Application Requirements pertaining to Hazardous Waste
Facilities

BACKGROUND
At its meeting of November 13, 1990, the City Council .adopted Ordinance
No. 90-36 relating to procedures for the siting of hazardous waste
facilities. As part of its deliberation on that ordinance, the. Council
directed staff to draft a resolution establishing application submittal
requirements for hazardous waste facilities.
The attached resolution is provided for Council's consideration: It provides
a list of submittal requirements that supplement the normal review material
required. Due to the unique and sensitive nature of a hazardous waste
facility, additional review material is helpful. A few of the key items
required by the resolution are: (1) relationship of the project site to.
ground water supplies and acquifers; (2) identification of treated and
untreated wastewater generated by the project; (3) an analysis of air quality
impacts; (4) a risk assessment; (5) a monitoring program of air, soil, and
ground water; and (6) an emergency response plan. These materials and items
of information are also beneficial in assessing potential. environmental
impacts as well as reviewing the merit.of the project itself.
RECOMMENDATION
Adopt the attached resolution.

RESOLUTION NO, 91-93
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA CLARITA AMENDING RESOLUTION NO. 90-118,
PERTAINING TO THE APPLICATION SUBMITTAL REQUIREMENTS
OF THE COMMUNITY DEVELOPMENT DEPARTMENT
REGARDING HAZARDOUS WASTE FACILITIES
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. The City Council does hereby find and determine as
follows:
a.
On June 26, 1990, Resolution No. 90-118 was adopted establishing
application submittal requirements of the Community Development
Department.
b.
On November 13, 1990, the City Council adopted Ordinance
No. 90-36 .relating to the .regulation and establishment of
procedures for the siting of hazardous waste facilities.
C.
The Community Development Director has directed that staff
revise the application submittal requirements pertaining to
hazardous waste facilities to ensure proper case review and
filing.
d.
The adoption of this resolution will assist the orderly and
effective implementation of proper land use decision-making in
the City of Santa Clarita.
e.
It shall .be the responsibility of the applicant to assume all
reasonable costs associated with the processing of applications.
SECTION 2. Resolution No. 90-118 is hereby amended to add an
additional Section 6 to read as follows:
"SECTION 6. The application submittal requirements for all
conditional use permits and any other entitlements pertaining to hazardous
waste facilities are hereby established to read as follows:
Contents of Application
Every application for a hazardous waste facility project shall be
made in writing to the Director of Community Development on the forms provided
by the Director of Community Development, and accompanied by a. filing fee as
established by the City Council by resolution. In addition to the standard
filing requirements for conditional use permits, an application shall also
include the following information:

a. Proposed storage and processing areas;
b. the distance from the project property line to. the nearest
adjacent structure, and a description and location of such
structure;
C. proximity of the project to the one hundred (100) year flood
prone areas;
d. proximity of the project to any known earthquake fault zones;
e. the relationship of the proposed project to all above -ground
water supplies and all known underground aquifers that might be
threatened with contamination;
f. topographic description of the property and surrounding area;
g. a preliminary geological study of the property and surrounding
area which comprehends as. deep of a soils analysis as there are
known aquifers, regardless of the potability of those aquifers;
h. .. existing .and proposed .utilities which service or will be
required to service the facility;
i. vicinity map which indicates, at a minimum, proximity of the
project to schools, parks, and other community facilities within
the City of Santa Clarita;
j. identification of all wastewater, treated and untreated,
including stormwater runoff, generated by the proposed facility
and the method and place of final discharge;
k. an analysis of visual, noise, and any olfactory impacts
associated with the project and recommended mitigation measures;
1. an analysis of all anticipated air quality impacts associated
with the project and proposed mitigation measures to ensure no
degradation of air quality in the area;
M. identification of the habitat of any threatened or endangered
species or candidate threatened or endangered species of plant
or animal which may be impacted by the project;
n.^--identification,of.the amounts (in, tons), -sources, and types of
hazardous wastes to be treated, stored, or disposed of at the
proposed facility; the ultimate disposition of the wastes, and
anticipated life of the facility. This information shall be
based on an actual survey of the industries to be served and,
thereby, be representative of the wastes that will be processed
at the facility;
o. a risk assessment which analyzes, in detail, all probabilities
of accidents or spills at the site, transportation related
accidents from the point of origin to the facility, and any
other probabilities requested by either the Director of
Community Development, the Director of Public Works, or the City
Council. Such analyses shall identify mitigation measures to
reduce the identified risks. The risk assessment shall identify
the most. probable routes for transporting hazardous wastes to
the facility;
p.a plan that identifies an ongoing monitoring program of -air,
soil, and groundwater. This plan shall include any monitoring
requirements imposed by other permitting agencies such as, but
not limited to, the South Coast Air Quality Management District,
Regional Water Quality Control Board and Department of Health
Services;
q. all applications shall contain a designation of reasonable
alternative sites which shall be reviewed pursuant to the
California Environmental Quality Act; and
r. an emergency response plan that includes, but which is not
limited to,.the following:
1. Evidence that the proposed plan is consistent with any and
all applicable County and regional emergency response plans
and all City, County, State and Federal regulatory
requirements regarding emergency response procedure.
2. Detailed procedures to be employed at the time of emergency
for each and every type of chemical substance and
emergency, including contingency procedures.
3. Anticipated impacts on local fire, police, and medical
services.
4. Names, home and business addresses, and home and business
telephone numbers of all management personnel at the
facility, if known, and a detailed description of
uncontrolled release and emergency situation reporting
procedures.
5. An application, -shall not be t declared -.complete .: until .-such
emergency response plan is approved by the Director of
Community Development, and Public Works Director."
SECTION 3. The City Council of the City of Santa Clarita has
determined that in accordance with the California Environmental Quality Act,
this request is categorically exempt under Section 15308 (Actions 1by
Regulatory Agencies for Protection of the Environment) of the State CEQA
Guidelines, and requires no further environmental review.
SECTION 4. The City Clerk shall certify the adoption of this
resolution and certify this record to be a fully true, correct copy of the
action taken.
