HomeMy WebLinkAbout1990-05-08 - RESOLUTIONS - STORMDRN IMPROV DRAINS 1946-47 (2)RESOLUTION NO. 90-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS KNOWN AS PRIVATE DRAIN NO. 1946 AND 1947 IN THE CITY OF SANTA CLARITA FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF. WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage systems known as Private Drain Nos. 1946 and 1947, described in Exhibit A attached hereto; and WHEREAS, the City is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS, the City and the Los Angeles County Flood Control District entered into an agreement dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage systems described in Exhibit A attached hereto from the City to the Los Angeles County Flood Control District for future operation, maintenance, repair, and improvement. NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage systems described in said Exhibit A. BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights-of-way for said drain now vested in the City and all other necessary rights-of-way therefore have been conveyed to and accepted by District. Reference is hereby made to District Drawings Nos. 337-F131.1-.11 and 337-F129.1-.7, the plans and profile of said storm drain improvements and drainage systems on file in the office of the City Engineer, and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage systems. BE IT FURTHER RESOLVED that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles. Such warranties by the City are incorporated here by this reference. The City Clerk shall certify to the adoption:.of this Resolution. Lateral "Z-1" Commencing from a manhole structure per line "Z", Station 21 + 17.17 (Station 1 + 00, Lateral "24"), located within a 10 foot wide easement for storm drain and storm drain ingress and egress purposes; thence southerly and southwesterly in last said mentioned easement to a catch basin located within Magic Mountain Parkway, street Station 65 + 00 (Station 3 + 79.83, Lateral "Z-1 "), a distance of 280 feet, more or less. Line "G" Commencing from the end of an existing storm drain line, Station 2 + 11.27, per P. D. 1947, which lies within Newhall Avenue southeast of Creekside Road; thence southeasterly and southerly within Newhall Avenue to a variable width easement for storm drain and storm drain ingress and egress purposes; thence southeasterly within last said mentioned easement to Magic Mountain Parkway; thence easterly within Magic Mountain Parkway to a brick and mortar end of pipe plug, Station 15 + 90.24, a distance of 1,379 feet, more or less. Lateral "G-1" A connector pipe from Line "G" to a catch basin within Magic Mountain Parkway. Line "D" Commencing from an earthen trap channel, Station 0 + 38.00 per D.S. 437, which lies west of McBean Parkway and approximately 540 feet northerly of Creekside Road; thence easterly to a catch basin, Station 1 + 18.00, which lies within McBean Parkway; thence tying into an existing R.C.P. per DS 437, Station 1 + 60.00; thence easterly to a catch basin, Station 2 + 02.00, a distance of 122 feet, more or less. Lateral "A-6" Commencing from an existing storm drain, per Drawing No. 2-D 108 Lateral "A-2", Station 2 + 36.58 (Station 1 + 13.87, Lateral "A-6"); thence southeasterly within a variable width easement for storm drain and storm drain ingress and egress purposes, to a series of catch basins within Magic Mountain Parkway. Laterals "E-1", "E-2", "E-4" Catch basins from existing connector pipes per respective laterals of P. D. 1947 Lateral "E-3" Catch basin and connector pipe from existing connector pipe per Lateral T-3" of P. D. 1947. All as shown on District Drawing Nos 337-F131. bough 337-F131. 11 EXHIBIT "A" Private Drain No. 1947 A reinforced concrete pipe storm drain system and appurtenant structures for Tract Map No. 41960 filed in Book 1063, pages 80 to 83 inclusive, of Maps, Records of the County of Los Angeles, generally described as follows: Line "E" Commencing from an existing R.C.P. storm drain per D. S. 437, Station 3 + 32.00 which lies within City right-of-way (McBean Parkway); thence easterly to an 84 foot wide easement for storm drain and storm drain ingress and egress purposes; thence easterly and southeasterly within said easement to the western boundary of Tract 41960, Station 17 + 13.86; thence southeasterly within City right-of-way (Creekside Road) to a series of catch basins located southeast of the intersection of Newhall Avenue and Creekside Road, a distance of 1,796 feet more or less. Laterals "E -I", "E-3" Connector pipes from Line "E" to temporary inlet structures not being maintained by L.A.C.F.C.D. Laterals "E-2", "E-4", "E-9" Connector pipes from Line "E" stubbed out for future inlet structures or catch basins. Laterals "E-5", "E-6", "E-8" Connector pipes from Line "E" to a series of catch basins.
