SUBJECT: Second Reading Of Ordinance No. 91-22, An Ordinance
Amending the Santa Clarita Municipal Code Relating to
Building Permit Limitation

BACKGROUND
Ordinance No. 91-22 was introduced and passed to second reading at the
City Council meeting of April 9, 1991. As proposed, the. ordinance amends
the issuance of certain building permits from their current ministerial
status to discretionary actions subject to CEQA review, and implements
Resolution No. 91-50, adopted by the City Council on April 9, 1991.
RECOMMENDATION
Staff recommends to the City Council that it waive further reading and
adopt. Ordinance No. 91-22,, amending the Santa Clarita Municipal Code
relating to .building permit limitation.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, AMENDING THE SANTA
CLARITAMUNICIPAL CODE AT CHAPTER 18.04 OF TITLE
18 RELATING TO BUILDING PERMIT LIMITATIONS -
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. The Santa Clarita Municipal .Code is hereby amended at
Title 18 to add Chapter 18.04 to read as follows:
CHAPTER 18.04
BUILDING PERMIT LIMITATIONS
Section: 18.04.010 Building Permit Limitations
18.04.010 Building Permit Limitations. No building permit shall be
issued for any of the following:
1. single-family residential units when such development is in
conjunction with three -or more units;
2. multiple -family residences including apartments and condominiums
involving more than six residential units;
3. multiple -family residences including apartments and condominiums
involving two or more buildings, irrespective of the number of
units;
4. new commercial,, institutional and industrial structures
exceeding a floor area of 15,000 square feet;
5. new parking structures of one or more levels above grade;
6. additions to, existing structures exceeding a floor area of
15,000 square feet; and
7. tenant improvements which result in a change in land use or
result in,or perpetuate an unmet parking need;
unless the Planning Commission determines either:
a. That the project will not have 'a potential for a
significant effect on the environment; or

b. that the significant environment effect of the project
would either:
i. Be mitigated in a manner .approved .in a certified
environmental impact report, or
ii. are overridden by findings in accordance with
Sections 15091 - 15093 of the State CEQA Guidelines.
SECTION 2. The City Clerk. shall certify to the passage of this
ordinance and shall cause the same to be published as required by law.
