BACKGROUND
Staff has been pursuing the finalization of revised District reports for the
existing Bouquet Canyon and Route 126 Bridge and Major Thoroughfare
Construction Fee Districts (B & T) and to establish B & T Districts for the Via
Princessa and Valencia areas. These four districts will place all City areas
within one of the Districts. The County by agreement with the City is
preparing the Valencia District and has no scheduled date for completion. They
are also revising the fee rates for their portion of both the Bouquet Canyon
and Route 126 District. At this time, they are not committed to a specific
date to present the new rates to the Board of Supervisors.
Attached is a chart indicating the current fees, proposed County and City fees
for the two existing districts, and the proposed Via Princessa District rates.
The proposed City rates reflect Council's previous direction to provide four
lanes of paving rather than two as the County does. It does not include
medians as you previously directed because the City attorney has determined
that the enabling legislation does not allow medians to be included. - see
attached letter.
At first glance, you would expect the aity's fees to be double the County's to
account for the additional two lanes. However, since there are more buildable

units in the County portion of the district, their two lane cost is lower than
that within the City. Added to this the additional 'two lanes, again, assessed
against fewer City units, accounts for the exaggerated", difference between the
City and County fees.
The proposed rates reflect the expected housing, commercial, 'and industrial
property build out envisioned in the draft general plan. We also included all
annexed areas,, the widening of the Soledad Canyon Road bridge', and excluded the
portions of Whites Canyon Road already constructed.
The resulting information suggests that' it may be more prudent to form one
single B & T district that encompasses the entire City. It would result in one
B & T rate rather than several widely different ones. It would also allow the
use of B & T funds for any identified thoroughfares in the City rather than
being limited to construction in four specific areas. This would seem to fit
the pattern of roadway needs in the City where often times development in
specific areas affects roadway capacities in diverse areas of the City. , There
are some legal issues such as our agreement with the County to jointly
administer separate districts and the connection between fees and the benefits
received in widely separated areas.

Since the districts include adding two additional lanes of paving and an
increase in the feesi the City Attorney'has advised us that this action is no
longer categorically exempt as a project under the provisions of the California
Environmental Quality Act. Therefore, an environmental assessment will be
necessary to determine the environmental status, i.e. Negative Declaration or
Environmental Impact Report prior to setting a hearing.
In view of the substantial differences in rates between the City and County
Districts, there may be a tendency for development to occur in the County area
where the rates are more favorable. Unfortunately, the money collected in the
County would only build two lanes, and our discussion with them reflects that
they that they are firm on only constructing two lanes. This, coupled with the
fact that nearly all the traffic generated in the County passes through'the
City, would result in little reduction in traffic within the City and
potentially no roads to address the traffic. We bring this to the Council's
attention to describe what we foresee as a possible downside to the increased
fees.
In summary, we would like the Council's input on these comparison of new, old,
County and City rates. Based on the Council's direction P we will endeavor to
bring the Bouquet Canyon, Route 126, and Via Princessa District Reports in
final form at your February meeting to set a public hearing on the matter. We
would also suggest that the Council consider preparing its own Valencia
District Report to bring this district to a conclusion. We estimate the cost
of the report would be $35,000 and would be paid from existing B & T fees as a
loan to the District and would be repaid after the District is formed.
Alternatives for consideration are:
0 Forming one City-wide district.
Reevaluate the current boundaries between all three City Districts to
determine if modifying the boundaries would more closely represent the
connection between the fees established and the benefits to be received.
RECOMMENDATION
The Council consider the new B & T fees and provide direction to staff.
