Medina DATE: March 13, 1990 SUBJECT: VALENCIA BRIDGE & MAJOR THOROUGHFARE DISTRICT COOPERATIVE 6+i(4HMENT DEPARTMENT: Public Works(49 U lv" BACKGROUND On October 30, 1989, the City Council authorized staff to develop with the County an agreement for the joint administration of a proposed Valencia Bridge and Major Thoroughfare District. We have had several meetings with County staff to determine the major tenants of the proposed District and the associated agreement for joint administration. The major points of the agreement are: 1. The District to be formed as a single District that includes both City and County areas; 2. the City and County will establish that portion of the District which lies within their respective boundaries; 3. each entity will collect fees only in the area of the District; and 4. City and County staff will develop a priority list of projects which will be constructed -as funds become available. The formation of a single district with an agreed priority list of projects will allow for the orderly and coordinated completion of infrastructure which will serve the regional needs of the Santa Clarita Valley. This, along with the authority of each jurisdiction to collect fees, and administer and construct district improvements within their respective jurisdictions allows both a coordinated and flexible approach to the operation of the District. A map. of the proposed district and a copy of the proposed Cooperative Agreement are attached for your reference. If the Council approves the Agreement, we will be bringing back for your consideration the district report for the Valencia District. We also will be submitting the Via Princessa District report which does not include any County area. These reports, if approved, will then encompass all of the City within at least one of the Bridge and Major Thoroughfare Districts. ATTACHMENTS Map Agreement 0 0 14 / �) III � � � • _ 1�., A �OOAT CAN'f s .� II ��/ � � r\ Rou(E 12b ��, �� CITy LIMITS A VALENCIA BRIDGE AND MAJOR THOROUGHFARE COOPERATIVE AGREEMENT THIS AGREEMENT, is made this day of , 1989, by and between the COUNTY OF LOS ANGELES, herein termed "COUNTY", a political subdivision of the State of California, and the CITY OF SANTA CLARITA, herein termed "CITY", a municipal corporation in the County of Los Angeles: W I T N E S S E T H WHEREAS, in certain unincorporated areas of Los Angeles County and areas in the City of Santa Clarita, there is a need, caused by anticipated private deve- lopment, to improve existing roadways and/or develop additional public highways for proper traffic circulation; and WHEREAS, there is a need to finance these additional roadway facilities; and WHEREAS, new development is willing to be assessed for its proportionate share of public roadway facility costs; and 0 WHEREAS, an equitable and reasonable funding mechanism has been determined to be the formation of a Bridge and Major Thoroughfare Construction Fee District; and WHEREAS, one of these areas is the Valencia area of the Santa Clarita Valley; and WHEREAS, a portion of the Valencia area is in the unincorporated area of County and the remaining area is in CITY; and WHEREAS, formation of a single Bridge and Major Thoroughfare Construction Fee District for the entire Valencia area is in the mutual interest of COUNTY and CITY in that it will allow for the orderly and coordinated completion of infrastructure which will serve regional needs; and WHEREAS, pursuant to the authority contained in Section 21.32.200 and 22.48.235 of the Los Angeles County Code and the Santa Clarita City Code and Section 66484 of the State of California Government Code, COUNTY (1) and CITY desire to establish the VALENCIA BRIDGE AND MAJOR THOROUGHFARE CONSTRUCTION FEE DISTRICT, hereinafter referred to as "DISTRICT"; and WHEREAS, DISTRICT will provide for the improvement of a number of spe- cific projects to be financed with DISTRICT fees, hereinafter referred to as "DISTRICT IMPROVEMENTS". NOW, THEREFORE, in consideration of the covenants and conditions herein contained it is agreed as follows: (1) COUNTY AGREES: a. To prepare a DISTRICT report, either with its own staff or by a contract with a private consultant. b. To provide any funds necessary to finance preformation costs. c. To set up and administer an interest earning account for fees collected by DISTRICT in COUNTY jurisdiction. d. To prepare or have prepared plans, specifications and cost estimates, acquire the necessary right of way and to do all other things necessary to construct DISTRICT IMPROVEMENTS within COUNTY jurisdiction. e. To maintain in good condition the completed DISTRICT IMPROVEMENTS that are within COUNTY's jurisdiction at COUNTY expense. (2) CITY AGREES: a. To set up and administer an interest earning account for fees collected by the DISTRICT in CITY jurisdiction. b. To prepare or have prepared plans, specifications and cost estimates, acquire the necessary right of way and all other things necessary to construct DISTRICT IMPROVEMENTS within CITY jurisdiction. c. To maintain in good condition the completed DISTRICT IMPROVEMENTS that are within CITY's jurisdiction at CITY expense. (2) • (3) (3) IT IS MUTUALLY AGREED BETWEEN COUNTY AND CITY: a. That CITY and COUNTY will work cooperatively together on all DISTRICT matters and will take all necessary steps to formally create DISTRICT and establish DISTRICT fees within their respective jurisdictional boundaries. b. Upon adoption.of DISTRICT by CITY and COUNTY, COUNTY will be reimbursed by DISTRICT for any preformation costs incurred by COUNTY. c. CITY or COUNTY may allocate DISTRICT funds collected within its jurisdiction to improve DISTRICT projects in other jurisdictions. d. That costs associated with DISTRICT IMPROVEMENTS are to be financed with DISTRICT fees collected by COUNTY and CITY. e. CITY and COUNTY will work together to identify the highest priority projects in.order to move them to construction at the earliest possible time as funds become available. • (3) C IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by their respective officers.
