HomeMy WebLinkAbout1991-11-12 - AGENDA REPORTS - BUS BAY IMPROVEMENTS BID AWARD (2)7 AGENDA REPORT City Manager Item to be p CONSENT CALENDAR DATE: November 12, 1991 SUBJECT: VALENCIA BOULEVARD AT MAGIC MOUNTAIN PARKWAY (PROJECT 90-22) BUS BAY IMPROVEMENTS - BID AWARD Community Development BACKGROUND On September 24, 1991, Council authorized the advertisement of the subject project. The project consists of providing a bus turnout lane, curb, gutter and sidewalk improvements on the south side .of Valencia Boulevard north of Magic Mountain Parkway (shown on the attached location map). On October 15, 1991, the following bids were received by the City Clerk: Company Bid Amount E.C. Construction Co. $34,212.35 Padilla & Sons $35,415.23 Security Paving $38,677.33 Excel Paving Company $41,388.80 Grigolla & Sons Construction Co. $42,061.50 Nobest Incorporated $42,844.43 Kalban, Inc. $430405.51 Padilla Paving Co. $43,710.00 Mohammed Toutounchian $45,007.00 PLC Paving Corporation $47,401.89 B-1 Enterprise Co. $48,682.98 Damon Construction Co. $52,677.90 The Engineer's estimate for this project is $55,827. A total of $94,900 has been budgeted under Account No. 25-96031-227 for design, contract administration, inspection, and construction of this project. Staff recommends that the project be awarded to E.C. Construction Co., the low bidder. E.C. Construction Co. possesses the necessary State Contractor's license and is a member in good standing. This contractor has performed similar work for other cities, and the references indicated satisfactory performance. It should be noted that the E.C. Construction Co. bid contained the following irregularity: APPROVED Agenda Item: r 4 VALENCIA BOULEVARD AT MAGIC MOUNTAIN PARKWAY PROJECT 90-22 Page 2 Bidders were required to submit their proposal on bid forms included in the bid set. E.C. Construction Co. provided their bid bond on their Surety's form. However, E.C. Construction Co.'s Surety form contains the essential element of a bid bond which is to pay the City the difference between their bid and the next lowest bidder if they fail to enter into a contract. What we are assured of is that we get the construction for the lowest bid even if E.C. Construction does not do the work. Awarding the bid to E.C. Construction Co. is stili the best price for this project. The City Attorney's office is aware of this matter and has advised staff that the contract documents permit the City to waive this type of irregularity. RECOMMENDATION 1. Waive the aforementioned irregularity. 2. Award the contract to E.C.Construction in the amount of $34,212.35. ATTACHMENT Location map AGN/536 I: CITY.
