HomeMy WebLinkAbout1991-02-12 - AGENDA REPORTS - ANNEX 1988-02 WRITTEN PROTEST (2)AGENDA REPORT City Manager Approval: Item to be presented by: Lynn M. Harris PUBLIC HEARING DATE: February 12, 1991 SUBJECT: Annexation No. 1988-02, Resolution Making Findings On Written Protest and Approving & Ordering Annexation 1988-02 DEPARTMENT: Community Development BACKGROUND Annexation No. 1988-02 is a proposal to annex approximately 202.3 acres of uninhabited land to the City of Santa Clarita for the proposed development of 299 single-family residential units. The site is located in the Sand Canyon area, generally south of the Santa Clarita River and east of Oak Springs Canyon Road. The property abuts the City to the east and south. Annexation is requested by the property owner (American Beauty Homes, Inc.), who cites a desire for City services and local government permit processing. The City's cost to provide municipal services to this area would be offset for the forseeable future due to revenues from increased property valuation, building permit fees, and other development fees. There are no known persons, agencies or organizations opposed to this proposal. The proposal is for a resolution be adopted by the City Council to approve and order Annexation No. 1988-02. The resolution states the direction given to Council by the LAFCO to proceed with a duly noticed public hearing, and sets forth the reasons for the annexation, terms and conditions established for the annexation by the LAFCO, exhibits identifying the site, and other required recitals. The resolution represents the final action to be taken by the City Council to complete Annexation No. 1988-02; upon adoption, the resolution will be forwarded to the LAFCO for review and certification, and the annexation will be recorded with the State Board of Equalization within 15-25 days. The date of recordation typically serves as the effective date of completion of annexation proceedings. Because Annexation No. 1988-02 is presently defined as "uninhabited," only property owners may protest. If owners of property who own less than 50 percent of the total assessed value of land in the affected area oppose Annexation No. 1988-02, the annexation can be approved by the City. Council. If the percentage of opposition protest is above 50%, the City Council must deny the annexation. Adopted: .-2 -,a - ct i Agenda Item: Previous actions taken by the City Council on Annexation No:,1988-02 include adoption of Resolution 89-145, initiating proceedings with the LAFCO, and Resolution 90-21, a joint resolution with the County of Los Angeles regarding property tax transfer. 1. Adopt Resolution No. 91-24 making findings regarding written protest. 2. If the hearing results in insufficient written protest and the annexation is approved, then direct staff to transmit Resolution No. 91-24 and and appropriate fees to the Local Agency Formation Commission for final review and certification.
