HomeMy WebLinkAbout1991-04-09 - AGENDA REPORTS - DEVELOPMENT IMPACT FEE STUDY (2)U AGENDA REPORT City.Manager Approve Item to be presented W , NEW BUSINESS DATE: April 9, 1991 SUBJECT: Development Impact Fee Study DEPARTMENT: Community Development BACKGROUND The consultant firm of Recht, Hausrath and Associates has recently been retained by the City to conduct a Development Impact Fee Study. The consultant has prepared a presentation to the Council for the meeting of April 9, 1991. The consultant will be providing an overview of the study and their approach. and would like to obtain initial input .from the City Council on this subject. A brief memorandum providing an -overview of this study is attached. In view of the importance of this subject and the interrelationship between the City and County for infrastructure provision, service and financing, the County of Los Angeles has been contacted regarding this study with the suggestion that it be a joint venture. The Council' may wish to take this opportunity to establish a small City task force with one or two Council members and City staff and suggest that the County select an equal number of officials and staff to work on this project. City staff has been in contact with County staff and has forwarded a copy of the study work program to them. RECOMMENDATION Receive 'the report by Recht, Hausrath and Associates and provide input as appropriate; appoint one or two Council members to a development impact fee study task force; and direct staff to send a letter to the County inviting participationinthe study. The study started in February. This memo provides an overview of the study's purpose and scope for you Information, and to provide an opportunity for Council input at the early stages of the .study. Purpaw of the .Study Development impact fees are imposed on new development to fund the cost of public facilities required to serve thai development. Fee revenues can not be used to fund existing capital facility deficiencies, or for operating costs. A reasonable relationship, or "nexus" must be docuineated between new development, the cost of facilities to accommodate it, and the fee imposed. The purpose of this study is to provide that documentation for a range of public facilities needed to served new development in the City of Santa Claata. Upon completion, the Council will have the option of imposing fees based on this documentation. The following facility areas are included in the study's scope: • Streets and transit Parks and recreation 0 Sheriff/police 0 Ubraries • Fire 0 Sewer • Child care • Civic center/corporation yard The sheriff/police and library fees will depend on the cooperation of the County because these facilities are owned and operated by that agency. Whether the streets fee includes the Gay's surrounding unincorporated area will also depend on County cooperation. The child care fee will not be developed as an impact fee because of legal constraints, but instead will be proposed as an in -lieu mitigation fee. The draft report will be available for public bearings by cold -June. Following Council adoption of the fees, should that occur, there is a mandatory 60 -day waiting period before the City can begin collecting fees from new development.. Based on this schedule, the City could begin realizing impact fee revenues by September.
