SUBJECT: DECLARATION.OF INTENTION TO VACATE A PORTION OF
RAILROAD AVENUE AT 4TH STREET AND SAN FERNANDO ROAD

BACKGROUND
The property owners adjacent to Railroad Avenue and San Fernando Road have
requested the City to vacate a portion of Railroad Avenue. When Caltrans made
the improvements on San Fernando Road, Railroad Avenue which originally
intersected San Fernando Road was realigned to turn at a right angle onto 4th
Street - see attached vicinity map. Curb and gutter was constructed along San
Fernando Road and along the right angle turn from Railroad Avenue to 4th
Street. Consequently, there is a portion of right-of-way for Railroad Avenue
which is no longer necessary. This item is to initiate proceedings for a
vacation of public right-of-way.
The procedure governing the vacation of streets, alleys, and easements is: set
forth in the Government Code. In brief, that procedure calls for the Council to
first adopt a Resolution of Intention, set a date for a public hearing, and post
a notice along the right-of-way of the proposed vacation. The hearing may be
held not less than 15 days following the adoption of the Resolution. The
hearing date is scheduled for July 24, 1990, and this date is specified within
the Resolution. Prior to the hearing, staff will investigate the need to
reserve utility easements and what, if any, improvements might be necessary to
the vacated alley.
That the City Council approve Resolution No. 90-121, declaring its intention to
vacate a portion of Railroad Avenue as described on Exhibit A and shown on
"Exhibit B", and give notice of a public hearing to be held on Tuesday, July 24,
1990, at 6:30 p.m. Notices will be published and posted as required by the
Street Vacation Act.

RESOLUTION NO. 90-121
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA
CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF A
PORTION OF RAILROAD AVENUE AT SAN FERNANDO ROAD AND
4TH STREET IN THE CITY OF SANTA CLARITA
WHEREAS, Railroad Avenue has been realigned and improved during the
construction of improvements on San Fernando Road and a portion of
Railroad Avenue is no longer necessary; and
WHEREAS, the City will retain an easement for sewer purposes and the
utility companies will retain an easement over the portion to be vacated
and have no objection to the vacation;
NOW, THERFORE, pursuant to the provisions of the "Street Vacation Act
of 1941", being Part 3 of Division 9 of the Streets and'Highways Code of
the State of California, the City Council of the City of Santa Clarita,
California, does resolve, declare, determine and order as follows:
Section 1. That it is the intention of the City Council of the City
of Santa Clarita, California, to order the vacation of a portion of
Railroad Avenue as described on Exhibit A and as.shown on "Exhibit B" and
located within the City of Santa Clarita, proposed to be vacated under
Resolution No. 90-121 on file and open to public inspection in the office
of the City Clerk of the City of Santa Clarita, California, located at
23920 Valencia Boulevards Suite 300, and referred to and by this
reference incorporated herein as a part of this Resolution.
Section 2. That the hour of 6:30 p.m. on Tuesday, July 24, 1990 at
City Hall, 23920 Valencia Boulevard, within the City of Santa Clarita, is
the time and place when and where any and all persons interested in or
objecting to the proposed vacation of this public street may appear
before the City Council to be heard, offer testimony, and submit evidence
in relation thereto.
Section 3. That the City Clerk of the City of Santa Clarita,
California is hereby directed to cause "NOTICE OF STREET VACATION OF A
PORTION OF RAILROAD AVENUE AT SAN FERNANDO ROAD AND 4TH STREET WITHIN THE
CITY OF SANTA CLARITA, CALIFORNIA, AND PUBLIC HEARING THEREON" to be
published and posted as required by the "Street Vacation Act of 194111,
being Part 3 of Division 9 of the Streets and Highways Code of the State
of California; and the City Council of the City of Santa Clarita hereby
elects to proceed under the provisions of that Act.
Section 4. The City Clerk shall certify to the passage of this
Resolution and shall cause it to be published and posted in the manner
prescribed by law.

MAP RECORDED IN BOOK 53, PAGES 21 AND 22 OF MISCELLANEOUS
RECORDS, BOUNDED ON THE NORTHEAST BY THE SOUTHWESTERLY
BOUNDARY OF THE SOUTHERN PACIFIC RAILROAD RIGHT OF WAY, 100
FEET WIDE, AND ON THE SOUTHWEST BY THE NORTHEASTERLY
