BACKGROUND
The construction of Private Drain Nos. 1946 and 1947 located in the vicinity of
Creekside Road at McBean Parkway (see attached map) have been inspected and
approved by the County Director of Public Works, who has sent a Notice of
Completion to the City. The storm drains were constructed by the developer in
accordance with agreements and the Faithful Performance Bonds on file with the
City Clerk (see Exhibit "B" attached showing the location and extent of
improvements). The agreements also provide that the work shall not be deemed
completed until approved, accepted as complete, and transferred to L.A.C.F.C.D.
for maintenance.
The City and County entered into an agreement on March 14, 1989 recorded as
Document Number 89-1346418 which provides for the transfer of storm drains. The
City Council must approve a resolution authorizing the transfer to complete the
process. The transfer is then accepted and approved by the Board of Supervisors
for the L.A.C.F.C.D., who operates and maintains the storm drains for public use.
RECOMMENDATION
1. Adopt the attached resolution for the transfer and conveyance of the storm
drain improvements to the L.A.C.F.C.D. for purposes of operation,
maintenance, repair, and improvements.
2. Authorize the Mayor of the City to execute the attached Quitclaim Deed(s)
for the easement(s) to the L.A.C.F X .D. on behalf of the City.
3. Direct the City Clerk to tr mit copy of this report indicating the date
and action taken, three or ni 1 copies of the unrecorded Quitclaim Deed
properly executed and acknowle ed, and three original copies of the adopted
resolution to the County of Los Angeles.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS
OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF
CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER
AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS KNOWN AS PRIVATE
DRAIN NO. 1946 AND'1947 IN THE CITY OF SANTA CLARITA FOR
FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND
AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF.
WHEREAS, there have been dedicated to, or the City .has otherwise acquired,
the storm drain improvements and drainage systems known as Private Drain Nos.
1946 and 1947, described in Exhibit A attached hereto; and
WHEREAS, the City is authorized and empowered to transfer and convey to
the Los Angeles County Flood Control District any storm drain improvements and
drainage systems for future operation, maintenance, repair, and improvement;
and
WHEREAS, the City and the Los Angeles County Flood Control District
entered into an agreement dated March 14, 1989, and recorded August 22, 1989,
as Document Number 89-1346418, of the Official Records in the office of the
County Recorder for the County of Los Angeles, whereby the City made certain
warranties about its future transfers and conveyances of Flood Control
facilities to the District; and
WHEREAS, the best public interest will be served by transfer and
conveyance of the storm drain improvements and drainage systems described in
Exhibit A attached hereto from the City to the Los Angeles County Flood
Control District for future operation, maintenance, repair, and improvement.
NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los
Angeles County Flood Control District to accept the transfer and conveyance of
the storm drain improvements and drainage systems described in said Exhibit A.
BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the
Board of Supervisors of the Los Angeles County Flood Control District, the
City Engineer is directed and ordered to prepare all necessary instruments and
documents, including deed, to effectuate said transfer and conveyance, and
that the Mayor is authorized and instructed to execute said deed and other
instruments and documents. District shall have no obligation or
responsibility to maintain said storm drain, improvements, and drainage until
all rights-of-way for said drain now vested in the City and all other
necessary rights-of-way therefore have been conveyed to and accepted by
District.
Reference is hereby made to District Drawings Nos. 337-F131.1-.11 and
337-F129.1-.7, the plans and profile of said storm drain improvements and
drainage systems on file in the office of the City Engineer, and on file
in the office of the Chief Engineer of said District for further data as
to the exact location, extent, and description of said storm drain
improvements and drainage systems.
BE IT FURTHER RESOLVED that the transfer and conveyance hereby
requested are subject to each of the warranties described in the
Agreement between the City and the District dated March 14, 1989, and
recorded August 22, 1989, as Document Number 89=1346418, of the Official
Records in the office of the County Recorder for the County of Los
Angeles. Such warranties by the City are incorporated here by this
reference.
The City Clerk shall certify to the adoption of this Resolution.

For a valuable consideration, receipt of which is hereby acknowledged, the
CITY OF SANTA CLARITA, a municipal corporation, as successor in interest to the
County of Los Angeles by reason of incorporation, does hereby remise, release,
and forever quitclaim unto the LOS ANGELES COUNTY FLOOD CONTROL DISTRICT, a body
corporate and politic, all its right, title, and interest in and to those
certain easements for storm drain and storm drain ingress and egress purposes,
acquired by Tract No. 43712, filed May 28, 1986, in Book 1068, pages 40 to 46,
inclusive, of Maps, in the office of the Registrar -Recorder of the County of
Los Angeles, insofar and only insofar as said easements exist in the real
property in the City of Santa Clarita, County of Los Angeles, State of
California, described as follows:

Those portions of Lots 3, 8, 10 and 11, Tract No. 43712,
as shown on map filed in Book 1068, pages 40 to 46, inclusive,
of Maps, in the office of the Registrar -Recorder of the County

A reinforced concrete pipe storm drain system and appurtenant structures for Tract Map No. 43712, Filed
in Book 1068 , pages 40 to 46 , inclusive, of maps, Records of the County of Los Angeles, generally
described as follows:
Line "Z"
Commencing from the end of an existing storm drain, line "Z" of P.D. 1947, Station 9 + 60, located
within a 10 foot wide easement for storm drain and storm drain ingress and egress purposes, which lies
southeasterly of the intersection of McBean Parkway and Creekside Road; thence southerly, southeasterly,
and southerly within last said mentioned easement to a manhole structure, Station 21 + 17.17, a distance
of 1,163 feet, more or less.
Lateral "Z-1"
Commencing from a manhole structure per line "Z", Station 21 + 17.17 (Station 1 + 00, Lateral "Z-1 "),
located within a 10 foot wide easement for storm drain and storm drain ingress and egress purposes;
