This ordinance would only pertain to activities on public rights of way. It does not affect businesses on private property. RECOMMENDATION Introduce Ordinance -No. 91-25, waive further reading, and pass to second reading. Section 11.38.170 of the Municipal Code for the City of Santa Clarita is amended to read as follows: 11.38.170 Peddling on Highways - Location Restrictions It is unlawful for any person engaged in the business of peddling or selling liquids or edibles for human consumption from wagons or. other vehicles, or any traveling merchant, hawkster or peddler of goods, wares or merchandise who uses a wagon or other vehicle °and who holds a license to engage in any said business in the City, to carry on or conduct any said business upon any portion of a public highway located within the City, or on.a sidewalk adjacent to any such public highway within the City. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner required by law. ATTEST: PASSED AND APPROVED this day of 1991. Harris -- SUBJECT: Draft ordinance relating to peddling on highways and location restrictions Ordinance No; 91-25 DEPARTMENT: Community Development BACKGROUND At its meeting of December 11, 1990, the Council discussed the above item and then introduced the ordinance. On January 8, 1991, the Council was due to adopt this ordinance. However, after receiving public testimony, the Council directed staff to consider certain revisions to the ordinance and bring the ordinance back to the Council at a future date. The attached draft ordinance regulates the location of catering trucks and all other temporary roadside businesses in the City. Required parking provisions of the previous draft have been deleted. Previously, the council had requested staff research whether the City could exempt certain types of peddlers, such as the fruit stands currently seen throughout the City, from any zoning enforcement. Staff researchwith the City Attorney's office found the following; Currently, with respect to "itinerant restaurants," staff has had limited success in enforcing the health code regulations requiring that an "itinerant restaurant" move 500 feet or more every 30 minutes. This is the only enforcement tool available to staff at the present time. If this proposed peddling ordinance is adopted, it would not permit fruit stands, silk plant, rug, hot dog, seafood and pushcart vendors to conduct their activities on City streets and highways. This ordinance would provide us with the necessary enforcement power to effectively address the issue of vendors on the public streets and highways. "Streets and highways" includes the full width of the right-of-way. Finally, this ordinance would be enforced equally and uniformly throughout the City. All street vendors, without exception, would be required to comply. Should the City Council not adopt this ordinance, these vendors would be allowed to continue their activities on the public streets and in the rights-of-way. Staff recommends that the Council adopt Ordinance 91-25 and enforce it uniformly throughout the City. RECOMMENDATION Introduce Ordinance 91-25, waive further reading, and pass to second reading.
