Harris rri nhhL4 PUBLIC HEARING DATE: November 26, 1991 SUBJECT: Appeal of the Planning Commission's denial of Conditional Use Permit 91-005. The project site is located at _27009 Sand Canyon Road. APPLICANT: Veterans of Foreign Wars.Post 6885 DEPARTMENT: Community Development BACKGROUND At the September 3, 1991 meeting, the Planning Commission adopted Resolution P91-44,- formally denying Conditional Use Permit 91-005. The - applicant proposes a conditional use permit to allow for the continued use of an existing meeting and assembly hall with appurtenant facilities. (VFW Post) in an A-1-2 (Light Agriculture, minimum required area two acres) zone. The property consists of approximately 2.19 gross acres and fronts on Sand Canyon Road. The applicant presently operates a Veterans of Foreign Wars post at the above referenced location. The use has been in operation for approximately 20-24 years. The post is currently operating illegally without benefit of a permit. Staff has attached a memorandum from Richard Henderson, Principal Planner to Lynn M. Harris, Director of Community Development, listing a summarized chronology of events related to the activities of the VFW from the commencement of the use to present day. In addition, staff has attached a memo from the Sheriff's Department to the City Manager related to a research of calls for service for the VFW Post #6885. The site is presently developed with the following: 1) Two-story main building (includes the bar and restrooms) 2) Outdoor canteen (includes outdoor patio, covered patio, and adjacent restrooms) 3) Recreation area (includes horeshoe area), located off-site within the existing Sand Canyon Road right-of-way. 4) Unimproved.parking area ContinuedJo;� 9� Ag nd� item: PSI Existing on-site are 12 oak trees, four of which are located within the unimproved. parking lot. Approximately 56 parking spaces could. be implemented within the lot. Sultus Street presently crosses the southern portion of the property. The site is relatively flat and lies within a' flood hazard zone. Access to the site is from Sultus Street. The existing method of sewage disposal on-site is septic. The applicant has not indicated hours of operation for the use nor the proposed maximum occupancy expected at any one time. The project was determined to .be exempt, pursuant to the California Environmental Quality Act, Section 15261, due to the operation of existing facilities. During the review of this project, the Planning Commission received five letters of opposition to the project. Three of these letters were from organizations such as the Sand Canyon Homeowners Association, Sand Canyon Land Use Committee, and the Crystal Springs Homeowners Association. These letters cited concerns with the use and its incompatibility with adjacent residential uses. The Planning Commission received five letters supporting the project. Additional support of the project was submitted in the form of a petition. A total of 620 signatures were included within this petition. ANALYSIS The project site fronts on Sand Canyon Road. The surrounding land uses are as follows: single family residential (north), single family residential and a church (east), single family residential (south), and single family residential (west). The project site is within an area designated as Residential Estate (RE). This designation is.intended for large lot, detached single family homes that maintain the rural character of the area. Generally, an assembly use could be found to be consistent with the General Plan if the use serves the immediate area and does not create undue noise or nuisance. In order for the Planning Commission to approve a conditional use permit, the applicant must substantiate four findings. The Planning Commission determined that the project did not meet two of the required four findings. These findings are as follows: 1) That the proposed use will not be in substantial conflict with the adopted general plan for the area. The Commission determined that the project was not consistent with the type of development prescribed by the land use designation of Residential Estate (RE), due to the incompatibility of the project with adjacent residential uses. Though explicitly not a commercial use, the project could be comparable due to the inclusion of a bar and food service facilities within the facility and the renting of the facility for private parties. 2) The requested use at .the location will not adversely affect the health, peace, comfort or. welfare of persons residing or working in - 1 - the surrounding area; be materially detrimental to the use, enjoyment or valuation of property of other persons located in the vicinity of the site; jeopardize, endanger or otherwise constitute a menace to the public health, safety or general welfare. The Commission determined that the use has caused undue noise and nuisance impacts upon adjacent residential uses as indicated by filed complaints, written correspondence, and public testimony. The Commission determined that the existing main structure is not presently constructed to accommodate the existing and operating use. The Commission determined that the noise impacts associated with the project are not compatible with residential uses. The Commission denied the conditional use permit with the understanding that a 90 day "stay" of code enforcement is being implemented on the use. At the termination of this 90 day "stay", all use of the facility as a Veterans of Foreign Wars Hall shall cease. The applicant in appealing the Commission's decision suspended this determination of the Commission. At the direction. of the Council, staff has recently met with representatives of the surrounding homeowners and representatives of the V.F.W. Post. The committee representing the homeowners expressed a willingness to support a maximum six-month period during which the VFW could continue to operate at the present location,. while finding a suitable location to move to. The committee indicated that they would only support this additional time if the serving of alcohol cease immediately. The final meeting between the two groups did not result in any significant agreement concerning the continued operation of.the VFW. Councilwoman Heidt has formally requested that this item be continued to the next regularly scheduled Council meeting. RECOMMENDATION Uphold the Planning Commission's denial of Conditional Use Permit 91-005, and direct staff to return to the Council with a resolution of denial. P91-44 A RESOLUTION OF -THE PLANNING COMMISSION OF THE CITY OF SANTA.CLARITA, DENYING MASTER CASE NO. 91-066 CONDITIONAL USE PERMIT 91-005 TO ALLOW FOR THE CONTINUED USE OF AN ASSEMBLY AND MEETING HALL (PRIVATE RECREATIONAL CLUB) AT 27009 SAND CANYON ROAD THE PLANNING COMMISSION OF' THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission does hereby make the following findings of fact: a. A complaint was filed against the VFW Post 6885, the subject project, with the City's Code Enforcement Department on September 17, 1990., The complainant indicated that the use was causing loud noise, public drunkenness, and trash problems. b. After the review of existing documentation available on the use and structure it was determined by.staff that the existing main building was not constructed to required building standards for a meeting or occupancy use. An inspection conducted by affected agencies indicated the structure required 18 building and fire code corrections to accommodate the assembly and meeting use. Staff also determined that the use was operating illegally without benefit of an approved conditional use permit. C. The City's Code Enforcement Division informed the applicant of the required building and fire code corrections and also informed the Deputy District Attorney of violated code sections of the City's Municipal Code. These sections are as follows: 1). 22.24.100 -Use subject to conditional use permit approval 2) 22.60.330 - General Prohibition 3) 22.60.340 - Violation declared misdemeanor 4) 22.60.350 - Public Nuisance d. An application for a conditional use permit was filed with the City of Santa Clarita by the Veterans of Foreign Wars Post 6885 (the "applicant') on April 30, 1991. The property for which this application has been filed is located at 27009 Sand, Canyon Road. (Assessor Parcel Number 2841-024-008, a legal description of which is on file in the Department of Community Development.) e. The applicant is requesting a conditional use -permit to allow for the continued use of an existing meeting and assembly hall with appurtenant facilities (private recreational club) in an A-1-2 zone (Light Agriculture - 2 acre required area). The parcel consists of 2.19 acres. Conditional Use Permit 91-005 Resolution No. P91-44 f. The site is presently developed with the following: 1) Two story main building (includes a bar, food service, and restrooms) 2) Outdoor canteen (includes outdoor patio, covered patio, and restrooms) 3) Recreation area 4) Unimproved parking area which consists of an area sufficient to accommodate approximately 56 parking spaces g. The subject parcel is zoned A-1-2 (Light Agricultural - two acre required area). A private recreational club is permitted in this zone with the inclusion of an approved conditional use permit. The City's General Plan land use designation, for the project site is Residential Estate (RE). h. The site is relatively flat and improved. The vegetation on the site consists of native shrubs and 12 oak trees, four of which are within the unimproved parking lot. i. The surrounding land uses are: single family residential, Sand Canyon Road (to the north), Sultus Street, single family residential (to the south), single family residential, church (to the east), and single family residential (to the west). j. The application was circulated for City Department and agency review upon receipt. The application was deemed complete by the Community Development Department on June 3, 1991. A Development Review Committee (DRC) was conducted for the proposal. k. A duly noticed public hearing was held by the Planning Commission on August 20, 1991 at 7:00 P.M. The meeting was held at the City Council Chambers, 23920 Valencia Boulevard, Santa Clarita. SECTION 2. Based upon the above findings of fact, oral and written testimony and other evidence received at the public hearing held for the project, and upon studies and investigations made . by the Planning Commission and on its behalf, the Planning Commission further finds as follows: a. At.the hearing of August 20, 1991, the Planning Commission considered the staff report prepared for this project and received testimony on this proposal. 641 Conditional Use Permit 91-005 Resolution No. P91-44 b. The City's General Plan designation for the project site is Residential Estate (RE). The Residential Estate land use category is intended for large lot, detached single family homes that maintain the rural character of the area. An assembly use could be found to be consistent with the designation if it served the immediate vicinity and does not -create undue noise or nuisance upon adjacent residential uses. An assembly use that is not consistent with the above definition is not a reasonable use for the parcel. C. The 2.19 acre parcel is most suitable for development that is consistent with the City's General Plan and the permitted uses listed for the A-1-2 zone. d. The proposal cannot fully meet the required findings for the granting of a conditional use permit as listed in Santa Clarita Municipal Code Section 22.56.090, as follows: That the proposed use will not be in substantial conflict with the adopted general plan for the area. (The project as proposed, impacts the noise and land use elements of the .City's General Plan. Though explicitly not a commercial use, the project is comparable to one due to the inclusion of a bar and food service facilities within the facility and the renting of the facility for private parties. The noise and nuisance caused by this use is not consistent or compatible with surrounding residential uses. Land Use impacts have been cited in previous sections of the resolution). That the use requested will not adversely affect the health, comfort or welfare of persons residing or working in the surrounding area; be materially detrimental to the use, enjoyment or valuation of property of other persons located in the vicinity of the site; jeopardize, endanger or otherwise constitute a menace to the public health, safety or general welfare because: The use has caused undue noise and nuisance impacts upon adjacent residential uses as indicated by filed complaints, written correspondence, and public testimony. The existing main structure is not presently constructed to accommodate the existing and operating assembly use. The noise impacts associated with the project are not compatible with the adjacent residential uses. SECTION 3. Based upon the foregoing facts and findings, the Planning Commission hereby determines as follows: a. As proposed, the project does not substantiate all of the findings associated with approving a conditional use permit. -3- Conditional Use Permit 91-005 Resolution No. P91-44 b. As proposed, the project is not consistent with the City's General Plan. NOV, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Santa Clarita, California, as follows: The Planning Commission hereby denies Conditional Use Permit 91-005 with the understanding that a 90 day "stay" of code enforcement (from the date that this Resolution is adopted) is.being implemented on the use. At the termination of this 90 day "stay", all use of the facility as a Veterans of Foreign Wars Hall (private recreational club) shall cease. Director Harris introduced the item, a Conditional Use Permit to legalize the existing use of a meeting and assembly hall with facilities constituting a private recreational club in an A-1-2 zone. The applicant is the Veterans of Foreign Wars of the United States Post 6885. The following persons submitted last minute written testimony in opposition to the project: Letter dated August 19, from the president of Crystal Springs Ranch Homeowners Association representing 113 homeowners; letter dated August 20, from Louis and Rita Garasi, 26737 Gwenalda Lane; and a letter from Robert and Lynn Stevenson, 15349 Iran Canyon. Assistant Planner Glenn Adamick gave the staff report and slide presentation. Chairman Cherrington opened the public hearing at 7:45 p.m.. The following persons spoke in -favor of the project: Mr. Skip E. Johnson, Commander of VFW Post 6885, 28504 Sand Canyon Road, Sand Canyon. Mr. Johnson spoke in favor of the VFW Post. Mrs..Judy Johnson, President of the Women's Auxiliary of the VFW, 28504 Sand Canyon Road,' 197, Sand Canyon. Mrs. Johnson outlined the.present activities the VFW is conducting.with the welcoming home of Desert Storm troops. Mr. Walter E. Anderson, 16424 Lost Canyon Road, Sand Canyon. Mr. Anderson outlined some of the activities of the VFW. Mrs. Dorothy. Mosely, 14102 Lanark Street, Panorama City. Mrs. Mosely spoke in favor of the VFW. Mrs. Mosely outlined some of the VFW's community activities._ Mr. Philip H. Shea, 27432 Dewdrop, Canyon Country. Mr. Shea offered some information to discredit various allegations against the VFW. Mr. Ambrose Emard, Quartermaster of VFW Post 6885, 22421 Barbacoa, Santa Clarita. Mr. Emard cited some of the positive actions the VFW has taken in the Sand Canyon area as a good neighbor. Mr. Emard also extended an invitation on behalf of the VFW to the local residents to open a positive line of communication. The following persons spoke in opposition to the project: Ms. Cathy Joens, 15716 Condor Ridge Road, Canyon Country. Ms. Joens spoke in opposition totheVFW citing loud parties. Mr. Jim Anderson, 15618 Saddleback Road, Canyon. Country. Mr. Anderson spoke in opposition. to the VFW; and on behalf of the -Sand Canyon Homeowners's Association and as a homeowner. Mr. William Hunt, 27019 Tannahill, Canyon Country. Mr. Hunt would like to see the VFW brought within compliance of the zoning codes. Ms. Claudia Hunt, 27019Tannahill, Canyon Country. Ms. Hunt spoke in opposition with relation to the noise, drinking in public, and other nuisances. Mr. Marty Kovacs, 26615 N. Mountain Park Road, Canyon Country. Mr. Kovacs gave testimony regarding the.loud noise, and various other alleged violations. Mr. Richard H. Christensen, 26915,,Tannahill, Canyon Country. Mr. Christensen stated his opposition to.the VFW operating illegally within the.zone. Ms. Catharine Chiurazzi, 16047 Comet Way, Canyon Country. Ms. Chiurazzi spoke on behalf of the Comet Way Homeowner's Association in opposition to the VFW citing the hall's inconsistency with the City's General Plan. COMMISSION RECESS A repess was called at 8:16 p.m. by Chairman Cherrington. COMMISSION RECONVENES Chairman Cherrington called the meeting back to order at 8:20 p.m.. ITEM 2 - Continued Mr. Warren K. Johnson, 26534 Oak Crossing Road; Santa Clarita. Mr. Johnson gave the rebuttal to the various allegations on behalf of the VFW. Following the public testimony, a Commission discussion ensued with questions asked of -the applicant relating to outstanding. code violations, and the possible curtailment of offensive late night, loud activities. Commissioner Modugno raised numerous questions of. staff related to the neighbors' complaints and'Sheriff's records. Chairman Cherrington closed the public hearing at 8:52 p..m.. The Commission opened their discussion and outlined the possible courses of action available to the Commission. The Commission discussed the VFW's inconsistency with the City's General Plan due to the operating of a public meeting facility, and the meeting facility not being a reasonable use in a residential neighborhood. Commissioner Modugno motioned for the denial of Conditional Use Permit 91-005 as proposed, to direct staff to return to the next scheduled meeting with a resolution of denial which includes a provision for continued operation for a period up to 90 days (after adoption of said resolution), with no other conditions, limitations or extensions; Vice -Chairman 'Woodrow seconded the motion, and the motion for denial was -.carried by a vote of 4-1 with Commissioner Brathwaite opposed. Harris, Director of Community Devel ilt CASE PLANNER: Glenn Adamick, Assistant Planner II APPLICANT: Veterans of Foreign Wars (VFW) of the United States Post 6885 LOCATION: 27009 Sand Canyon Road; Santa Clarita REgUEST: A conditional use permit to allow for the continued use of an existing meeting and assembly hall with appurtenant facilities (private recreational club) in an A-1-2 zone. BACKGROUND The applicant is presently operating a Veterans of Foreign Wars meeting hall at the above referenced location. The use has been in operation for approximately 24 years. The meeting hall use is currently operating illegally without benefit of a permit. On February 16, 1971, an occupancy inspection permit was taken out.fora VFW meeting hall to be used for dancing and meeting activities. The permit was cancelled by the L.A. County building inspector with the accompanying comment 'Not approved for use as a meeting hall, corrections too costly February, 1971.' Approvals on file indicate the following: The site was approved on December 4, 1957 for a trout farm with the appurtenant facilities being a club house, merry-go-round, swimming pool, and picnic facilities. The main building was constructed previously, and not to assembly or commercial standards. An oak tree permit exemption (89-044) was issued by the City's Oak Tree Consultant and.Senior Code Enforcement Officer for the removal of an oak tree that had fallen in November, 1989. A complaint was filed against the VFW post with the City's Code Enforcement Division on September 17, 1990. The complainant indicated that the use was causing loud noise, public drunkenness, and trash problems due to weekend parties. Code Enforcement Officers inspected the site and indicated the code violations to the applicant in a written letter. Agenda Item: 2 An inspection was conducted on January 9, 1991, at the VFW Post by representatives of the City's Building and Safety Division, Code Enforcement Division, Los Angeles County Fire Prevention, and two members of the VFV Post. This inspection was needed to determine the necessary building and fire code corrections that would enable the applicant to obtain proper permits for the use and structure. There was a total of 18 corrections that would be required. These corrections are listed in an attached memorandum. As indicated by the above required corrections, the building is not safe in relation to its present use. On March 7. 1991, the City's Senior Code Enforcement Officer Vytautas Adomaitis sent a letter to Michael Noyes, Deputy District Attorney, outlining the code violations. The code sections violated are summarized below: 22.24.100 - Use subject to conditional use permit approval 22.60.330 - General Prohibition 22.60.340 - Violation declared misdemeanor 22.60.350 - Public Nuisance The applicant submitted a conditional use permit application on April 30, 1991, indicating that the above mentioned corrections and violations will be corrected upon a granting of a conditional use permit for the use. The City has allowed the use to continue while processing the conditional use permit application on the advise of the District Attorney. PROJECT DESCRIPTION: The proposal is to allow a private recreation club in an A-1-2 zone. The site is presently developed with the following: 1) Two story main building (includes the.bar and restrooms) 2) Outdoor `canteen (includes outdoor patio, covered patio, and adjacent restrooms) 3) Recreation area (includes horseshoe area, teeter totters, and merry-go-round), located off-site within the existing Sand Canyon Road right-of-way. 4) Unimproved parking area which consists of 39 standard parking spaces, 13 compact spaces, and 4 handicapped spaces totaling 56 parking spaces. Existing on-site are 12 oak trees, four of which are located within the unimproved parking lot. The parcel consists of 2.19 gross acres and lies adjacent to Sand Canyon Road. To the south lies Sultue Street, which is presently a private and future street. The site is relatively flat and lies within the flood hazard zone AO depth 3, which indicates a flood hazard zone with an average inundation of three (3) feet. Access to the site is from Sultus Street, which is presently unimproved. The existing method of sewage disposal is a private on-site system (septic tank). -2- 7 The applicant is not indicating hours of operation for the: use nor the proposed maximum occupancy expected at any one time. The usage of the facility would be for members and guests and on occasion the facility is rented for private groups and parties. GENERAL PLAN CONSISTENCY: The City's General Plan designation for the project's area is Residential Estate (RE). The RE designation is intended for large lot, detached single family homes that. maintain the rural character of the area. Generally; an assembly use. could be found to be consistent with the General Plan, if the use serves the immediate vicinity and does not create undue noise or nuisance. SURROUNDING LAND USE/ZONING: The zoning for the site is A-1-2 (Light Agriculture -2 acre required area). A conditional use permit is required to allow a private recreation club within this zoning designation. INTER DEPARTMENT/AGENCY. REVIEW: The project has been distributed to the affected City Departments and agencies. If an approval of the project is considered, the affected groups recommend.the Commission require conditions as summarized in attachment "A". . ANALYSIS: The project site is surrounded by residential uses and lies on the northwest corner of Sultus Street and Sand Canyon Road. Sand Canyon Road is designated as a major highway by the City's General Plan (104' in width). The Sand S--0 9 Canyon floodway lies approximately 250' to the west of the site. The Engineering Division is indicating.. the floodway limit lines were drawn assuming an improved channel.. Sand Canyon wash is presently unimproved. As indicated previously, an assembly use is generally consistent with the City's General Plan land use designation of Residential Estate (RE), if it. serves the immediate area and does not create undue noise or nuisance upon the surrounding properties. This assembly use attracts persons from outside of the immediate vicinity, due to the nature of the use (V.F.W. post) and the renting of the facility for private parties. In addition, the Sand Canyon Homeowners Association and adjacent residents have commented to staff regarding the project. The residents have indicated that they are not supportive of the project and will testify at the hearing. They believe the use is incompatible with the residential neighborhood and that they have not received.cooperation from.the V.F.W. in resolving their concerns. After review of.the Noise Element of the General Plan, staff would like to bring forth specific. policies that may impact this proposal. They are as follows: 1) Goal 4, Policy 4.1 - Develop, adopt, and enforce a standard for all commercial uses which cause adverse levels of significant discernible noise on adjacent residential neighborhoods. (Though not explicitly a commercial use, the project is comparable to a service oriented commercial use due to the inclusion of a bar and food service within the facility and the.renting of the facility for private parties.) 2) Goal 4, Policy 4.3 - Establish standards for the control of noise from commercial and entertainment establishments when adjacent to residential land uses. (This project, as indicated by adjacent property owners, causes excessive noise which impacts a rural residential neighborhood.) Staff has received one written complaint and additional phone calls from others in the immediate area supporting the complaint. If approved, staff believes the hours of operation for the use should be controlled and monitored and private parties exceeding 100 persons be required to submit a Temporary Use Permit application. The granting of this application would be at the discretion of the Director of Community Development. This would allow staff the opportunity to evaluate the individual proposals and the compatibility with the surrounding area. The project consists of 56 parking spaces which would allow for a project site maximum occupancy of. 168 persons. The present parking layout would. be significantly impacted by the Sand Canyon Road future right-of-way, setback requirements, and improvement of the lot. The existing layout would need to be modified to accommodate the above referenced number of existing spaces. The parking lot is presently unimproved. The Santa Clarita Municipal Code Section 22.52.1060 requires the lot be paved to present City standards. According to Santa Clarita Municipal Code Section 22.56.090, the applicant must substantiate four findings that are associated with the granting of a conditional use permit. Staff believes the applicant has failed to substantiate two of the four findings. They are as follows: -4- 4 1) That ,the proposed use will not be in substantial conflict with the adopted general plan for the area. (The project, as indicated previously within the staff report, impacts the land use and noise elements of the general plan.) 2) That the -requested use at the location proposed will not: A) Adversely affect the health, peace, comfort, or welfare of persons residing or working in the surrounding area, or B) Be materially. detrimental to the use, enjoyment or valuation of property of other persons located in the vicinity of the site, or C) Jeopardize, endanger or otherwise constitute a menace to public health, safety, or general welfare. Staff believes the project does adversely affect the sections cited above. Cited within the staff report is the complaint by an adjacent property owner, and support of the complaint (by other adjacent property owners) related to the use. The adjacent property owners have expressed their concerns regarding the negative impacts of the project and .its effects upon them. If approval of the project is considered, staff believes the requirements cited within the attached summarized conditions of approval should be implemented upon the project. RECOMMENDATION It is the opinion of staff that the applicant has not or cannot satisfy the findings and requirements associated with the conditional use permit for' this project; and therefore, staff recommends the Planning Commission: Deny Conditional Use Permit 91-005 as proposed, and that the Planning Commission direct all use of the building unsafe for these occupancies cease immediately. The permit was cancelled by the L.A. County Building Inspector with the accompanying comment, "Not approved for use as a meeting hall, corrections too costly, February, 1971." 3) March 25, 1971 - Zoning enforcement letter was sent to the VFW stating that the post was not permitted as it was changing use from a private club to a fraternal organization. 4) August 16, 1971 - A complaint was received indicating that a trailer was being used as living quarters. 5) September 30, 1971 - The trailer was removed, thereby suspending enforcement. 6) December 17, 1971 A complaint was received again regarding a trailer being used as living quarters. 7) January 19, 1972 - The trailer was removed,. thereby suspending enforcement. 8) November 8, 1974 - Lloyds Bank, executors for the .estate of the previous owner, requested affirmation of the legal nonconforming status of the property. 9) November 26, 1974 - A letter, from Regional Planning, was sent to Lloyds Bank reaffirming Zoning Enforcement's position that the VFW post is not permitted in an A-1 zone. 10) December 27, 1974 - Lloyds Bank, contended by letter, that the history of the property should make the use legal nonconforming. 11) February 7, 1975 Lloyds Bank was again advised that the VFW is not permitted in the zone. 12) August 6, 1975 - Based upon a complaint, Lloyds Bank and the VFW were sent a letter giving them 30 days to comply. 13) August 28, 1975 - The VFW was advised to file a zone change and given until November 1, 1975 to do so. 14) November 14, 1975 - The matter was referred- to the District Attorney's office. 15) November 26, 1975 The scheduled conference was not attended by the VFW or Lloyds Bank. 16) January 15, 1976 - The District Attorney's office granted a time extension to February 15, 1976. 17) February 20, 1976 - The VFW indicated that they could not file for a zone change until probate proceedings were completed. 18) November 26, 1976 - The matter was referred back to the District Attorney's.office. 19) December 21, 1976- The scheduled conference was not attended by the VFW or Lloyds Bank. The attorney representing the VFW called and indicated that probate proceedings were still not completed. 20) September 1, 1977 - The matter was referred back to the District Attorney's office. 21) October 21, 1977 - The VFW's attorney indicated that the probate proceedings were completed and the new owners were. Earl and Beatrice Cain.In addition, the attorney indicated that the Cain's planned to subdivide the property, and upon recordation, that the VFW plans to then apply for a zone change. 22) November 8, 1977 - A time extension. was. granted by the D.A.'s office to February 1, 1978 to file for a parcel map or zone change. 23) March 29, 1978 Parcel Map 8244 was conditionally approved. 24) September 5, 1978 - Parcel Map 8244 had not yet recorded so the item was referred back to the District Attorney's office. 25) April 27, 1979 - :District Attorney's office, indicates to Sand Canyon H.O.A. president Dennis Sherbel that the VFW is waiting for the recordation of the parcel map to take ownership of the property and file a conditional use permit. 26) September 7, 1990 - A complaint was filed with the City's Code Enforcement Section, indicating that the VFW is having loud parties and is a.general nuisance to the surrounding residents. 27) October 29, 1990 - A meeting between the VFW and the City was held. The VFW is informed to submit a conditional use permit application within 30 days. 28) November 30, 1990 - Upon a request of the VFW, a 30 day extension was granted. 29) January 18, 1991 - A field. inspection was performed on the site with the City's Building and Safety, Code Enforcement, and Engineering representatives attending. Los Angeles County Fire Department representatives were also in attendance. The meeting is to provide the VFW with an inspection of the property to determine the corrections required by the Municipal Code. 30) March 18, 1991 - A letter is sent to the VFW from the District Attorney's office outlining the charges against the VFW. 31) April 3, 1991 - A District Attorney conference resulted in the VFW being informed to submit a conditional use permit application. 32) April 30, 1991 - The VFW submitted their conditional use permit application. 33) August 20, 1991 - The Planning Commission denies Conditional Use Permit 91-005. 34) September 3, 1991 - The Planning Commission through the adoption of Resolution P91-44, formally denies the CUP. Rear stairway rail will need to be raised to 42 inches high. Both stairways will need to have the guard rails covered so that there is no opening greater than 6 inches. Initially let me point out that the VFW has existed in its location long before any of us, with a few minor exceptions, ever knew the Santa Clarita Valley ever existed. During its existence and apparently during the alleged noncompliance period, the very Sand Canyon Homeowners Association which is now complaining about its existence, utilized the facilities of the VFW for several years as its meeting hall. Likewise during the alleged noncompliance period, the Canyon Country Chamber of Commerce utilized the premises for Frontier Days. Further let me point out that I have had an opportunity to review certain police incident reports relating to the Sand Canyon area for the last several years. A view of such incident reports Indicate that none of the alcohol related traffic accidents or alcohol arrests in the Sand Canyon area could be attributed to visits to the VFW. Certainly members of the Sand Canyon Homeowners Association cannot make similar claims. A good portion of the alcohol related accidents and alcohol arrests are directly attributed to residents of the Sand Canyon area. Nextly although there is a large incidence of police responses to the VFW, most of which are self-fulfilling prophecies. As the neighbors have increasingly called the police, the police have increasingly come. That does not mean there is any untoward activity at the location for there have been few arrests attributable to such calls. The fact that the members of the Associations are attempting to harass the VFW by their repeated telephone calls to the Sheriff's Department ought not enure to the detriment of the VFW. Nextly, it is important to point out that the VFW is for bettei or for worse a landmark in the Santa Clarita Valley. None of the. complainers, with the exception of Paula Cox, lived in Santa Clarita prior to the VFW's existence. All of the people living in the Sultus area purchased with full knowledge that the VFW was there. October 3, 1991 Page 2 The VFW has attempted to be a good neighbor both with the generosity in providing rest facilities for the children of the Sultus area as they are waiting for school buses, the placement of the Sultus mail boxes on VFW property, permitting the Sultus residents to drive without easement across VFW property to access their property, etc. The VFW has contributed greatly to the community with respect to charitable events and otherwise. When the VFW purchased the property, they were advised that it was correctly zoned for a private club. In my view the ZEC in 1954 together with subsequent correspondence seem to indicate that in fact for many years the club had been operated without any ,shut down order. If nothing the doctrine of estoppel prohibits the closure presently. I would urge the City to recognize the rights of the VFW forthwith and to cease acting viscerally in response to disgruntled neighbors who have their own personal agendas. On a final note, in my view 2 members of the Council have conflicts of interest on the present issue. Although I highly respect these 2 individuals one of whom being my mentor inn Santa Clarita and the other a dear friend of my wife, on this particular Issue I believe they ought to be recused. These individuals are residents of Sand Canyon and, if Mr. Ostrom's assertions are correct that is that the Sand Canyon Homeowners Association of which he is President represents all the residents of the Canyon and whom apparently pay dues to this Association and have the ability to vote in the Association. It is in my view improper for 2 members of the City Council to sit and listen to the appeal when the major opponent of the VFW is the very Association of which they are voting members. Accordingly I would ask that Howard Ri12.k, McKeon and Jan Heidt recuse themselves from further deliberations yin the subject matter. Caine was the owner of the property now occupied by the VFW Poston Sand Canyon Road. A March 25, 1971 .letter from the County of Los Angeles to Montague Ticehurst of the VFW Clubhouse Committee states that the clubhouse for a fraternal organization is not permitted in zone A-1-2. 5. A January 9, 1975 memo of the code enforcement section to a division chief recites that the zone exception case had expired for nonuse. The memo states that the use was a legal private club until it was taken over by the VFW in 1971. The final sentence of that memo is as follows: "The fact that the property use has changed from a private club use (permitted) to a fraternal organization use (not permitted) nullified the legal nonconforming status the property would have enjoyed had it remained a private club." Further, the division chief wrote at the bottom of the memo, "I'm willing to go along with the above analysis and determination.') 6. When the City's General`Plan took effect, the.zoning,was changed to, RE to conform;to the luxury..residential estates'built numerously in Sand Canyon. Amidst all ':this affluence the V.F.W. post conducts its, . own veterans and community support programs-,and,"rents its facility to other groups or businesses for special -occasions... This commercial aspect is the irritant that provoked neighbors_ to. complain to the Sheriff's Dept. and the City. City Planners and code enforcers descended upon the Post and prepared the Planning Commission with a case for deniaYo-f the C.U.P.. 91-009 based on non-conformance with the new zoning.._. The Sand Canyon Homeowners Assoc. was also: well prepared with arguments against the right of the V.F.W. to be ,there. Explain that the unpleasant incidents in-the'past'occurred by renters events which are now';;rigidly controlled by -security guards and V.F.W. members. 2. Show that the Condor Homeowners Assoc. considers the V.F.W. a good neighbor. 3. Reveal the variety of,valuable community services V.F.W. members perform. I gave a 5,'minute rebuttal, touching -,some of theifollowing points ,- 1. The Grandfather Clause in civil law.entitles the'V.F W.'to'a C U.P. exemption.frotn the new.zoning. 'It provides :"ani"exception to a restriction that allows all those already doing something-,>tor'continue doing it.. even if they would be stopped by the new restriction." (Law Dictionary for non -lawyers) 2. The -General Planshould allow forathe.V.F.W. to exist or else phase out over a long period.of time if it'fs:disruptive to the dominant residential use. 3. The V.F.W. post should have been considered during G.P.A.C. sessions. Unlike the dominant business interests represented, non-profit organizations and the V.F.W., specifically, had no advocates. A Page two (Note - After I asserted that the General Plan is not complete or finished, Commission Chairman Cherrington insisted the G.P. was complete and finished. There may always be a need for amendments. Sometimes it may be to consider situations like that of the V.F.W. Then there are outright mistakes to remedy. The mistake of allowing over 200 house's to be built in the path of the most favorable of two possible alignments for Route 126 is a most obvious example. Another that was caught in time involves a significant future improvement to what some may consider a blighted part of the city. The City staff informally approved the S.C.V. Historical Society's Downtown Newhall Historic District concept a year ago. It was overlooked entirely by the planning staff until the Historical Society moved to include it in the General Plan.) 4. If progress and compatability of neighboring types requires changes in land use zoning, fair and equitable enforcement should be the standard. Shutting down the V.F.W. without compromise or compassion to remedy neighbors complaints is: discriminatory. 5. As for the V.F.W. site being non -conforming in an RE zone, let me draw your attention to another area of the city, Placerita Canyon from Sierra HIghway to 13th St. Think about the non -conformity of these luxury homes with their neighbors: oil fields, three co -generation plants, The Masters College, the Country School, the Melody Ranch movie lots, and commercial entities. How is this area zoned? How do all these non -conforming entities co -exist within General Plan zoning? (Note - The Co -generation plants paid about half a million dollars to the Placerita Homeowners Assoc. to muzzle their complaints. The V.F.W. cannot afford the same arrangement, nor should they submit to it. The Y.F.W. Was there first, quite the opposite of the co -generation plants.) The answers to the above questions involve C.U.P.s.for the non -conformers. Are the same considerations being given the V.F.W. that were applied to those in Placerita Canyon? The planning Dept. should answer these questions completely. If the V.F.W. is not being given equal opportunity for a C.U.P. then this is a case of discrimination. I urgently request that the City Council conduct an inquiry into this matter. The V.F.W. will appeal the Planning Commission's ruling, and rightly so. I have submitted this letter to encourage a more thorough analysis and thus a fair treatment to a valued organization that serves the community as well as veterans. Some may have a view that the V.F.W. should simply sell its valuable property and relocate. The V.F.W.'s rights are at issue here; not whether they can afford to be shut down and moved out. I attended your Planning Commissions public hearing meeting held on August 20, 1991. The documentation presented by the homeowners was in the form of charges. Some of these charges may have dated back months, when these homeowners didn't reside where they do today. These homeowners testified to the effect that they were present; and physically observed these charges, many of which hasn't been verified by the Sheriffs Department or the A.B.0 and remain just hearsay, but became the main issue. At this same public hearing meeting, the assistant to Principal Planner Rich Henderson, stated that a request was sent to the Sheriffs Department, regarding 1191-005. It was returned stating No Comments. Further verbal communication also resulted in No Comments, as stated by Mr. Hendersons assistant. Mr. Hendersons assistant further stated that the California Alcohol Beverage Control, (ABC), was contacted and their reply was that V.F.W. Post 6885 has a licgnse to operate with no restrictions and no violations noted. Let me quote your Commissioner, Pat Modugno, from the L.A. Times, August 21, 1991. "WITH 20 YEARS OF INCOMPATIBILITY, GIVING THE V.F.W. AND THE NEIGHBORS SIX MONTHS OR A YEAR' TO WORK THINGS OUT ISN'T GOING TO MAKE ANY DIFFERENCE." Please let me ask you this. Where was Mr. Modugno 20 years ago? Where were these homeowners -20 years ago? Where was V.F.W. POST 6885 20 years ago? In the same location that they were just thrown out of! WHO WAS THERE FIRST? My god, talk about a misuse of justice. In my opinion, these homeowners, charged, brought to trial, and convicted V.F.W. Post 6885 without the benefit of due process of law. The Planning Commission then passed sentence. It is my understanding the Planning Commission re -zoned this area as residential. Yet these homeowners have boasted that they raise sheep and horses. What do they do with these sheep and horses? I for one being the dumb.person that I•am would say that they sell them, period. Maybe this area should have been re -zoned as commercial and not residential. Why would you allow these homeowners to raise sheep and horses in an area zoned as residential? This "private" bar and club has been operating illegally for 15+ years despite the community's repeated complaints to Los Angeles County of public disturbance, code and zoning violations. This is not a matter of patriotism nor snobbishness. It is a land use issue. On factual merits alone, this combination bar, meeting hall, recreation and picnic area attracting crowds on a regional scope for -public events, does not belong in the middle of a residential neighborhood. This is not a local neighborhood use. Local families should be free and "permitted" to enjoy their own homes and yards, at any hour of day or night, without crowd noise, parking lot clamor, and music from public gatherings. "Conditioning" the incompatibility will not make it compatible nor consistent. On the _basis of noise alone, the proposal cannot be made to conform with the surrounding canyon homes. Sound seems to travel remarkable distances in Sand Canyon. Noise from crowds, bands and loud speakers from this hall can be clearly heard over a half a mile away. The close hillsides, various pad elevations and background sound levels create unique and unexpected sound patterns. It is unfair to ask any neighborhood to accept an already demonstrated incompatible use. Compromises simply haven't worked .... nor will conditions! Years of failed "good neighbor" attempts have already shown that the use cannot be made to "fit", despite community patience and the operators' good. intentions. Please deny this CUP and find that the proposed use is incompatible and inappropriate at this location and; It fails to meet the Burden of Proof required for a conditional use by Santa Clarita Municipal Code 22.56.090. (Staff report -last paragraph page 4 and page 5) Is in substantial conflict with the city's adopted General Plan and previous L.A. County plans. The RE land use designation does not provide for this use; as the facility does not primarily serve the immediate vicinity, as required. Please feel free to quote us or distribute this letter. The VFW appears to be running a business in what amounts to an open bar and party spot in the midst of our rural and otherwise quiet community. We have heard many complaints of loud noise/music, crowding, traffic, drunkenness, and lewd conduct (including urinating on neighbor's property). It is evident that the VFW no longer primarily serves a local group of veterans with minimal impact on the community. In addition; the VFW property has been poorly maintained and is generally an eyesore to the community. We would be delighted if the VFW conditional use permit was not granted (or severely restricted). We certainly do not need to encourage driving under the influence of alcohol on Sand Canyon Road which endangers all of us and our children. In addition, property owners located near the VFW certainly do not deserve the ongoing abuse that they have suffered. We realize that the VFW was here long before many of us, however, they have failed to change with the times. Society no longer freely accepts alcohol as the primary reason forgathering. Organizations such as MADD, the stricter laws against drunk driving, and the programs in our local schools are all indications that society is maturing. With Sand Canyon now a -well developed community this situation can no longer be tolerated. Dear Mr. Adamick: The topic of the VFW Post along Sand Canyon at Sultus has been discussed several times in the past few years at the Sand Canyon Home Owners Association (SCHOA) meetings. These discussions generally started because of homeowners complaints. Among the complaints have been: loud parties late into the night, alcohol being consumed by minors on premises, drunkenness on and around the premises, excessively large crowds, and unsanitary conditions. Additionally, the SCHOA is now aware that the VFW has been operating for t^.- pas` two decades The SCHOA recognizes that the key issues regarding the Subject are: 1, is the proposed use compatible with the City's General Plan and 2. is the proposed use compatible with the surrounding area. In both instances, the answer is clearly NO! The SCHOA has been very clear in its desire for no additional commercial enterprises in Sand Canyon south of the Santa Clarita River and this has been reflected in the new General Plan. The surrounding area is a rural equestrian residential area. The proposed, operation is, simply a bar that will draw the majority of its clients from outside the area. This is an issue crucial to the future of the entire canyon. We want to acquaint you with the pertinent facts, history and issues and to request your suggestions, participation and support. The members of this committee have repeatedly received complaints concerning activities taking place on the V.F.W.'s premises. The most frequent concerns are loud band music, large gatherings of people, traffic congestion on Sand Canyon Road, alcoholic litter in the area, drinking in public, rental of the facilities to various groups, tent and motor -home camping, permanent residents in substandard housing, and the sale of alcoholic beverages to non-members. There have even been "open parties" as illustrated on the copy of a flyer we have enclosed. These conditions and others constitute a land use that is not compatible with the rural residential character of the canyon. Moreover, many have pointed out that the V.F.W. principally serves and attracts persons from a broad region of the Santa Clarita Valley, and has not been primarily for local neighborhood use. Since the 1970's -the V.F.W. has operated with full knowledge that their occupancy in an A-1 zone is impermissible. They have operated contrary to law and are otherwise nonconforming.and illegal. After considerable departmental review, in 1975 the case was referred by the County to the District Attorney to require the V.F.W. to comply with zoning laws. Continued promises by the V.F.W. to seek a zone change stalled effective prosecution of the matter until 1978. Requests to legalize nonconforming use status have consistently been denied, commencing in 1974. Accordingly, the City has now required the V.F.W. to apply for a conditional permit. A public hearing on this application to allow the V.F.W. to continue its presently impermissible use and occupation is set for Tuesday, August 20 before the City Planning Commission. If the conditional use permit it seeks is denied, the V.F.W. will be required to cease its operation. If, however, the V.F.W. is permitted to continue operating, this would 1e in conflict with the spirit and intent of the "General Plan", which is to uphold the zoning and integrity of our rural residential community. 11 Page 2 It is imperative that the City not begin de -facto "Spot -Zoning" of inappropriate uses in Sand Canyon. For years, Canon residents have joined together and have been successful in resisting attempts to establish commercial and quasi -commercial uses and zone changes in the canyon. The sole exception is the V.F.W., which has never had the proper zoning or exemption. Mow that the V.F.W.'s usage'is finally before a decision-making body it is critical that this incompatible, nonconforming use be terminated. We do not want this exception to serve as a precedent for other similar commercial proposals. You can make the difference. Talk to your neighbors and call us with your ideas or any input to share with city officials. Most importantly, since the V.F.W. and its members will likely appear in force, please plan to attend the planning commission meeting. Your presence is the only effective way to demonstrate your interest. Without your support, we face the creation of a permitted precedent. This spot -zoning exemption could only result in the erosion of the residential character of Sand Canyon and -the perpetuation of conditions which conflict with the peaceful enjoyment of our homes. This is an issue crucial to the future of the entire canyon. We want to acquaint you with the pertinent facts, history -and issues and to request your suggestions, participation and support. The members of this committee have repeatedly received complaints concerning activities'taking place on the V.F.W.'s premises. The most frequent concerns are loud band music, large gatherings of people, traffic congestion on Sand Canyon Road, alcoholic litter in the area, drinking in public, rental of the facilities to various groups, tent and motor -home camping, permanent residents in substandard housing, and the sale of alcoholic beverages to non-members. There have even been "open parties" as illustrated on the copy of a flyer.we have enclosed. These conditions and others constitute a land use that is not compatible with the rural residential character of the canyon. Moreover, many have pointed out that the V.F.W. principally serves and attracts persons from a broad regionofthe Santa Clarita Valley, and has not been primarily for local neighborhood use. Since the 19700s the V.F.W. has operated with full knowledge that their occupancy in an A-1 zone is impermissible. They have operated contrary to law and are otherwise nonconforming and illegal. After considerable departmental review, in 1975 the case was referred by the County to the District Attorney to require the V.F.W. to comply with zoning. laws. Continued promises by the V.F.W. to seek a zone change stalled effective prosecution of the matter until 1978. Requests to legalize nonconforming use status have consistently been denied, commencing in 1974. Accordingly, the City has now.required the V.F.W. to apply for a conditional permit. A public hearing on this application to allow the V.F.W. to continue its presently impermissible use and.occupation is set for Tuesday, August 20 before the City Planning Commission. If the conditional use permit it seeks is denied, the V.F.W. will be required to cease its operation. If, however, the V.F.W. is permitted to continue operating, this would be in conflict with the spirit and intent of the "General Plan", which is to uphold the zoning and integrity of our rural residential community. 211 Page 2 It is imperative that the City not begin de -facto "Spot -Zoning" of inappropriate uses in Sand Canyon. For years, Canyon residents have joined together and have been successful in resisting attempts to establish commercial and quasi -commercial -uses and zone changes in the canyon. The sole exception is the V.F.W., which has never had the proper zoning or exemption. Now that the V.F.W.'s usage is finally before a decision-making body it is critical that this incompatible, nonconforming use be terminated. We do not want this exception to serve as a precedent for other similar commercial proposals. You can make the difference. Talk to your neighbors and call us with your ideas or any input to share with city officials. Most importantly, since the V.F.W. and its members will likely appear in force, please plan to attend the planning commission meeting. Your presence is the only effective way to demonstrate your interest. Without your support; we face the creation of a permitted precedent. This spot -zoning exemption could only result in the erosion of the residential character of Sand Canyon and the perpetuation of conditions which conflict with the peaceful enjoyment of our homes. When confronted he then claimed to be a "retired deputy", and came at me in a hostile manner.
