This item is on the agenda to inform Council of the events which will occur
during the next few months before- election. The attached election calendar
includes dates of all activities, adoption of resolutions, campaign: filing
dates, etc. Also attached.is an election calendar from .election consultants,
Martin and Chapman. .

SUGGESTED LAST DAY TO FILE PETITIONS REGARDING MEASURE
(E -130)
If a petition is being circulated about the City to put a measure on the ballot
at the election, d is suggested that the petition be filed by this date in order
to allow the dark the full 3o days to verify the petition and certify it to the
Council. . 1.
FILING PERIOD FOR NOMINATION PAPERS
(E - 89 to 68)
Between these days (bath days included), voters may nominate candidates
for election by signing a nomination paper. Each candidate shall be
proposed by not less than 20 nor more than 30 voters In a city of 1,000
registered voters or more, and not less than 5 nor more than 10 voters in a
city of less than 1,000 registered voters, but only one candidate may be
named In any one nomination paper for the same office. No voter may sign
more than one nomination paper for the same adice, and in theeventhe
does so, his signature shall count only on the first nomination paper filed
which contains his signature. Nomination papers subsequently filed and
containing his signature shall be considered as though his signature does
not appear thereon. Each seat on the governing body is a separate office.
Any person registered to vote at the election may circulate a nomination
paper. Where there are full terms and short terms to be filled, the term shall
be specified in the nomination paper.

Any registered voter of the jurisdiction, including the candidate and/or the
circulator, may sign a nomination paper. The signatures to each nomination
paper shall be appended on the same sheet of paper and each signer shall
print his or her name and place of residence, giving the street and number,
If any; otherwise, such designation of his or her place of residence as will
enable its location to be readily ascertained.

Every nomination paper shall have annexed a declaration of the person who
Circulated it to the effect that he saw written all the signatures appended
thereto and knows that they are the signatures of the persons whose names
they purport to be and the dates between which all signatures to the paper
were obtained.

Each nomination paper shall be accompanied by a verified statement of the
candidate that he will accept the nomination and also accept the office in the
event of his election.
(§ 22839, Elections Code.)
Until 5:00 p.m. on the 68th day before the election, or the 83rd day for any
office requiring an extended filing period, but no later than then, a candidate
may, withdraw his nomination paper after it is filed with the Clerk.

All fortes required for nomination and election to all municipal offices shall
be furnished only by the City Clerk during regular business hours. At the
time of issuance of those fomes the City Clerk shall type in theformsthe
name of the candidate and the office for which he is a candidate, shall
imprint a stamp which reads Official Filing Form, and shall affix his
signature and date. • The forms shall be distributed without charge to all
candidates applying for them.

Each candidate for Mayor and Member of the City Council shall file no later
than the final filing date of nomination papers, his or her statement disclosing
his or her investments and his or her Interests In real property with the Clerk.
The Clerk shall make and retain a copy and forward the original to the Fair
Political Practices Commission.

Each candidate may prepare a candidate's statement on an appropriate form
provided by the Clerk. Such statement may Include the name, age,
occupation, and a brief description of no more than 200 words of the
candidate's education and qualifications expressed by the candidate himself
or herself. Such statement shall be filed at the time nomination papers are
filed unless a runoff or general election Is to occur within 88 days of a
primary or first election, the statement shall then be filed with the clerk by
the third day following the governing body's declaration of the results from
the primary or first election. It may be withdrawn but not changed during the
period for filling nomination papers and until 5:00 p.m. on the day following
the dose of nomination. Candidates statements shall remain confidential
until the expiration of the filing deadline.

Not lessthan10 calendar days before the clerk submits the official voters
pamphlet referred to in § 10012 for printing, the clerk shall make a copy of

the voter's pamphlet available for public examination in the clerk's office. Any
person may obtain a copy of the voter's pamphlet from the clerk for use outside
of the clerk's office. The clerk may charge a fee to any person obtaining a copy
of the material, which fee shall riot exceed the actual cost incurred by the clerk in
providing the copy. '
During the 10ralen lar -day examination period provided by this section, arty voter
of the jurisdiction in which the election is being held, or the clerk, himself or
herself, may seek a writ of mandate or an injunction requiring any or all of the
material in voter's pamphlet to be amended or deleted.

At the time nomination papers are issued, the clerk shall give the candidate a copy
of the Code of Fair Campaign Practices and a copy of §§ 12500 -12528,
Elections Code. Any candidate may subscribe to the Code by filing a copy with the
clerk who shall keep it as a public record.

The Clerk shall give the following hems to each candidate or the candidate's
representative at the time nomination papers are Issued:

LAST DAY TO CALL ELECTION FOR BALLOT MEASURES
(E - 88)
Last day for City Council on its own motion or pursuant to petitions filed under
Elections Cade Articles 1 (Initiative), 2 (Referendum), and 3 (City Charters),
Chapter 2, Division 5 (Commencing with § 4000), DMslon 16 (Recall) (Cortvrancirg
with § 27000) and Chapter 2, Part 1, Division 2, Title 4, Government Code
(commencing with § 34450) (City Charters) to adopt a resolution placing a
measure on the ballot.

LAST DAY TO FILE CAMPAIGN EXPENDITURE STATEMENT- MEASURES
Committees fanned or existing primarily to support or.oppose the qualification of
a ballot measure and proponents of a state ballot measure who control a
committee formed or existing primarily to support the qualification of a measure
shall file a campaign statement 21 days after the deadline for filing petitions. The
closing date for the period covered by a statement required by this subdivision
shall be seven days prior to the deadline for filing the statement
(§ 84200.5r, fiovemmem code.)

SUGGESTED LAST DAY TO FILE ARGUMENTS
(E - 78)
The clerk shall set a date for filing arguments that is approximately ten days after
the City Council calls the election but no later than this date in order to allow
ample time for the 10 -calendar -day public examination period, translation,
typesetting, printing and mailing to the voter. Arguments may be changed or
withdrawn by their proponents until and including the date fixed by the Clerk.

Not less than 10 days before the clerk submits the official election materials
referred to in §§ 4015 (arguments), 4015.5 (rebuttals), 5011 (city attorney
analyses). 5012, 5013, and 5014.5 (arguments), for printing, the clerk shall make
a copy of such material available for public examination in the dark's office. Any
person may obtain a copy of such materials from the clerk for use outside of the
clerk's office. The clerk may charge a fee to any person obtaining a copy of the
material, which fee shall not exceed the actual cost incurred by the clerk in
providing the copy.
During the 10day examination period provided by this section, any voter of the
jurisdiction in which the election is being held, or the dark, himself or herself, may
seek a writ of mandate or an injunction requiring any or all such materials to be
amended or deleted. A peremptory writ of mandate or an injunction shall be
issued only upon demand convincing proof that the material in question is false,
misleading or Inconsistent with the requirements of this Chapter. and tl>at issuance
C the writ or Injunction wit not substantially Interfere with the printing or disebutlon
of official election materials as provided by law.

the 68th day when nomination papers for an incumbent elective officer of
the city were not filed pursuant to §§ 22836 and 22840, Elections Code.
This section is not applicable where there is no Incumbent eligible to be
elected.

Until 5:00 p.m. on the 68th day before the election, or the 63rd day for any
office requiring an extended filing period, but no later than then, a candidate
may withdraw his nomination paper after It is filed with the Clerk.

SECRETARY OF STATE TO DETERMINE ORDER OF NAMES ON
BALLOT
(E - 62)
The Secretary of State shall conduct a drawing of -the letters of the alphabet
constituting a randomized alphabet to be used in determining the order of all
candidates on the ballot. The results of the drawing shall be mailed
immediately to each Clerk.

February 17 — March 31
FILING PERIOD FOR WRITE-IN CANDIDATE
(E - 57 to 14)
Between these days (both days included), any person who desires to have
his or her name as written on the ballot of the election counted for a
particular office shall file a statement of write-in candidacy which shall
contain the candidate's name, residence address, a declaration stating that
he or she is a write-in candidate, the title of the office for which he or she is
running, the date of the election and a nominating petition with the required
number of signatures.

March 5
LAST DAY TO FILE CAMPAIGN EXPENDITURE STATEMENTS
(E-40)
Last day for each candidate and each committee supporting or opposing a
candidate or candidates or supporting or opposing a ballot measure or ballot
measures to file campaign statements with the Clerk. The closing date shall
be 5 days before the filing deadline.

LAST DAY TO REGISTER TO VOTE
(E - 29)
Affidavits of registration shall be accepted at all times except during the 28
days immediately preceding any election, when registration shall cease for
that election as to electors residing in the territory within which the election
is to be held. Transfers of registration for an election may be made from one
precinct to another precinct in the same county at any time when registration Is In
progress in the precinct to which the elector seeks to transfer.

March 16 — April 7
VOTERS MAY REOUEST ABSENTEE BALLOTS
(E - 29 to 7)
Between these days (both days included), any voter entitled to vote by absent
voter ballot may file a written application for an absent voter ballot with the Clerk.
The application shall be signed by the applicant and shall show his place of
residence. Applications received prior to the first day of the period shall be hell
and processed by the Clerk following the first day of the period, in the same
manner as if received at that time.

Any printed application which is to be distributed to voters for requesting absent
voter ballots can have preprinted on the form: (1) The prided name and residence
address of the voter as tt appears on the affidavit of registration; (2) The name and
date of the election for which the request is to be made; and (3) The date the
application must be received by the clerk.
The voter must personally affix: (4) The address to which the ballot is to be
mailed; and (5) The voter's signature.
The law restricts the address to which a ballot can be mailed.
Any application which contains pmpnnted information shall contain a conspicuousy
printed statement as follows: 'You have the legal right to mail or deliver this
application directly to the local elections official of the citywhere you reside'
The application shall provide the voters with information conceming the procedure
for establishing permanent absentee voter status, and the basis upon which
permanent absentee voter status is claimed.
The application shall be attested to by the voter as to the truth and correctness of
its content, and shall be signed under penalty of perjury.

The Secretary of State shall prepare and distribute to appropriate elections officials
a uniform application format foran absent voter's ballot which conforms to the
requirements of this chapter. This format shall be followed by all individuals,
organizations, and groups who distribute applications for an absent voter's banol.
The uniform format need not be utilized by elections officials in preparing an
absent voter's ballot application to be included with the sample ballot.

(a) Any lxfividual, organization. or grog that distributes applications; for absent
voter ballots and receives completed application fortes shall return the farms to the
appropriate elections official within 36 hours of receiving the completed forme, or
before the deadline for application, whichever is sooner. The name of any
organization which authorizes the distribution of the applications shall be Included
on the application.
(b) Any application for an absent voter's ballot which Is sent by a group or
organization to a voter shall be nonfonxarlable. Any absent voters ballot which
Is returned to an elections official as undeliverable shall not be forwarded by the
elections official. -
(§ 1006.3. Elections Code)
The ballot may be delivered to the applicant, his or her spouse, or his or her parent
if the applicant is unmarried. The clerk shall deliver the absentee ballot to the
applicants spouse or parent only if the spouse or parent signs a statement
attested to under penalty of perjury that provides the name of the applicant, his or
her relationship to the applicant, and affirms that he or she is authorized by the
applicant to deliver the absentee ballot.
The official shall send a second absent voter ballot to any voter upon receipt of a
statement under penalty of perjury that the voter has failed to receive, lost or
destroyed his original ballot
The official shall keep a record of each absent voter ballot sent to and received
from a voter and shall verify, prior to counting any duplicate ballot that the voter
has riot attempted to vote twice. Mabdetermined that avoter has attempted
to vote twice, both ballots shall be void.

Absent voters who return to their home precincts on election day may vote Orly 1
they surrender their absent voter ballots to the Inspector of the precinctboerd,
The precinct board shall retum the unused absent voters ballots to ft elections
official in an envelope designated for this purpose.

Any absent voter who is unable to surrender his or her abserltvoters ballot within
the meaning of Section 1012 shall be issued a provisional ballot In accords" 4;.a

All absentee ballots cast under the provisions of this division shall be voted
on or before the day of the election. After marking the ballot, the absent
voter shall either: (1) return the ballot by mail or in person to the official
from whom it came or (2) return the ballot in person to any member of a
precinct board at any polling place within the jurisdiction. However, an
absent voter who, because of Illness or other physical disability, is
unable to return the ballot, may designate his or her spouse, child,
parent, grandparent, grandchild, brother, or sister to return the ballot
to the off total from whom it came or to the precinct board at any polling
place within the jurisdiction. The ballot must, however, be received by
either the official from whom it came or the precinct board before the close
of the polls on election day.
The official shall establish procedures to insure the secrecy of any ballot
returned to a precinct polling place.
The provisions of this section are mandatory, not directory, and no ballot
shall be counted if it is not delivered in compliance with this section.

After the close of the period for requesting absent voter ballots by mail any
voter unable to go to the polls because of illness or disability resulting in his
or her confinement in a hospital, sanatorium, nursing home, or place of
residence, or any voter unable because of a physical handicap to go to his
or her polling place or because of such handicap is unable to vote at his or
her polling place due to existing architectural barriers at his or her polling
place denying him or her physical access to the polling place, voting booth,
or voting apparatus or machinery, or any voter unable to go to his or her
polling place because of conditions resulting in his or her absence from the
precinct on election day may request in a written statement, signed under
penalty of perjury that a ballot be delivered to him or her.. This ballot shall
be delivered by the elections official 10 any authorized representative of the
voter who presents this written statement to the official.
The voter shall mark the ballot, place in It the identification envelope, fill out
and sign the envelope and return the ballot, personally or through the
authorized representative, to either the elections official or any polling place
within the jurisdiction.
These ballots shall be processed and counted in the same manner as other
absentee ballots.
(§ 1017, Elections Code.)
The opening, processing, and counting of absent voter ballots shall be open
to the public, both prior to and after the election.
The clerk shall notify absentee voter observers and the public at least 48
hours in advance of the dates, times, and places where absentee ballots will
be opened, processed, and counted.
Absentee voter observers shall be allowed close enough access to enable
them to observe and challenge whether those individuals handling absentee
ballots are following established procedures, Including: (1) Verifying
signatures and addresses by comparing them to voter registration
information; (2) Duplicating accurately any damaged or detective ballots; (3)
Securing absentee ballots to prevent any tampering with them before they
are counted on election day.
No absentee voter observer shall interfere with the orderly processing and
counting of absentee ballots, including touching or handling of the ballots.

Absent voter ballots mailed to, and received from, voters on the permanent
absent voter list are subject to the same deadlines and shall be processed
and counted in the same manner as all other absent voter ballots.

The clerk may begin to process hand tallied ballots at 5 p.m. on the day
before the election. Results of any absent voter tabulation or count are not
to be released prior to the close of the polls on the day of the election.

The clerk may commence processing machine tallied absentee ballots by
opening envelopes, removing and inspecting the ballots not earlier than
12:00 noon on the day before the election. However, the clerk shall not
count ballots until election day. Results of any absent voter tabulation or
count are not to be released prior to the close of the polis on the day of the
election.

The Elections Official shall keep an accurate list of all voters who have
received and voted an absent voter ballot at each election and compare this
list with the Roster of Voters as provided in § 705 to check whether the voter
has voted more than once in any election.

LAST DAYTO MAIL SAMPLE BALLOTS AND POLLING PLACE NOTICES

Last day for the Clerk to mail to each registered voter a sample ballot and a polling
place notice showing the location of the precinct polling place of the voter. A
sample ballot shall be mailed, postage prepaid, to each voter not more than 40
days' nor less than 10 days before the election.

April 8 — April 14
EMERGENCY ABSENT VOTING PERIOD

Between these days (both days included) any voter may apply for an absentee
ballot if conditions require his or her absence from the precinct on election day.
The voter may designate an authorized representative to pick-up and return the
ballot.

Last day for legislative body, by resolution, to adopt procedures to resolve a tie
vote at a Special Runoff Election. The council shall call the Special Runoff
Election after the Declaration of the Result, recount or judicial certification of the
election which resulted in a tie vote.

The polls shall be open on the day of election between such hours as the City
Council may determine, but not less than eight Consecutive tours. The hours of
opening and closing the polls shall be specified in the notice of election, otherwise,
they shall be the same as provided for general elections. Before the precinct
board receives any ballots, it shall cause It to be proclaimed aloud at the place of
election that the polls are open.

Immediately upon the arrival of thehour when the polls are required by law to be
closed on election day, the clerk shall openly, in the clerk's main office, In the
presence of any persons who are present to observe, place all of the unused
ballots into a special container provided for that purpose. A tamperproof Saw
containing spaces for entering the total number of unused ballots enclosed, the
beginning and ending serial numbers thereof, a statement certifying that all of the
ballots were placed in the container in their presence and the information on the
seal is true and correct shall be signed by the clerk and at least one deputy or
assistant clerk or registrar. After signing the seal, it shall be placed on the
container in a manner that the container cannot be opened without tearing the
seal.
The clerk shall forthwith make and file an affidavit, in writing, as to the number of
unused ballots.

CLERK TO CANVASS ABSENT VOTER BALLOTS

The Clerk, or a canvassing board appointed by the Clerk, shall count the votes
cast by absent voters. The Clerk or board shall commence this count as soon as .
the polls close on the day of election. The canvassing board, if any, shall b

appointed and the absent vote count shall be conducted in the marine
prescribed by §§ 1400 to 1411, Elections Code. The result of the tour
shall be included with the canvass of returns from the precincts.

The clerk may commence reading voters names, opening envelopes
removing stubs, etc. not earlier than 12:00 noon on the day before thr
election for machine tallied ballots or 5:00 p.m. on election day for han(
tallied ballots. Results of any absent voter tabulation or count are not to be
released prior to the close of the polls on the day of the election.

CLERK OR COUNCIL TO CANVASS RETURNS

The City Council shall meet to canvass the returns.

The City Council may, by resolution duly adopted prior to the date o
election, order the canvass to be made by the Clerk prior to the firs
Tuesday after the election. §§ 17082 and 17083 shall govern the conduc
of the canvass. Upon completion of the canvass; the Clerk shall certify the
results to`the Council who shall on the first Tuesday after the electior
comply with the other provisions of § 22932.

Upon completion of the canvass (and before installing new officers), the
council shall adopt a resolution in accordance with §§ 22932 and 22933 0
the Elections Code and the Clerk shall enter in the minutes a statement o
the results.

The Clerk shall immediately issue a Certificate of Election and administer the
oath to each person elected.

The Elections Official shall keep an accurate list of all voters who have
received and voted an absent voter ballot at each election and Compare this
list with the Roster of Voters as provided in § 705 to check whether the vote
has voted more than once in any election.

STATE
On of before April 1 of each odd -numbered year, the clerk of each legislative
body shall file a report with the Secretary of State regarding city measures
considered over the prior two years.
