John E. Medina On February 26, 1991, the Council adopted Resolution No. 91-21, establishing the City's intention to construct a Commuter Rail Station by applying for funding. Staff was directed to focus on the "Bermite Property" as the primary location, with the "Glazer Property" as the alternate; unless other alternate sites proved to be more advantageous. Meetings with the Whittaker Corporation, owners of the Bermite Property, and representatives from the Los Angeles County Transportation Commission, are resulting in a workable design at the Bermite site. Additionally, an environmental study is in progress for this site. Initial meetings have been held with representatives of both the "Glazer" and the "Gates" properties. Both are still interested in the City's plans, but have yet to present staff with design concepts or funding proposals. An environmental study is also in progress for the Glazer site. The Whittaker Corporation has presented to staff a preliminary outline for an agreement, by which the City may lease and eventually acquire a portion of their property for the rail station site (see Attachment A). This agreement could eventually grant the land to the City, contingent.upon the City approving their development provided the development is acceptable to both the City and the developer. In the event the City cannot approve their development, condemnation of said land could happen at a reduced price. This .agreement would allow the City to build and operate a rail station for three years without the additional financial impact from land acquisition costs. Since the LACTC will finance the layover station, the projected cost of 5.6 million dollars to develop the rail station should be somewhat less, provided the property is donated. We feel that this agreement, as outlined, is a reasonable start in acquiring the station site. Staff also believes that a negotiated purchase, in the event the land could not be granted . to the City, would be more advantageous rather than acquisition through the condemnation process. Further meetings with the other site representatives will continue. Staff does point out, however, that due to the time constraints of environmental documentation and the LACTC start—up date, the window of opportunity for _other possible locations is quickly closing for first station site alternates �;�'�� Agenda Item:.:..�;�. RECOtM1ENDATIONS 1. City Council review the elements of the Bermite proposal, discuss any additional or unacceptable aspects of the proposal and direct staff to continue negotiating toward a final agreement with the Whittaker Corporation. 2. Continue focusing on the Glazer site as the prime alternate site, while leaving open the opportunity for other possible sites. ATTACHMENTS 1. Copy of a tentative site concept for the Bermite property station. /ce COMMUTER RAIL ACQUISITION AGREEMENT SUMMARY BERMITE SITE 1. Land lease phase of property, for station and parking. • Mutual agreed upon location. • Three year lease term, after commencement of rail service, late 1992. • Lease rate of'$1.00 per year. 2. The land for the station and parking will be donated to the City if Whittaker is able to obtain all required approvals for their development. 3. If Whittaker is .unable to attain the City's approval for their development. • They will provide us with an additional two year lease. • Lease rate will be 10% of the property's current appraised value. 4. Property condemnation -by the City. • City may condemn the property any time after the initial three year lease. • Compensation rate for the property will be 90% of the current value at the time. 5. Station relocation, if desired'by Whittaker. • New location would require approval by the City and the LACTC. • Whittaker would pay for all relocation costs.
