm drain improvements to the L.A.C.F.C.D. for purposes of operation, maintenance, repair, and improvements. 2. Authorize the Mayor of the City to execute the attached Quitclaim Deed(s) for the easement(s) to the L.A.C.F.C.D, on behalf of the City. 3. Direct the City Clerk to transmit copy of this report indicating the date and action taken, three copies of the original unrecorded Quitclaim Deed properly executed and acknowledged, and three original copies of the adopted resolution to the County of Los Angeles. ATTACHMENTS Resolution No. 90-129 Exhibit A Exhibit B Quitclaim of Easements /tw Adopted: -2 Agenda Item: Owl RESOLUTION NO. 90-129 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS KNOWN AS PRIVATE DRAIN NO. 1786 IN THE CITY OF SANTA CLARITA FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF. WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage system known as Private Drain No. 1786, described in Exhibit A attached hereto; and WHEREAS, the City is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS, the City and the Los Angeles County Flood Control District entered into an agreement dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage system described in Exhibit A attached hereto from the City to the Los Angeles County Flood Control District for future operation, maintenance, repair, and improvement. NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system described in said Exhibit A. BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights-of-way for said drain now vested in the City and all other necessary rights-of-way therefore have been conveyed to and accepted by District. Reference is hereby made to District Drawings Nos. 366-F7.1 through 366-F7.20, the plans and profile of said storm drain improvements and drainage system on file in the office_of the City Engineer and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. BE IT FURTHER RESOLVED that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles. Such warranties by the City are incorporated here by this reference. The City Clerk shall certify to the adoption of this Resolution: PASSED, APPROVED, AND ADOPTED this day of 1990. ATTEST: CITY CLERK MAYOR I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Santa Clarita at a regular meeting thereof, held on the day of , 19 by the following vote of the Council: AYES: COUNCILMEMBERS: NOES: COUNCILMEMBERS: ABSENT: COUNCILMEMBERS: CITY CLERK EXHIBIT "A" Private Drain No. 1786 A reinforced concrete pipe and box storm drain system and appurtenant structures for Tract No. 34251, filed in Book 1019, pages 16 to 23, inclusive, of Maps, Records of the County of Los Angeles, generally described as follows: Line "A": Commencing from a transition structure, Station 31 +36.01, located in a 42 and 47 -foot -wide easement for covered storm drain and appurtenant structures and ingress and egress purposes, which lies within Lots 6, 7 and 10 of said tract; thence northeasterly in said easements to Tyler Lane; thence northeasterly in said street to a 42 and 47 -foot -wide easement for covered storm drain and appurtenant structures and ingress and egress purposes, which lies within Lots 13, 14 and 15 of said tract; thence northeasterly in last said mentioned easements to Scherzinger Lane; thence northeasterly, crossing Scherzinger Lane, to a transition structure, Station 46 + 68.13, a distance of 1,532 feet, more or less.
