Proposals from firms to provide and maintain Transit Bus Shelters which would
display. revenue producing advertising, at no cost to the City, required
submittal of the proposals to the City Clerk by 11:00 a.m., April 30, 1991.
Copies of the Request for Proposals (RFP) were also mailed to the four bus
shelter companies located in the region. Shelter Vision, Target Media, Gannet
Transit company, and Bustop Shelters of California. Only Bustop Shelters of
California responded with a proposal but the company representative was delayed
reporting to the City and was unable to.. meet the 11:00 a.m. deadline.
Consequently, no response was received meeting the legal requirements.
The remaining three non—responding shelter companies were contacted to determine
the cause with the following results.
1. Shelter Vision: The company representative could not be reached and did
not attempt to contact this office.
2. Target media: The company representative stated that their base of
operations is too far away from Santa Clarita for them to offer service.
3. Gannet Transit Company: The Public Affairs Representative indicated that
the company objected to two provision of the RFP: Item III — page 5
regarding the five year term of the contract and the City's right to
acquire the shelters, and item L of attachment A requiring review of the
advertisement copy prior to placement in the shelters. Gannet would like
to be able to place the ads in the shelters without review and would remove
any ad which was found to be objectionable.
Public Contract Code Div. 2, Part 3, Article 4 Section 20166, states in part,
"If no bids are received, the legislative body may have the project done without
further complying with this part." Therefore, since no proposals were received,
the State allows the City to enter into negotiated bids. Staff would,
therefore, request authorization to proceed to have the bus shelters constructed
through a negotiated contract. It is felt that such a procedure would permit
moving quickly with various firms and a contract. The firm selected .and
suggested contract will be brought before the Council for consideration.
RECOMMENDATION
The City Council direct staff to enter into negotiations with bus stopshelter
providers and return with a recommendation and suggested contract. 40
